    R 408 .22101   Scope .

    Rule 1101 . These ru les provide for recor dkeep ing an d report ing by pub-lic an d privat e employers cover ed un der th e act as necess ar y or appropriat e for en for cement of th e act, for developing informat ion regar ding th e cau ses an d prevent ion of occupat iona l injur ies an d illnesses , an d for ma inta ining  a  program  of  colle ct ion,  com pilat ion,  an d  ana lysis  of occu pat iona l safety an d health stat ist ics. Some employers ar e  part ially  exempted  from keepi ng work -relat ed injur y an d illness recor ds.  See R 408 .22103 .

     

    R 408 .22102   Inten t.

    Rule 1102 . (1) These ru les ar e substant ially ident ical to th e fede ra l occu pat iona l safety an d  health  act  (OSH A)  recor dkeep ing  an d  report ing  requirement s,  as  conta ined  in  29

    C.F.R., Part 1904 (2001 ), to assur e that employers ma inta ining recor ds pur suant  to th ese ru les ar e in  com plian ce with  th e fede ra l requirement s an d need  not  ma inta in  additiona l

     

     

    recor ds or submit additiona l report s pur suant to th e fede ra l regulat ions.  R 408 .21119  of th is part perta ins to th e use of OSHA form s.

    (2)     This part sha ll not supersede th e recor dkeep ing an d report ing requirement s prescribed by sections 18 an d 24 of Pu blic Law 91-596 , 29 U.S.C. §§667 an d 673 .

    (3)      If an employer creat es records to comply with an oth er governm ent agencys injur y an d illness recor dkeep ing requirement s, MIOS HA will con sider th e recor ds as com plying with th ese ru les if OSHA or MIOS HA a ccep t s th e oth er agencys recor ds un der a memoran dum of un derstan ding  with  that  agency,  or  if  th e  oth er  agencys  recor ds  conta in  th e  sam e in format ion as th ese ru les requires an employer to recor d.     R 408 .22103   Ex ceptions ; app li ca bility ; petitions .

    Rule 1103 .  (1) Basic requirement s for employers with 10 or fewer employees.

    (a)      If your com pan y ha d 10 or fewer employees at all t imes dur ing th e last calendar year , you do not need to keep MIOS HA injur y an d illness recor ds un less MIOS HA, th e bur eau of labor stat istics (BLS), or th e Un ited Stat es dep artm ent of labor (OSH A), in form s you, in writing, that you mu st keep recor ds a ccor ding to R 408 .22141 or R 408 .22142 . However, as required by R 408 .22139 , all employers cover ed by th e MIOS H act sha ll report to MIOS HA an y work place incident that results in a fata lity or th e hospita lizat ion of 3 or more employees.

    (b)     If your compan y ha d more than 10 employees at an y t ime dur ing th e last calendar year , you mu st keep MIOS HA injur y an d illness recor ds un less your esta blishm ent is classified as a part ially exempt industr y in th is ru le.

    (2)     Implementat ion.

    (a)     Is th e part ial exemption for size based on th e size of my ent ire com pan y or on th e size of an individua l business esta blishm ent ? The part ial  exemption  for  size  is  based  on  th e num ber of employees in th e ent ire compan y.

    (b)        How do I determ ine th e size of my com pan y to find out if I qua lify for th e part ial exemption for size? To determ ine if you ar e exempt becau se of size, you need to determ ine your compan y's peak employment dur ing th e last calendar year . If you did not ha ve more than 10 employees at an y t ime in th e last calendar  year , th en your  com pan y qua lifies for th e part ial exemption for size.

    (3)     Basic requirement s for part ial exemption for esta blishm ent s in certa in industr ies.

    (a)         If your business esta blishm ent is classified in a specific low  ha zar d  reta il,  service, finan ce, insuran ce, or real estat e industr y listed in appe ndix a, you do not need to keep MIOS HA injur y an d illness  recor ds  un less  th e governm ent  asks  you  to keep  th e recor ds a ccor ding to R 408 .22141 or R 408 .22142 . However, all employers mu st report to MIOS HA an y work place incident that results in a fata lity or th e hospita lizat ion of 3 or more employees as required by R 408 .22139 .

    (b)      If 1 or more of your com pan y's esta blishm ent s ar e classified in a nonexempt industr y, th en you mu st  keep  MIOS HA injur y  an d  illness  recor ds  for  all  of such  esta blishm ent s un less your com pan y is part ially exempted becau se of size un der th ese ru les.

    (4)     Implementat ion of part ial exemptions.

     

     

    (a)   Does th e part ial industr y classificat ion exemption apply only to business esta blishm ent s in th e reta il, services, finan ce, insuran ce, or  real  estat e  industr ies  (SICs  52  t89,  see appe ndix  a )?  Yes,  business  esta blishm ent s  classified   in   agricultur e;   con stru ct ion; manu factur ing; tran sportat ion; commun icat ion, electr ic, gas, an d san itar y services; or wholesale tra de ar e not eligible for th e part ial industr y classificat ion exemption.

    (b)   Is th e part ial industr y classificat ion exemption based on th e industr y classificat ion of my ent ire com pan y or on th e classificat ion of individua l business esta blishm ent s operat ed by my com pan y? The part ial industr y classificat ion exemption applies to individua l business esta blishm ent s. If a com pan y ha s severa l business esta blishm ent s engaged in differ ent classes of business activities, some of th e com pan y's esta blishm ent s ma y be required to keep recor ds, while oth ers ma y be exempt.

    (c)    How do I determ ine th e stan dar d industr ial classificat ion code for my com pan y or for individua esta blishm ent s? You determ ine your stan dar d industr ial  classificat ion  (SIC) code by using th e stan dar d industr ial classificat ion manua l (1987 ), Execut ive Office of th e Pr eside nt , Office of Mana gement an d Budget.     (5)     The dep artm ent of con sum er an d industr y services sha ll supply copies of th e form s provided for in th ese ru les an d sha ll com pile, corr ect, an d ana lyze data obta ined pur suant to th ese ru les. The dep artm ent sha ll pr ocess petitions for exceptions to th ese ru les from public employers.     R 408 .22105   De finitio ns ; E, F.

    Rule 1105 .  As used in th is part :

    (a)         “Em ployer mean s an individua l or organ izat ion, including th e stat e or a political subdivisi on, which employs 1 or more person.

    (b)     esta blishm ent mean s a single physical locat ion where business is con ducted or where services or industr ial operat ions ar e per form ed. For activities where employees do not work at a single physical locat ion, such as con stru ct ion; tran sportat ion; commun icat ions; electr ic, gas, an d san itar y services; an d  similar  operat ions,  th e  esta blishm ent  is  represe nt ed  by ma in or bran ch offices , term ina ls, stat ions, an d th e like that eith er supervise th e activities or ar e th e base from which personn el carr y out th e activities. The followin g ar e exam ples of an esta blishm ent :

    (i)     A factory.

    (ii)     Mill.

    (iii)      Store.

    (iv)     Hotel.

    (v)     Res taurant .

    (vi)     Movie th eat er.

    (vii)      Farm . (viii)  Ran ch.

    (ix)     Bank .

     

     

    (x)     Sales Office.

    (xi)     War ehouse.

    (xii)      Centra l administrat ive office.

    (xiii)      A single sch ool with in a sch ool distr ict .

    (xiv)  A city gara ge with in th e dep artm ent of public work s.

    (xv)     A bran ch office of th e dep artm ent of stat e.

    (xvi)      A police stat ion with in th e police dep artm ent of a city.

    (c)     First aid mean s an y of th e followin g:

    (i)         Using a nonprescription medicat ion at nonprescription str ength . (For medicat ions available in both prescription an d nonprescription form , a recomm endat ion by a physician or oth er licensed health car e pr ofessi ona l to use a nonprescription  medicat ion  at prescription str ength is con sidered medical tr eatm ent for recor dkeep ing pur poses).

    (ii)         Administering  tetanu s  immun izat ions.    (Oth er  immun izat ions,  such  as  hepat it is  B va ccin e or ra bies va ccin e, ar e con sidered medical tr eatm ent ).

    (iii)      Clean ing, flushing, or soak ing woun ds on th e sur face of th e sk in.

    (iv)     Using woun d cover ings such as ban dages, Ban d-aidstm , gau ze pads, or th e like; or using butt erfly ban dages or Steri-str ipstm . (Oth er woun d closing devices, such as sutur es, sta ples, an d th e like, ar e con sidered medical tr eatm ent ).

    (v)     Using hot or cold th era py.

    (vi)      Using an y nonr igid mean s of support , such as elastic ban dages, wra ps, nonr igid back belts, or th e like. (Devices that ha ve rigid sta ys or oth er systems designed to imm obilize part s of th e body ar e con sidered medical tr eatm ent for recor dkeep ing pur poses).

    (vii)       Using temporar y imm obilizat ion devices while tran sport ing an  a ccide nt  victim, such as splint s, slings, neck collar s, backboar ds, an d th e like.

    (viii)      Drilling of a fingerna il or toena il to relieve press ur e, or dra ining fluid from a blis ter.

    (ix)     Using eye pat ches.

    (x)     Removing foreign bodies from th e eye using only irr igat ion or a cott on swab.

    (xi)        Removing splint ers or  foreign  mat erial from  ar eas oth er  than  th e eye by irr igat ion, tweeze rs, cott on swabs, or oth er simple mean s.

    (xii)      Using finger guar ds.

    (xiii)        Using ma ssages.   (Ph ysical th era py or chiropra ct ic tr eatm ent  is con sidered medical tr eatm ent for recor dkeep ing pur poses).

    (xiv)      Drink ing fluids for relief of heat str ess .

     

    R 408 .22106   De finitio ns ; H, M.

    Rule 1106 .  As used in th is part :  (a)  Hospita lizat ionmean s th e inpat ient admission to a hospita l for tr eatm ent , obse rvat ion, or an y oth er reason.

    (b) “Medi cal tr eatm ent mean s th e mana gement an d car e of a pat ient to com bat disease or disorder. For th e pur poses of th ese ru les, medical tr eatm ent does not include an y of th e following:

    (i)      Visits to a physician or oth er licensed health car e pr ofessi ona l solely for obse rvat ion or coun seling.

    (ii)        The con duct of diagnostic pr oced ur es, such as x-ra ys an d blood tests, including th e administrat ion of prescription medicat ions used solely for diagnostic pur poses, for exam ple , eye drops to dilat e pupils.

     

     

    (iii)      First aid as defined in R 408 .22105 (c).

     

    R 408 .22107   De finitio ns ; O to Y.

    Rule 1107 .  As used in th is part :

    (a)    “Occu pat iona l injur y or illness mean s an abnorma l con dition or disorder. Occu pat iona l injur y is a result of a work a ccide nt or from an exposur e involving a single incident in th e work environm ent an d includes, but is not limited to, a cut , fra ctur e, spra in, or am putat ion. Occu pat iona l illnesses include both acut e an d chr onic illnesses , including, but  not limited to, a skin disease, respi rat ory disorder, or poisoning.

    (Note: Injur ies an d illnesses ar e recor dable only if th ey ar e new, work -relat ed cases that meet 1 or more of th e recor ding criteria of th ese ru les.)

    (b)       “Oth er potent ially infectious mat erial mean s oth er potent ially infectious mat erial as defined in R 325 .70001 et seq., being th e bloodborn e infectious diseases stan dar d.  These mat erials include th e followin g:

    (i)     Human  bodily fluids, t issues, an d organ s.

    (ii)       Oth er mat erials infected with th e HIV or hepat it is B (HBV) viru s, such as laborat ory cultur es or t issues from expe r imenta l an ima ls.

    (c)     “Ph ysician or oth er licensed health car e pr ofessi ona l” mean s a physician or oth er licensed health car e pr ofessi ona l is an individua l whose legally perm itt ed scope of pra ct ice, that is, license, registrat ion, or cert ificat ion, allows him or her to indepe ndent ly per form , or be delegat ed th e resp onsibili ty to per form , th e activities described by th ese ru les.

    (d)        Recor dable injur ies an d illness mean s an injur y or illness that  meets  th e genera l recor ding criteria, an d th erefor e is recor dable, if it results in an y of th e followin g:

    (a)     Death .

    (b)     Days away from work .

    (c)    Res tr icted work or tran sfer to an oth er job.

    (d)    Medi cal tr eatm ent beyond first aid.

    (e)     Loss of con sciousness .

    An employer mu st also con sider a case as meeting th e genera l recor ding criteria if  it involves a significant injur y or illness  diagnosed  by a  physician  or  oth er  licensed  health car e pr ofessi ona l, even if it does not result in death , days away from work , restr icted work or job tran sfer, medical tr eatm ent beyond first aid, or loss of con sciousness .

    (e)   “SIC mean s th e stan dar d industr ial classificat ion as defined in th e stan dar d industr ial classificat ion manua l (1987 ), Execut ive Office of th e Pr eside nt , Office of Mana gement an d Budget.  “SIC 52 to 89 (see appe ndix a) mean s an y of th e following:

    (i)    Reta il tra de esta blishm ent s (SIC ’s  52 to 59) whose primar y activity con st itut es reta il tra de, including esta blishm ent s engaged in selling merchan dise to th e genera l public for persona l or household con sum ption, such as aut omotive dealers, appar el an d a ccess ory stores, furn itur e an d home furn ishing stores, an d eat ing an d drink ing places.

    (ii)     Finan ce, insuran ce, an d real estat e esta blishm ent s (SIC s 60 to 67) whose primar y activity con st itut es finan ce, insuran ce, an d real estat e, including th ose engaged in bank ing, credit oth er than  bank ing, secur ity dealings, insuran ce, an d real estat e.

    (iii)      Service esta blishm ent (SIC s 70 to 89) whose primar y activity con stitut es services, including esta blishm ent s that provide a var iety of services for individua ls, businesses , governm ent  agencies,  an d  oth er  organ izat ions,  such  as  persona l  an d  business  services;

     

     

    legal, socia l, an d cultura l services; an d membership organ izat ions. For finan ce, insuran ce, real estat e, an d service esta blishm ent s, th e primar y activity of an  esta blishm ent  is determ ined by th e value of receipts of revenu e for services rendered by th e esta blishm ent . In esta blishm ent s with diversified activities, th e activities determ ined to a ccount  for  th e lar gest shar e of production, sales, or revenu e will ident ify th e primar y activity. In some instan ces th ese criteria will not adequat ely represe nt th e relat ive econ omic importan ce of each of th e var ied activities. In such cases , employment or payroll should be used in place of th e norma l basis for determ ining th e primar y activity.

    (f)    “You mean s an employer as defined in section 5 of 1974 PA 154 , MCL 408 .1005 .

    R 408 .22109   Reco rding  crit e ri a.

    Rule 1109 .  Basic recor ding requirement .

    (1)      Ea ch employer required to keep recor ds of fata lit ies, injur ies, an d illnesses  mu st recor d each fata lit y, injur y, an d illness that  involves all of th e followin g:

    (a)     Is work -relat ed.

    (b)     Is a new case.

    (c)      Meets 1 or more of th e genera l recor ding criteria of R 408 .22112  or th e applicat ion to spe cific cases of R 408 .22113 to R 408 .22120 .

    (2)     What  sections of th is ru le describe recor ding criteria for recor ding work -relat ed injur ies an d illnesses ? The followin g list indicat es which ru les address each topic:

    (a)     Determ inat ion of work -relat edness .  See R 408 .22110 .

    (b)     Determ inat ion of a new case.  See R 408 .22111 . Genera l recording criteria.  See R 408 .22112 .

    (3)      How do I decide wheth er a part icular injur y or illness is recor dable? The decision tr ee for recor ding work -relat ed injur ies an d illnesses below shows th e steps involved in mak ing th is determ inat ion.

     

     

     

     

    R 408 .22110   Dete rmina tio n of w ork-relatedness  .

    Rule 1110 . (1) Basic requirement . You mu st con sider an injur y or illness to be work - relat ed if an event or exposur e in th e work environm ent eith er cau sed or contr ibut ed to th e resulting condition or significant ly aggra vat ed  a  preexis t ing  injur y  or  illness .  Work - relat edness is presum ed for injur ies an d illnesses resulting from  event s  or  exposur es occurr ing in th e work environm ent , un less an exception in subru le (2)(b) spe cifically applies.

    (2)     Implementat ion.

    (a)     What is th e "work environm ent "?  MIOS HA defines  th e  work  environm ent  as  "th e esta blishm ent an d oth er locat ions where 1 or more employees ar e work ing or ar e prese nt as a con dition of th eir  employment .  The  work  environm ent includes  not  only  physical locat ions, but also th e equipment or mat erials used by th e employee dur ing th e cour se of his or her work ."

    (i)   Can 1 business locat ion include 2 or more esta blishm ent s? Norma lly, 1 business locat ion ha s only 1 esta blishm ent . Und er limited con ditions, th e employer ma y con sider 2 or more sep arat e businesses that shar e a single locat ion to be sep arat e esta blishm ent s. An employer ma y divide 1 locat ion int o 2 or more esta blishm ent s only when all of th e followin g provisions apply:

    (A)  Ea ch of th e esta blishm ent s represe nt s a distinctly sep arat e business . (B)  Ea ch business is engaged in a different economic activity.

    (C)       A single industr y description in th e stan dar d industr ial classificat ion manua l (1987 ) does not apply to th e joint activities of th e esta blishm ent s.

    (D)     Sep arat e report s ar e rout inely prepar ed for each esta blishm ent on th e num ber of employees, th eir wages an d salar ies, sales or receipts, an d oth er business in format ion.  For

     

     

    exam ple, if an employer operat es a con stru ct ion com pan y at th e sam e locat ion as a lum ber yar d, th e employer ma y con sider each business to be a sep arat e esta blishm ent .

    (ii)      Can an esta blishm ent include more than 1  physical  locat ion?  Yes,  but  only  un der certa in con ditions. An employer ma y com bine 2 or  more physical locat ions int o a  single esta blishm ent only when all of th e followin g provisions apply:

    (A)    The employer operat es th e locat ions as a single business  operat ion  un der  comm on mana gement .

    (B)   The locat ions ar e all locat ed in close proximity to each oth er.

    (C)    The employer keeps 1 set of business recor ds for th e locat ions, such as recor ds on th e num ber of employees, th eir wages an d salar ies, sales or receipts, an d oth er kinds of business in format ion. For exam ple, 1 manu factur ing esta blishm ent might include th e ma in plant , a war ehouse a few blocks away, an d an administrat ive services building across th e str eet.

    (iii)      If an employee telecommut es from home, is his  or  her  home  con sidered  a  sep arat e esta blishm ent ?  No, for employees who telecommut e from home, th e employee' s home is not a business esta blishm ent an d a sep arat e 300 log is not required.  Em ployees  who telecommut e mu st be link ed to 1 of your esta blishm ent s  un der  subdivisi on  (c)  of  th is subru le.

    (b)  Are th ere situat ions where an injur y or illness occur s in th e work environm ent an d is not con sidered work -relat ed? Yes, an injur y or illness occurr ing in th e work environm ent that falls un der an y of th e followin g exceptions is not work -relat ed, an d th erefor e is not recor dable:

     

     

     

     

     

    R 408 .22110 (2)(b)

    Yoar e not  required to record injur ies an d illnesses  if...

    (i)

    At th e t ime of th e in jur y or illness , th e employee was prese nt  in th e work environm ent  as a member of th e genera l public rath er than  as an

    em ployee.

    (ii)

    The in jur y or  illness  involves signs or symptoms that  sur face at  work  but result  solely from  a  non-work -r elat ed  event  or  exposur e that  occur s

    out side  th e work  environm ent .

    (iii)

    The injur y or  illness  results solely from  voluntar y part icipat ion in  a

    wellness program or in  a  medical, fitn ess , or  recreat iona l activity such  as blood donat ion, physical exam inat ion, flu  shot, exercise  class, ra cquetball, or  baseball.

    (iv)

    The injur y or illness  is solely th e result  of an  employee eat ing, drink ing, or  prepar ing food or  drink  for  persona l consum ption  wheth er  bought  on  th e employer's premises  or brought  in  For exam ple, if th e em ployee is injur ed by choking on  san dwich  while in  th e employer's esta blis hm ent , th e case would not  be considered work -r elat ed.   Note:  if th e employee is ma de ill by ingesting food contam inat ed by work place contam inant s, such as lead, or  gets food poisoning from food supplied by th e employer, th en  th e case  would be considered  work -relat ed.

    (v)

    The injur y or illness  is solely th e result of an  employee doing persona l

    ta sks , unr elat ed to his or her employment  at  th e esta blis hm ent  out side of th e employee' s assigned  work ing hour s.

    (vi)

    The injur y or  illness  is solely the result  of persona l grooming, self- medicat ion  for  a  non-work -relat ed  condition, or  is int ent iona lly self- inflicted.

    (vii)

    The injur y or illness  is cau sed  by a motor vehicle accident  an d occur s on a compan y park ing lot  or  compan y access  road while th e employee is commut in g t o or fr om work .

    (viii)

    The illness  is th e comm on cold or flu (note :  conta gious diseases  such as tu berculosis, bru cellosis, hepat it is a , or  plague ar e considered  work -

    relat ed if th e employee is infected at  work ).

    (ix)

    The illness  is menta l illness .   Menta l illness  will not be considered  work -r elat ed  un less  th e employee voluntar ily provides  th e employer  with

    an  opinion from  physician  or oth er licensed  health  car e professi ona l who ha s appropriat e tra ining an d expe rience (psychiatr ist , psychologist,

    psychiatr ic nur se pra ct it ioner, or  th e like) stat ing that  th e employee ha s a menta l illness  that  is work -relat ed.

     

     

     

    (c) How do I han dle a case if it is not obvious wheth er th e precipitat ing event or exposur e occurr ed in th e work environm ent or occurr ed away from work ? A preexis t ing injur y or illness ha s been significant ly aggra vat ed, for pur poses of MIOS HA injur y an d illness recor dkeep ing, when an event or exposur e in th e work environm ent results in an y of th e following:

    (i)     Death , if th e preexis t ing injur y or illness would likely not ha ve resulted in death but for th e occu pat iona l event or exposur e.

    (ii)       Loss of con sciousness , provided that th e preexis t ing injur y or illness would likely not ha ve resulted in loss of con sciousness but for th e occu pat iona l event or exposur e.

    (iii)    One or more days away from work , or days of restr icted work , or days of job tran sfer that oth erwise would not ha ve occurr ed but for th e occu pat iona l event or exposur e.

    (iv)      Medi cal tr eatm ent in a case where medical tr eatm ent was not needed for th e injur y or illness befor e th e work place event or exposur e, or a chan ge in medical  tr eatm ent  was necessi tat ed by th e work place event or exposur e.

    (e)     Which injur ies an d illnesses ar e con sidered preexis t ing con ditions?  An injur y or illness is a preexis t ing con dition if it resulted solely from a  non-work -relat ed  event  or  exposur e that  occurr ed out side th e work environm ent .

    (f)  How do I decide wheth er an injur y or illness is work -relat ed if th e employee is on tra vel statu s at th e t ime th e injur y or illness occur s? Injur ies an d illnesses that occur while an employee is on tra vel statu s ar e work -relat ed if, at th e t ime of th e injur y or illness , th e employee was engaged in work activities "in th e int erest of th e employer." Exam ples of such activities include tra vel to an d  from  customer  conta cts,  con ducting  job  ta sks ,  an d ent erta ining or being ent erta ined to tran sact, discuss, or promote business (work -relat ed ent erta inm ent includes only ent erta inm ent activities being engaged in at  th e direction of th e employer).

    Injur ies or illnesses that occur when th e employee is on tra vel statu s do not ha ve to be recor ded if th ey meet an y of th e exceptions listed below.

    (i)

    Checked int o a hotel or motel for 1 or more

    days.

    When a tra veling employee checks int o a

    hotel, motel, or oth er temporar y reside nce, he or she esta blishes a "home away from

    home." You mu st evaluat e th e employee' s activities after he or she checks int o th e

    hotel, motel, or oth er temporar y reside nce for his or her work -relat edness in th e

    sam e mann er as you evaluat e th e

    activities of a non-tra veling employee.

    When th e employee checks int o th e temporar y reside nce, he or she is con sidered to ha ve left th e work

    environm ent .  When th e employee begins work each day, he or she re-ent ers th e work environm ent .  If th e employee ha s esta blished a "home away from home" an d is report ing to a fixed work site each day, you also do not con sider injur ies or

    illnesses work -relat ed if th ey occur while th e employee is commut ing between th e

    temporar y reside nce an d th e job locat ion.

    (ii)

    Tak en a detour for persona l

    reasons.

    Injur ies or illnesses ar e not con sidered work -relat ed if th ey occur while th e

    employee is on a persona l detour from a reasona bly direct rout e of tra vel, that  is,

    ha s tak en a side tr ip for persona l reasons.

     

    (g)     How do I decide if a case is work -relat ed when  th e  employee  is  work ing  at  home? Injur ies an d illnesses that occur while an employee is work ing at home, including work in a home office, will be con sidered work -relat ed if th e injur y or illness occur s while th e employee is per form ing work for pay or com pensat ion in th e home, an d th e injur y or illness is directly relat ed to th e per forman ce of work rath er than to th e genera l home environm ent or sett ing. For exam ple, if an employee drops a box of work docum ent s an d injur es his or her foot , th e case is con sidered work -relat ed. If an employee' s fingerna il is pun ctur ed by a needle from a sewing ma chine used to per form garm ent work at home, becom es infected an d requires medical tr eatm ent , th e injur y is con sidered work -relat ed. If an employee is injur ed becau se he or she tr ips on th e fam ily dog while ru shing to an swer a work phone call, th e case is not con sidered work -relat ed. If an employee work ing at home is electr ocut ed becau se of fau lty home wiring, th e injur y is not con sidered work -relat ed.

     

     

     

    R 408 .22111   Dete rmina tio n of ne w cases .

    Rule 1111 . (1) Basic requirement . You mu st con sider an injur y or illness to be a "new case" if eith er of th e followin g applies:

    (a)       The employee ha s not previously expe rienced a recor ded injur y or illness of th e sam e type that  a ffect s th e sam e part of th e body.

    (b)      The employee previously expe rienced a recor ded injur y or illness of th e sam e type that a ffect ed th e sam e part of th e body but ha d recover ed com pletely (all signs an d symptoms ha d disappe ar ed) from th e previous injur y or illness an d an event or exposur e in th e work environm ent cau sed th e signs or symptoms to reappe ar .

    (2)       Implementat ion. When an employee expe riences th e signs or symptoms of a chr onic work -relat ed illness , do I need to con sider each recurr ence of signs or symptoms to be a new case? No, for occu pat iona l illnesses  where th e signs or symptoms ma y recur or cont inu e in th e abse nce of an exposur e in th e work place, th e case mu st only be recor ded once. Exam ples include occu pat iona l can cer, asbes tosis, byssi nosis, an d silicosis.

    (3)   When an employee expe riences th e signs or symptoms of an injur y or illness as a result of an event or exposur e in th e work place, such as an epis ode of occu pat iona l asthma , mu st I tr eat th e epis ode as a new case? Yes, becau se th e epis ode or recurr ence was cau sed  by an event or exposur e in th e work place, th e incident mu st be tr eat ed as a new case.

    (4)     May I rely on a physician or oth er licensed health  car e  pr ofessi ona l  to  determ ine wheth er a case is a new case or a recurr ence of an old case? You ar e not required to seek th e advice of a physician or oth er licensed health car e pr ofessi ona l. However, if you do seek such advice, you mu st follow th e physician or oth er licensed health car e pr ofessi ona l's recomm endat ion about wheth er th e case is a new case or a recurr ence.  If you  receive recomm endat ions from 2 or more physician s or oth er licensed health car e pr ofessi ona ls, you mu st mak e a decision as  to  which  recomm endat ion  is  th e  most  auth oritat ive  (bes t docum ent ed, bes t reasoned, or most auth oritat ive), an d recor d th e case based upon that recomm endat ion.

    Rule 1112 . (1) Basic requirement . You mu st con sider an injur y or illness  to meet th e genera l recor ding criteria, an d th erefor e to be recor dable, if it results in an y of th e following:

    (a)     Death .

    (b)     Days away from work .

    (c)    Res tr icted work or tran sfer to an oth er job.

    (d)    Medi cal tr eatm ent beyond first aid.

    (e)       Loss of con sciousness . You mu st also con sider a case to meet th e genera l recor ding criteria if it involves a significant injur y or illness diagnosed by a physician  or  oth er licensed health car e pr ofessi ona l, even if it does not result in death , days away from work , restr icted work or job tran sfer, medical tr eatm ent beyond first aid, or loss of con sciousness .

    (2)     Implementat ion.

    (a)    How do I decide if a case meets 1 or more of th e genera l recor ding criteria? A work - relat ed injur y or illness mu st be recor ded if it results in 1 or more of th e followin g:

    (i)     Death .  See subdivisi on (b) of th is subru le.

     

     

    (ii)     Days away from work .  See subdivisi on (c) of th is subru le.

    (iii)      Res tr icted work or tran sfer to an oth er job.  See subdivisi on (d) of th is subru le.

    (iv)     Medi cal tr eatm ent beyond first aid.  See subdivisi on (e) of th is subru le. (v) Loss of con sciousness .  See subdivisi on (f) of th is subru le.

    (vi) A significant injur y or illness  diagnosed by a physician  or oth er licensed health  car e pr ofessi ona l.  See subdivisi on (g) of th is subru le.

    (b)       How do I recor d a work -relat ed injur y or illness that results in th e employee' s death ? You mu st recor d an injur y or illness that results in death by ent ering a check mark on th e MIOS HA 300 log in th e space for cases resulting in death . You mu st also report an y work - relat ed fata lity to MIOS HA with in 8 hour s, as required by R 408 .22139 .

    (c)   How do I recor d a work -relat ed injur y or illness that results in days away from work ? When an injur y or illness involves 1 or more days away from work , you mu st recor d th e injur y or illness on th e MIOS HA 300 log with a check mark in th e space for cases involving days away an d an entr y of th e num ber of calendar days away from work in th e num ber of days column . If th e employee is out for an extended period of t ime, you mu st ent er  an estimat e of th e days that th e employee will be away, an d updat e th e day count when th e actua l num ber of days is kn own.

    (i)       Do I count th e day on which th e injur y occurr ed or th e illness began ? No, you begin count ing days away on th e day after th e injur y occurr ed or th e illness began .

    (ii)        How do I recor d an injur y or illness  when  a  physician  or  oth er  licensed  health  car e pr ofessi ona l recomm ends that th e work er  sta y at  home but  th e employee com es  to work an yway? You mu st recor d th ese injur ies an d illnesses on th e MIOS HA 300 log using th e check box for cases with days away from work an d ent er th e num ber of calendar days away recomm ended by th e physician or oth er licensed health car e pr ofessi ona l. If a physician or oth er licensed health car e pr ofessi ona l recomm ends days away, you should en coura ge your employee to follow that recomm endat ion. However, th e  days  away  mu st  be  recor ded wheth er  th e  injur ed   or   ill  employee   follows   th  physician   or   licensed   health   car e pr ofessi ona l's recomm endat ion or not. If you receive recomm endat ions from 2 or more physician s or oth er licensed health car e pr ofessi ona ls, you ma y mak e a decision as to which recomm endat ion is  th e  most  auth oritat ive,  an d  recor d  th e  case  based  upon  that recomm endat ion.

    (iii)        How do I han dle a case when a physician or oth er licensed health car e pr ofessi ona l recomm ends that th e work er return to work but  th e employee sta ys at  home an yway?  In th is situat ion, you mu st end th e count of days away from work on th e dat e th e physician or oth er licensed health car e pr ofessi ona l recomm ends that  th e employee return  to work .

    (iv)      How do I count weekends, holidays, or oth er days th e employee would not ha ve work ed an yway?  You mu st count th e num ber of calendar days th e employee was una ble to work as a result of th e injur y or illness , regar dless of wheth er or not th e employee was scheduled to work on th ose days. Weekend days, holidays, vacat ion days, or oth er days off ar e included in th e tota l num ber of days recor ded if th e employee would not ha ve been able to work on th ose days becau se of a work -relat ed injur y or illness .

    (v)       How do I recor d a case in which a work er is injur ed or becom es ill on a  Fr iday an d report s to work on a Monday, an d was not scheduled to work on th e weekend? You need to recor d th is case only if you receive in format ion from a physician or oth er licensed health car e  pr ofessi ona l indicat ing that  th e  employee  should  not  ha ve  work ed, or  should  ha ve

     

     

    per form ed only restr icted work , dur ing th e weekend. If so, you mu st recor d th e injur y or illness as a case with days away from work or restr icted work , an d ent er th e day count s, as appropriat e.

    (vi)       How do I recor d a case in which a work er is injur ed or becom es ill on th e day befor e scheduled t ime off such as a holiday, a plann ed vacat ion, or a temporar y plant closing? You need to recor d a case of th is type only if you receive in format ion from a physician or oth er licensed health car e pr ofessi ona l indicat ing that th e employee should not ha ve work ed, or should ha ve per form ed only restr icted work , dur ing th e scheduled t ime off. If so, you mu st recor d th e injur y or illness as a case with days away from work or restr icted work , an d ent er th e day count s, as appropriat e.

    (vii)       Is th ere a limit to th e num ber of days away from work I mu st count ? Yes, you ma y "ca p" th e tota l days away at 180 calendar days. You ar e not required to keep tra ck of th e num ber of calendar days away from work if th e injur y or illness resulted in more than 180 calendar days away from work or days of job tran sfer or restr ict ion, or both . In such a case, ent ering 180 in th e tota l days away column will be con sidered adequat e.

    (viii)       May I stop count ing days if an employee who is away from work becau se of an injur y or illness retires or leaves my com pan y? Yes, if th e employee leaves your com pan y for some reason unr elat ed to th e injur y or  illness , such  as  retirement , a  plant  closing, or  to tak e an oth er job, you ma y stop count ing days away from work or days of restr ict ion /job tran sfer. If th e employee leaves your com pan y becau se of th e injur y or illness , you mu st estimat e th e tota l num ber of days away or days of restr ict ion /job tran sfer an d ent er th e day count on th e MIOS HA 300 log.

    (ix)     If a case occur s in one year but results in days away dur ing th e next calendar year , do I recor d th e case in both year s?  No, you only recor d th e injur y or illness  once.  You mu st ent er th e num ber of calendar days away for th e injur y or illness on th e MIOS HA 300 log for th e year in which th e injur y or illness occurr ed. If th e employee is still away from work becau se of th e injur y or illness when you prepar e th e annua l summar y, estimat e th e tota l num ber of calendar days you expe ct th e employee to be away from work , use th is num ber to calculat e th e tota l for th e annua l summar y, an d th en updat e th e initial log entr y lat er when th e day count is kn own or reaches th e 180 -day cap.

    (d)      How do I recor d a work -relat ed injur y or illness that results in restr icted work or job tran sfer? When an injur y or illness involves restr icted work or job tran sfer but does not involve death or days away from work , you mu st  recor d  th e  injur y  or  illness  on  th e MIOS HA 300 log by placing a check mark in th e space for job tran sfer or restr ict ion an d an entr y of th e num ber of restr icted or tran sferr ed days in th e restr icted work days column .

    (i)       How do I decide if th e injur y or illness resulted in restr icted work ? Res tr icted  work occur s when, as th e result of a work -relat ed injur y or illness eith er of th e followin g occur s:

    (A)     You keep th e employee from per form ing 1 or more of th e rout ine fun ct ions of his or her job, or from work ing th e full work day that he or she would oth erwise ha ve been scheduled to work .

    (B)      A physician or oth er licensed health car e pr ofessi ona l recomm ends that th e employee not per form 1 or more of th e rout ine fun ct ions of his or her job, or not work th e full work day that  he or she would oth erwise ha ve been scheduled to work .

     

     

    (ii)        What is meant by "rout ine fun ct ions"? For  recor dkeep ing  pur poses,  an  employee' s rout ine fun ct ions ar e th ose work activities th e employee regular ly per form s at least once per week.

    (iii)      Do I ha ve to recor d restr icted work or job tran sfer if it applies only to th e day on which th e injur y occurr ed or th e illness began ? No, you do not ha ve to recor d restr icted work or job tran sfers if you, or th e physician or oth er licensed health car e  pr ofessi ona l,  impose  th e restr ict ion or tran sfer only for th e day on which th e injur y occurr ed or th e illness began .

    (iv)        If you or a physician or oth er licensed health  car e pr ofessi ona l recomm ends  a  work restr ict ion, is th e injur y or illness aut omat ically recor dable as a "restr icted work " case?  No, a recomm ended work restr iction is recor dable only if it a ffect s 1 or more of th e employee' s rout ine job fun ct ions. To determ ine wheth er  th is  is  th e  case,  you  mu st  evaluat e  th e restr ict ion in light of th e rout ine fun ct ions  of th e  injur ed  or  ill  employee' s  job.  If  th e restr ict ion from you or th e physician or oth er licensed health car e pr ofessi ona l keeps th e employee from per form ing 1 or more of his or her rout ine job fun ct ions, or from work ing th e full work day th e injur ed or ill employee would oth erwise ha ve work ed, th e employee' s work ha s been restr icted an d you mu st recor d th e case.

    (v)     How do I recor d a case where th e work er work s only for a part ial work shift becau se of a work -relat ed injur y or illness ? A part ial day of work is recor ded as a day of job tran sfer or restr ict ion for recor dkeep ing pur poses , except for th e day on which th e injur y occurr ed or th e illness began .

    (vi)      If th e injur ed or ill work er produces fewer goods or services than he or she would ha ve produced befor e th e injur y or illness , but oth erwise per form s all of th e rout ine fun ct ions of his or her work , is th e case con sidered a restr icted work case? No, th e case is con sidered restr icted work only if th e work er does not per form all of th e rout ine fun ctions of his or her job or does not work th e full shift that  he or she would oth erwise ha ve work ed.

    (vii)         How do I han dle vague restr ict ions from a physician or oth er licensed health car e professi ona l, such as that th e employee engage only in "light dut y" or "tak e it easy for a week"? If you ar e not clear about th e physician or oth er licensed health car e pr ofessi ona l's recomm endat ion, you ma y ask that person wheth er th e employee can do all of his or her rout ine job fun ct ions an d work all of his or her norma lly assigned work shift. If th e an swer to both of th ese questions is "yes," th en th e case does not involve a work restr ict ion an d does not ha ve to be recor ded as such. If th e an swer to 1 or both of th ese questions is "no," th e case involves restr icted work an d mu st be recor ded as a restr icted work case.  If you ar e una ble to obta in th is additiona l in format ion from  th e physician  or  oth er  licensed  health car e pr ofessi ona l who recomm ended th e restr ict ion, th en recor d th e injur y or illness as a case involving restr icted work .

    (viii)        What do I do if a physician or oth er licensed health car e pr ofessi ona l recomm ends a job restr ict ion meeting MIOS HA's definition, but th e employee does all of his or her rout ine job fun ct ions an yway? You mu st record th e injur y or illness on th e MIOS HA 300 log as a restr icted work case. If a physician or oth er licensed health car e pr ofessi ona l recomm ends a job restr ict ion, you should ensur e that th e employee com plies with that restr ict ion. If you receive recomm endat ions  from  two  or  more  physician s  or  oth er  licensed  health  car e pr ofessi ona ls,  you  ma y  mak e  a  decision  as  to  which   recomm endat ion   is   th  most auth oritat ive, an d recor d th e case based upon that  recomm endat ion.

     

     

    (ix)      How do I decide if an injur y or illness involved a tran sfer to an oth er job? If you assign an injur ed or ill employee to a job oth er than his or her regular job for part of th e day, th e case involves tran sfer to an oth er job. Note: th is does not  include th e day on  which  th e injur y or illness occurr ed.

    (x)       Are tran sfers to an oth er job recor ded in th e sam e way as restr icted work  cases? Yes, both job tran sfer an d restr icted work cases ar e recor ded in th e sam e box on th e MIOS HA 300 log. For exam ple, if you assign, or a physician or oth er licensed health car e pr ofessi ona l recomm ends that you assign, an injur ed or ill work er to his or her rout ine job dut ies for part of th e day an d to an oth er job for th e rest of th e day, th e injur y or illness involves a  job tran sfer. You mu st record an injur y or illness that involves a  job tran sfer  by placing a check in th e box for job tran sfer.

    (xi)       How do I count days of job tran sfer or restr ict ion? You count days of job tran sfer or restr ict ion in th e sam e way you count days away from work , using subdivisi on (c)(i) to (viii) of th is subru le. The only differ ence is that , if you perman ent ly assign th e injur ed or ill employee to a job that ha s been modified or perman ent ly chan ged in  a  mann er  that eliminat es th e rout ine fun ct ions th e employee was restr icted from per form ing, you ma y stop th e day count when th e modificat ion or chan ge is ma de  perman ent . You  mu st  count  at least 1 day of restr icted work or job tran sfer for such cases.

    (e)   How do I recor d an injur y or illness that  involves medical tr eatm ent beyond fir st aid?  If a work -relat ed injur y or illness results in medical tr eatm ent beyond  first  aid, you  mu st recor d it on th e MIOS HA 300 log. If th e injur y or illness did not involve death , 1 or more days away from work , 1 or more days of restr icted work , or 1 or more days of job tran sfer, you ent er a check mark in th e box for cases where th e employee received medical tr eatm ent but rema ined at work an d was not tran sferr ed or restr icted.

    (i)            What is  th e  definition  of  medical  tr eatm ent ?  "Medi cal  tr eatm ent "  mean th e mana gement an d car e of a pat ient to com bat disease or disorder. For th e pur poses of th ese ru les, medical tr eatm ent does not include an y of th e followin g:

    (A)     Visits to a physician or oth er licensed health car e pr ofessi ona l solely for obse rvat ion or coun seling.

    (B)        The con duct of diagnostic pr oced ur es, such as x-ra ys an d blood tests, including th e administrat ion of prescription medicat ions used solely for diagnostic pur poses, such as eye drops to dilat e pupils.

    (C)     "First aid" as defined in para gra ph (ii) of th is subdivisi on.

    (ii)         What is "fir st aid"? For th e pur poses of th ese ru les, "fir st aid" mean s an y of th e following:

    (A)        Using a nonprescription medicat ion at nonprescription str ength . For medicat ions available in both prescription an d nonprescription form , a recomm endat ion by a physician or oth er licensed health car e pr ofessi ona l to use a nonprescription  medicat ion  at prescription str ength is con sidered medical tr eatm ent for recor dkeep ing pur poses.

    (B)         Administering  tetanu s  immun izat ions.  Oth er  immun izat ions,  such  as  hepat it is  B va ccin e or ra bies va ccin e, ar e con sidered medical tr eatm ent .

    (C)     Clean ing, flushing, or soak ing woun ds on th e sur face of th e sk in.

    (D)    Using woun d cover ings such as ban dages, Ban d-aids TM , gau ze pads, or th e like; or using butt erfly ban dages or Steri-str ips TM or oth er woun d closing devices, such as sutur es, sta ples, or th e like is con sidered medical tr eatm ent .

     

     

    (E )  Using hot or cold th era py.

    (F ) Using an y nonr igid mean s of support , such as elastic ban dages, wra ps, nonr igid back belts, or th e like. Devices that ha ve rigid sta ys or oth er systems des igned to imm obilize part s of th e body is con sidered medical tr eatm ent for recor dkeep ing pur poses.

    (G)     Using temporar y imm obilizat ion devices while tran sport ing an a ccide nt victim, such as splint s, slings, neck collar s, back boar ds, an d th e like.

    (H)     Drilling of a fingerna il or toena il to relieve press ur e, or dra ining fluid from a blis ter. (I) Using eye pat ches.

    (J )  Removing foreign bodies from th e eye using only irr igat ion or a cott on swab.

    (K)       Removing splint ers or foreign mat erial from ar eas oth er than th e eye by irr igat ion, tweeze rs, cott on swabs, or oth er simple mean s.

    (L)     Using finger guar ds.

    (M)        Using ma ssages.  Ph ysical th era py or  chiropra ct ic tr eatm ent  is  con sidered  medical tr eatm ent for recor dkeep ing pur poses.

    (N)     Drink ing fluids for relief of heat str ess .

    (iii)          Are  an y  oth er  pr oced ur es  included  in  first  aid?  No,  th is  is  a  com plete  list  of all tr eatm ent s con sidered first aid for th e pur poses of th ese ru les.

    (iv)       Does th e pr ofessi ona l statu s of th e person providing th e tr eatm ent ha ve an y effect on what is con sidered first aid or medical tr eatm ent ? No, MIOS HA con siders th e tr eatm ent s listed in para gra ph (ii) of th is subdivisi on to be first aid regar dless of th e pr ofessi ona l statu s of th e person providing th e tr eatm ent . Even when th ese tr eatm ent s ar e provided by a physician or oth er licensed health car e pr ofessi ona l, th ey ar e con sidered fir st aid. Similar ly, MIOS HA con siders tr eatm ent beyond fir st aid to be medical tr eatm ent even when it is provided by someone oth er than  a physician or oth er licensed health car e pr ofessi ona l.

    (v)        What if a  physician  or  oth er  licensed  health  car e pr ofessi ona l recomm ends  medical tr eatm ent but th e employee does not follow th e recomm endat ion? If a physician or oth er licensed health car e pr ofessi ona l recomm ends medical tr eatm ent , you should en coura ge th e injur ed or ill employee to follow that recomm endat ion. However, you mu st recor d th e case even if th e injur ed or ill employee does not follow th e physician or oth er licensed health car e pr ofessi ona l's recomm endat ion.

    Note: MIOS HA believes that most significant injur ies an d illnesses will result in 1 of th e criteria listed in subru le (1) of th is ru le, such as: death , days away from work , restr icted work or job tran sfer, medical tr eatm ent beyond first aid, or loss of con sciousness . However, th ere ar e some significant injur ies, such as a pun ctur ed ear drum or a fra ctur ed toe or rib, for which neith er medical tr eatm ent nor work restr ict ions ma y be recomm ended.     R 408 .22113   Reco rding  crit eri a for need les tick  and  sha rps in ju ri es .

    Rule 1113 . (1) Basic requirement .  You mu st recor d all work -relat ed needles t ick injur ies an d cut s from shar p objects that ar e contam inat ed with an oth er persons blood or oth er potent ially infectious mat erial, as defined in R 325 .70001 et seq., being bloodborn e infectious diseases stan dar d. You mu st ent er th e case on th e MIOS HA 300 log as an injur y. To protect th e employees privacy, you ma y not ent er th e employees nam e on th e MIOS HA 300 log (see th e requirement s for privacy cases in R 408 .22129 (7) to (10).

    (2)     Implementat ion.

    (a)       What does “oth er potent ially infectious mat erial mean ? The term “oth er potent ially infectious mat erials is defined in R 408 .22107 (2).  These mat erials include th e followin g:

    (i)     Human  bodily fluids, t issues, an d organ s.

    (ii)       Oth er mat erials infected with th e HIV or hepat it is B (HBV) viru s, such as laborat ory cultur es or t issues from expe r imenta l an ima ls.

    (3)      Does th is mean that I mu st recor d all cut s, lacerat ions, pun ctur es, an d scrat ches? No, you need to recor d cut s, lacerat ions, pun ctur es, an d scrat ches only if th ey ar e work -relat ed an d involve contam inat ion with an oth er persons  blood  or  oth er  potent ially  infectious mat erial. If th e cut , lacerat ion, or scrat ch involves a clean object, or a contam inant oth er than blood or oth er potent ially infectious mat erial, you need to recor d th e case only if it meets 1 or more of th e recor ding criteria in R 408 .22112 .

    (4)     If I record an injur y an d th e employee is lat er diagnosed with an

    infectious bloodb orn e disease, do I need to updat e th e MIOS HA 300 log? Yes, you mu st updat e th e classificat ion of th e case on th e MIOS HA 300 log if th e case results in death , days away from work , restr icted work , or job tran sfer. You mu st also updat e th e description to ident ify th e infectious disease an d chan ge th e classificat ion of th e case from an injur y to an illness .

    (5)     What if one of my employees is splashed or exposed to blood or oth er potent ially infectious mat erial with out being cut or scrat ched? Do I need to recor d th is incident ? You need to recor d such an incident on th e MIOS HA 300 log as an illness if an y of th e followin g provisions apply:

    (a)      It results in th e diagnosis of a bloodborn e illness , such as HIV, hepat it is B, or hepat it is C.

    (b)   It meets 1 or more of th e recor ding criteria in R 408 .22112 .

    Rule 1114 . (1) Basic requirement . If an employee is medically removed un der th e medical sur veill an ce requirement s of an MIOS HA stan dar d, you mu st recor d th e case on th e MIOS HA 300 log.

     

     

    (2)     Implementat ion.

    (a)      How do I classify medical removal cases on th e MIOS HA 300 log? You mu st ent er each medical removal case on th e MIOS HA 300 log as eith er a case involving days away from work or a case involving restr icted work activity, depe nding on how you decide to com ply with th e medical removal requirement . If th e medical removal is th e result of a chemical exposur e, you mu st ent er th e case on th e MIOS HA 300 log by checking th e "poisoning" column .

    (b)      Do all of MIOS HA's stan dar ds ha ve medical removal provisions? No, some MIOS HA stan dar ds, such as th e stan dar ds cover ing bloodborn e path ogens an d noise, do not ha ve medical removal provisions. Man y MIOS HA stan dar ds that  cover  specific  chemical substan ces ha ve medical removal provisions. These stan dar ds include, but ar e not limited to, lead, cadmium , meth ylene chloride, forma ldehyde, an d benzene.

    (c)       Do I ha ve to recor d a case where I voluntar ily removed th e employee from exposur e befor e th e medical removal criteria in a MIOS HA stan dar d ar e met? No,  if  th e  case involves voluntar y medical removal before th e medical removal level s  required  by  a MIOS HA stan dar d, you do not need to recor d th e case on th e MIOS HA 300 log.

    Rule 1117 . (1) Basic requirement . If an y of your employees ha s been occupat iona lly exposed to an yone with a kn own case of active tu berculosis  (TB),  an d  that  employee subseq uent ly develops a tu berculosis infection, as evide nced by a positive sk in test or diagnosis by a physician or oth er licensed health car e pr ofessi ona l, you mu st recor d th e case on th e MIOS HA 300 log by checking th e "respi rat ory condition" column .

    (2) Implementat ion. (a) Do I ha ve to recor d, on th e log, a  positive TB  sk in  test  result obta ined at a preemployment physical? No, you do not ha ve to recor d it becau se  th e employee was not occu pat iona lly exposed to a kn own case of active tu berculosis in your work place.

    (b) May I line-out or era se a recor ded TB case if I obta in evide nce that th e case was not cau sed by occu pat iona l exposur e? Yes, you  ma y  line-out  or  era se  th e case  from  th e log un der th e an y of th e followin g circum stan ces:

    (i)      The work er is living in a household with a person who ha s been diagnosed with active TB.

    (ii)       The public health dep artm ent ha s ident ified th e work er as a conta ct of an individua l with a case of active TB unr elat ed to th e work place.

    (iii)      A medical investigat ion shows that th e employee' s infection was cau sed by exposur e to TB away from work , or proves that  th e case was not relat ed to th e work place TB exposur e.

You mu st ent er in format ion about your business at th e top of th e MIOS HA 300 log, ent er a 1 or 2-line description for each recor dable injur y or illness , an d summar ize th is in format ion on th e MIOS HA 300 -a at th e end of th e year .

    (3)     What do I need to do to com plete th e MIOS HA 301 incident report ?  You mu st com plete a MIOS HA 301 incident report form , or an equivalent form , for each recordable injur y or illness ent ered on th e MIOS HA 300 log.

    (4)      How quickly mu st each injur y or illness be recor ded? You mu st ent er each recor dable injur y or illness on th e MIOS HA 300 log an d 301 incident report with in 7 calendar days of receiving informat ion that  a recor dable injur y or illness ha s occurr ed.

    (5)     What is an equivalent form ?  An equivalent form is one that  ha s th e sam e in format ion, is as readable an d un derstan dable, an d is com pleted using th e sam e instru ct ions as th e MIOS HA form it replaces. Man y employers use an insuran ce form instead of th e MIOS HA 301 incident report , or supplement an insuran ce form by adding an y additiona l in format ion required by MIOS HA.

    (6)       May I keep my recor ds on a com put er? Yes, if th e com put er can produce equivalent form s when th ey ar e needed , as des cribed un der R 408 .22135 an d R 408 .22140 , you ma y keep your recor ds using th e com put er system.

    (7)      Are th ere situat ions where I do not put th e employee' s nam e on th e form s for privacy reasons? Yes, if you ha ve a "privacy con cern case," you ma y not ent er th e employee' s nam e on th e MIOS HA 300 log. Instead, ent er "privacy case" in th e space norma lly used for th e employee' s nam e. This will protect th e privacy of th e injur ed or ill employee when an oth er employee, a form er employee, or an auth orized employee represe ntat ive is provided a ccess to th e MIOS HA 300 log un der R 408 .22135 (3). You mu st keep a sep arat e, con fident ial list of th e case num bers an d employee nam es for your privacy con cern cases so you can updat e th e cases an d provide th e in format ion to th e governm ent if asked to do so.

    (8)     How do I determ ine if an injur y or illness is a privacy con cern case? You mu st con sider all of th e followin g injur ies or illnesses to be privacy con cern cases:

    (a)     ) An injur y or illness to an int imat e body part or th e reproductive system.

    (b)     )  An injur y or illness resulting from a sexua l assau lt .

    (c)    Menta l illnesses .

     

     

    (d)    HIV infection, hepat it is, or tu berculosis.

    (e)       Needles t ick injur ies an d cut s from shar p objects that ar e contam inat ed with an oth er person's  blood  or  oth er  potent ially  infectious   mat erial   (see    408 .22113 (2)  an  R 408 .22107 (2) for definitions).

    (f)     Oth er illnesses , if th e employee indepe ndent ly an d voluntar ily requests that his or her nam e not be ent ered on th e log. After J anuar y 1, 2003 , mu sculoske leta l disorders (MSDs ) ar e not con sidered privacy con cern cases .

    (9)      May I classify an y oth er types of injur ies an d illnesses as privacy con cern cases ?  No, th is is a com plete list of all injur ies an d illnesses con sidered privacy con cern cases for th e pur poses of th ese ru les.

    (10)        If I ha ve removed th e employee' s nam e, but st ill believe that th e employee ma y be ident ified from th e in format ion on th e form s, is th ere an yth ing else that I can do to furth er protect th e employee' s privacy? Yes, if you ha ve a reasona ble basis to  believe  that informat ion des cribing th e privacy concern case ma y be persona lly ident ifiable even th ough th e employee' s nam e ha s been omitt ed, you ma y use discretion in des cribing th e injur y or illness on both th e MIOS HA 300 an d 301 form s. You mu st ent er enough in format ion to ident ify th e cau se of th e incident an d th e genera l severity of th e injur y or illness , but you do not need to include deta ils of an int imat e or privat e natur e. For exam ple, a sexua l assau lt case cou ld be des cribed as "injur y from assau lt ," or an injur y to a reproductive organ cou ld be described as "lower abdomina l injur y."

    (11)      What mu st I do to protect employee privacy if I wish to provide a ccess to th e MIOS HA form s 300 an d 301 to persons oth er than governm ent represe ntat ives, employees, form er employees, or auth orized represe ntat ives? If you decide to voluntar ily disclose th e form s to persons  oth er  than  governm ent   represe ntat ives,   employees,   form er   employees,   or auth orized represe ntat ives, as required by R 408 .22135 an d R 408 .22140 , you mu st remove or hide th e employees' nam es an d oth er persona lly ident ifying in format ion, except for th e followin g cases . You ma y disclose th e form s with persona lly ident ifying in format ion only as follows:

    (a)       Do I need to keep MIOS HA injur y an d illness recor ds for short -term esta blishm ent s, that is, esta blishm ent s that will exist for less than a year ? Yes, however, you do not ha ve to keep a sep arat e MIOS HA 300 log for each such esta blishm ent . You ma y keep 1 MIOS HA 300 log that cover s all of your short -term esta blishm ent s. You ma y also include th e short - term esta blishm ent s' recor dable injur ies an d illnesses on a MIOS HA 300 log that cover s short -term esta blishm ent s for individua l com pan y divisions or geogra phic regions.

    (b)      May I keep th e recor ds for all of my esta blishm ent s at my headquart ers locat ion or at some oth er centra l locat ion? Yes, you ma y keep th e recor ds for an esta blishm ent at your headquart ers or oth er centra l locat ion if you com ply with both of th e followin g provisions:

    R 408 .22131   Cove red emp loyees .

    Rule 1131 . (1) Basic requirement . You  mu st  recor d  on  th e  MIOS HA  300  log  th e recor dable injur ies an d illnesses of all employees on your payroll, wheth er th ey ar e labor, execut ive, hour ly, salar y, part -t ime, seasona l, or migrant work ers. You also mu st recor d th e recor dable injur ies an d illnesses that occur to employees who ar e not on your payroll if you supervise th ese employees on a day-t o-da y basis. If your business is organ ized as a sole proprietorship or partn ership, th e owner or partn ers ar e  not  con sidered  employees  for recor dkeep ing pur poses.

    (2)     Implementat ion.

     

     

    (a)      If a self-em ployed person is injur ed or becom es ill while doing work at my business , do I need to recor d th e injur y or illness ? No, self-em ployed individua ls ar e not cover ed by th ese ru les.

    (b)     If I obta in employees from a temporar y help service, employee leasing service, or personn el supply service, do I ha ve to recor d an injur y or illness occurr ing to one of th ose employees? You mu st recor d th ese injur ies an d illnesses if you supervise th ese employees on a day-t o-da y basis.

    (c)  If an employee in my esta blishm ent is a contra ctor's employee, mu st I recor d an injur y or illness occurr ing to that employee? If th e contra ctor's employee is un der th e day-t o-da y supervision of th e contra ctor, th e contra ctor is resp onsible for recor ding  th e  injur y  or illness . If you supervise th e contra ctor employee' s work on a day-t o-da y basis, you mu st recor d th e injur y or illness .

    (d)   Must th e personn el supply service, temporar y help service, employee leasing service, or contra ctor also recor d th e injur ies or illnesses occurr ing to temporar y, leased, or contra ct employees that I supervise on a day-t o-da y basis?     Rule 1132 .  (1)  Basic requirement .  At th e end of each calendar year , you mu st do all of th e following:

    (a)      Review th e MIOS HA 300 log to verify that th e entr ies ar e com plete an d a ccurat e, an d corr ect an y deficiencies ident ified.

    (b)     Creat e an annua l summar y of injur ies an d illnesses recorded on th e MIOS HA 300 log.

    (c)    Cert ify th e summar y.

    (d)    Post th e annua l summar y.

    (a)     How extensively do I ha ve to review th e MIOS HA 300 log entr ies at th e end of th e year ? You mu st review th e entr ies  as  extensively  as  necess ar y  to  mak e  sur e  that  th ey  ar e com plete an d corr ect.

    (d)     Who is considered a compan y execut ive? The compan y execut ive who cert ifies th e log mu st be an y of th e followin g persons:

Yes, dur ing th e stora ge period, you mu st updat e your stored MIOS HA 300 logs to include newly discover ed recor dable injur ies or illnesses an d to show an y chan ges that ha ve occurr ed in th e classificat ion of previously recor ded injur ies an d illnesses . If th e description or out com e of a case chan ges, you mu st remove or line out th e origina l entr y an d ent er  th e  new informat ion.

    (b)    Do I ha ve to updat e th e annua l summar y? No, you ar e not required to updat e th e annua l summar y, but you ma y do so if you wish.

    (c)    Do I ha ve to updat e th e MIOS HA 301 incident report s? No, you ar e not required to updat e th e MIOS HA 301 incident report s, but you ma y do so if you wish.

    Rule 1134 . If your business chan ges ownership, you ar e resp onsible for recor ding an d report ing work -relat ed injur ies an d illnesses only for that period of th e year dur ing which you owned th e esta blishm ent . You mu st tran sfer your recor ds un der th is part to th e new owner. The new owner mu st save all recor ds of th e esta blishm ent kept by th e prior owner, as required by R 408 .22133 , but need not updat e or corr ect th e recor ds of th e prior owner.

     

    R 408 .22135   Emp loyee  invo lvement .

    Rule 1135 . (1) Basic requirement . Your employees an d th eir represe ntat ives mu st be involved in th e recor dkeep ing system as follows :

    (a)     You mu st in form each employee of how he or she is to report an injur y or illness to you.

    (b)    You mu st provide limited a ccess to your injur y an d illness  recor ds for your  employees an d th eir represe ntat ives.

     

     

    (2)    Implementat ion. What mu st I do to mak e sur e that  employees  report  work -relat ed injur ies an d illnesses to me?

    (a)     You mu st set up a way for employees to report work -relat ed injur ies an d illnesses promptly.

    (b)   You mu st t ell each employee how to report work -relat ed injur ies an d illnesses to you.

    (3)   Do I ha ve to give my employees an d th eir represe ntat ives a ccess to th e MIOS HA injur y an d illness recor ds? The sur vey sha ll produce adequat e estimat es for most  4-digit  stan dar d industr ial classificat ion (SIC) industr ies in manu factur ing an d for 3-digit SIC classificat ion in nonmanu factur ing.

    Rule 1162 . Upon receipt of an occupat iona l injur ies an d illness sur vey form un der R 408 .22161 , an employer sha ll promptly com plete th e  form  pur suant  to th e  instru ct ions conta ined in th e form an d return it in a ccor dan ce with th e instru ct ions.  Noth ing in th ese ru les sha ll a ffect th e dut ies of employers to submit stat istical report form s un der th is part .
