NOTICE OF PUBLIC HEARING
Certificate of Need and
Certificate of Need Hearing Procedures
The Department of Community Health will hold a public hearing on Wednesday, January 5, 2011, at 9
a.m. at the Department of Community Health, 201 Townsend, 1st Floor, Conference Center Rooms A, B
& C, Lansing, Michigan.
The public hearing is being held to receive comments from interested persons on the proposed changes to clarify ambiguity that currently exists in the rules, address needed changes brought about from Public Act 619 of 2002, and to conform with current department practice. The proposed rules will rescind the current certificate of need administrative rules last revised March 27, 1996. The proposed rules will also amend the hearing process for the Certificate of Need program in accordance with the Administrative Procedures Act.
The “Certificate of Need” rules (2010-018 CH) will move through the promulgation process with a companion rule set entitled, “Certificate of Need Hearing Procedures” (2010-019 SR), which will be promulgated by the State Office of Hearings and Administrative Rules (SOAHR).

These rules are being promulgated under the authority conferred on the director of community health by sections 2226, 2233, and 22255 of 1978 PA 368, MCL 333.226, MCL 333.233, and MCL 333.22255,
Executive Reorganization Order No. 1996-1, MCL 330.101, and by the State Office of Administrative Hearings and Rules, in accordance with Executive Reorganization No. 2005-1, MCL 445.2021. These rules are proposed to take effect immediately upon filing with the Secretary of State.
