    EMPLOYMENT SECURITY BOARD OF REVIEW- PART 2.

    APPEALS TO REFEREES

     

    January 30, 2013

    The Department of Licensing and Regulatory Affairs will hold a public hearing on

    Wednesday January 30, 2013 starting at 10:00 a.m. at the General Office Building (Courtroom 3), 7150 Harris, Dimondale, Michigan 48909.

     

    The public hearing is being held to receive comments on the proposed modifications of R 421.1203 and R 421.1208—Appeals to an Administrative Law Judge administrative rules.

     

    The proposed rule modification of R 421.1203 will redefine the number of days required for notification of a hearing before an unemployment administrative law judge. This rule change will reduce the minimum requirement for mailing a notice from 10 calendar days before the hearing, to 7 calendar days before the hearing. The proposed amendment of R 421.1208 will specify that unemployment appeal hearings will be conducted by telephone as a standard. In-person hearings will only be granted by the Executive Director of the Michigan Administrative Hearing System (MAHS) or his or her designee.

    Currently, MAHS conducts approximately 30% of its hearings by telephone. This rule change will assist MAHS in meeting Federal timeliness standards by reducing the time required to give parties notification of an upcoming hearing and by allowing greater scheduling flexibility.

     

    These rules are being promulgated by authority conferred on the Director of the Department of Licensing and Regulatory Affairs by section 34 of 1936 (Ex. Sess.) PA 1, MCL 421.34 and Executive Reorganization Order Nos. 1996-2, 2003-1, 2011-4, 2011-6 MCL 445.2001, 445.2011, 445.2030 and

    445.2032

     

    Comments on the proposed rules may be presented in person at the public hearing.
