TRIBUNAL RULES OF PRACTICE AND PROCEDURE RULE SET 2012-130 LR TRIBUNAL COURTROOM NO. 3

The Michigan Tax Tribunal will hold a public hearing on January 11, 2013, to receive comments from interested person regarding proposed revisions to the Tribunal’s Rules of Practice and Procedure as published in the January, 2013, issue of the Michigan Register.  The hearing will be held in Tribunal Courtroom No. 3 in the General Office Building, 1st Floor, A-Wing, at 7150 Harris Drive, Dimondale, MI, 48821, and commence at 9:30 a.m.

 

The Tribunal is quasi-judicial administrative body within the Michigan Administration Hearing System (“MAHS”) that functions as a tax court.  The Tribunal is authorized to promulgate rules and establish fees by Sections 32 and 49 of 1973 PA 186, MCL 205.732 and 205.749.  The Tribunal’s Rules of Practice and Procedure are similar to the Michigan Court Rules and govern the filing of documents, the payment of fees, and the conduct of hearings in both divisions of the Tribunal – Entire Tribunal and Small Claims Division.  The Tribunal is proposing to reorganize and revise its Rules of Practice and Procedure to implement an electronic filing system and modify existing practices to so as to make them consistent with statutory requirements and to expedite the processing and resolution of appeals filed with and pending before the Tribunal.

 

The proposed rules (Rule Set 2012-130 LR) are available on Michigan Government web site at  http://www.michigan.gov/mahs and copies may also be obtained from the Tribunal by submitting a request by mail, electronic transmission, or by telephone.  The Tribunal’s mailing and e-mail addresses; and telephone numbers are as follows:

Written comments on the proposed rules may be submitted to the Tribunal’s Chief Clerk, Peter Kopke, by 5:00 p.m. on January 11, 2013, at the Tribunal mailing address noted above.
