    Rule 1.  (1) "Auth or it y" m e an s th e Mich igan s tat e fa ir auth or it y.  As used in th ese ru les: (a) "Agricultura l exhibitor" mean s a person who ent ers an  exhibit in th e agricultura l an d livest ock section of th e fair.

    (b)    "Comm ercial exhibitor" mean s a holder of a comm ercial exhibit lice n se PE RMIT , his or her agent , or des ignat ed represe ntat ive.

    (c)   "Comm ission" mean s th e comm ission of agricultur e.

    (d)  "Commun ity art s exhibitor" mean s person who ent ers an exhibit in th e commun ity art s section of th e fair.

     

     

    (e)  "Concessi on  stan d" mean s a  stan d  w h ich  THAT  sells  an d  imm ediat ely  delivers  food, bevera ges, specialty items, balloon s, art work , novelties, or oth er like items to fair patr ons.

    (f)  "COUN CIL " MEANS THE STATE EXPOSITIO N AND FAIRGROUNDS  COUN CIL .

    (g)   "Director" mean s th e director of th e dep artm ent of agricultur e.

    (h)      "Educat iona l  exhibitor"  mean s  an  educat iona l,  char ita ble,  or  nonpr ofit  cor porat ion exhibitor who is grant ed a lice n se PE RMIT by th e fa ir .

    (i) "Exhibit" mean s an art icle, item, OR livest ock or p ou ltr y ent ered for public display at th e fair.

    (j) "Fa ir" mean s th e annua l fair sta ged at Detr oit by th e agricultur e comm ission, with th e advice of th e a d vis or y coun cil, an d con sisting of a com petitive an d educat iona l exhibit of agricultura l comm odities; livest ock an d poultr y; an d manu factur ed products  for  which awar ds an d premium s ma y be paid; industr ial, comm ercial, an d recreat iona l pur suits; an d oth er relat ed activities.

    (k)   "F ood con cessi on" mean s a place or stan d which sells or serves food or bevera ges, or both , an d includes A RESTAURANT OR GRABST AND OR BOTH th e followin g:

    "Genera l mana ger" mean s th e genera l mana ger of th e fair.

    Rule 4.  Lice n ses PE RMITS ar e classified as follows :

    (a)   "Building or groun ds lice n se PE RMIT " mean s an agreement , oth er than a lease, for use of an y part of th e buildings or fairgroun ds when th e fair is not in operat ion.

    (b)    "Comm ercial exhibit lice n se PE RMIT " mean s a perm it to operat e a stan d, exhibit, or building, th e ma in pur pose of which is to exhibit comm ercial products to solicit prospective buyers or to mak e direct sales at th e fair.

    (c)   "Concessi on lice n se PE RMIT " mean s a perm it  to operat e  a  con cessi on  stan d  for  th e pur pose of mak ing direct sales to patr ons of th e fair.

    (2) A person seek ing con cessi on space sha ll fill out an applicat ion form . iss u ed by th e sp a ce ut iliz at ion se ct ion .  THE APP LIC ANT SHALL SIGN  THE affidavit of ownership  s ha ll be s ign ed by an a pp licant an d atta ch THE AFF IDAVIT to th e applicat ion.

    THE FAIR SHALL GRANT A PE RMIT TO A concessi ona ir e with WHO HAS esta blished sat isfactory per forman ce recor ds  at  th e  fair  will  be  grant ed  lice n ses  befor e  lice n ses  A PE RMIT is issued to A new con cessi ona ire. Und e r th e s u pe r vis ion of The genera l mana ger OR DESIGN EE th e sp a ce ut iliz at ion se ct ion s u pe r vis or sha ll determ ine th e eligibili ty an d des ira bility of th e new concessi on request BASED ON VEN DOR MIX AND SUIT ABILIT Y TO FAMIL Y EN TERTAINM EN T, SPACE AVAILABILIT Y, AND CONSIS TEN CY WITH FAIR VALUES .

    (3) An a pp licat ion  an d  comm e r cia l  exh ibi t or  lice n se  r e ceived  by  th e  sp a ce  ut iliz at ion se ct ion s ha ll be s u b m itt ed , t oge th e r with it s r e comm e n d at ion s , t o th e ge n e ra l mana ge r , an d u p on th e a d vice of th e auth or it y, th e n ma y be s u b m itt ed t o th e d ir e ct or for a pp r ova l.

    Rule 19.     Rule 22. If th e premises occu pied by a lice n see THE PE RMIT HOLDER, concessi ona ire, or lessee ar e IS des tr oyed in an y degree, or left in an un clean con dition as a result of th e use of th e premises by th e lice n see PE RMIT HOLDER, con cessi ona ire, or lessee , THEN th e genera l mana ger  will  SHALL  repair  or  clean  th e  premises  an d  char ge  th e  lice n see PE RMIT HOLDER, con cessi ona ire, or lessee th e cost of s u ch THE labor an d mat erials.

    Rule 31. An exhibitor or concessi ona ire will SHALL be grant ed a ccess to th e fairgroun ds an d exhibit buildings fr om 8:30 a .m . t o 5:00 p .m . d a ily, excep t S atur d a ys an d S un d a ys , for 10 w ork in g d a y s AS DEF IN ED BY PE RMIT before th e opening day of th e fa ir for  th e pur pose of prepar ing his OR HE R exhibits or con cessi ons. A comm e r cia l exh ibi t or will be grant ed a ccess t o comm e r cia l exh ibi t b u ild in gs 2 d a ys be for e th e ope n in g d a y of th e fa ir fr om 8:30 a .m . t o 5:00 p .m .  Spe cia l w r itt e n pe rm iss ion t o se t u p e ar lie r s ha ll be ob ta in ed fr om th e ge n e ra l mana ge r .

    Rule 32. (1) THE GENE RAL MANAGER SHALL CANCEL  a  space  a llotm ent  an d lice n se PE RMIT ma y be can celed if an exhibitor or con cessi ona ire fa ils to occu py th e space a llott ed to him OR HE R with th e exhibit or con cessi on BY THE DATE spe cified on his OR HE R lice n se PE RMIT be for e th e ope n in g of th e fa ir or for violat ion for an y stat e law, city ordinan ce, or th ese ru les.

    (2) An exhibitor or con cessi ona ire ma y can cel th e space a llott ed to him OR HE R for th e fair by advising th e genera l mana ger in writing on or before J uly 15 of th e year in which he OR SHE ha s a lice n se a gr ee m e nt PE RMIT .

    Rule 33 . The genera l mana ger r ese r ve s th e  r ight  t o  MAY  require  an  exhibitor  or con cessi ona ire to locat e or move his OR HE R exhibit or con cessi on to s om e AN ALTERNATE site, DUE TO  SAFE TY CONSI DERATIO NS  OR  IN  if it  is  for  th e  bes t int erest of th e fair. If th e fair cann ot find a suita ble alternat e site, THEN th e exhibitor or con cessi ona ire is e nt it le d t o SHALL RECEIVE a pro rata  refun d of space rent paid.

    Rule 34 .  The genera l mana ger ma y can cel a  lice n se PE RMIT  in  case  of labor  un ion d ifficu lt ie s DIS PU TES involving an exhibitor or concessi ona ire which ma y lead to or result in a str ike or picketing of th e fairgroun ds.  An  exhibitor or con cessi ona ire whose  lice n se PE RMIT is can celed is e nt it le d t o SHALL RECEIVE a pro rata refun d of un earn ed renta l for th e balan ce of th e period provided for in his OR HE R lice n se  PE RMIT .  I n s u ch a ca se , n o lia bili t y for  d ama ge is  char ge a ble  t o th e s tat e of Mich igan , it s  office r s , a ge nt s , an d e m p loyee s.

    Rule 36. (1) AN EXHIBITOR SHALL CONS TRUCT AN exhibit in a building s ha ll be con s tru ct ed so as not to obstru ct th e public's view of an adjacent exhibit.

    Rule 52. (1) On th e opening day of th e fair an d at all t imes  th e r e a ft e r , THE  exhibitor an d concessi ona ire vehicles sha ll COMPLY WITH ALL OF THE FOLLOWI NG PROVISIONS :

    (a)     Displ ay a comm ercial sticker issued by th e genera l mana ger.

    (b)         S ha ll  Ent er  th e  fa irgroun ds  thr ough  th e  service  gat e  des ignat ed  by  th e  genera l mana ger.

    (c)    S ha ll Be subject to inspection by th e des ignat ed officer s.

    (2) Dur ing th e fair all vehicles servicing exhibits an d con cessi ons sha ll ent er th e groun ds thr ough th e des ignat ed service gat e. Fa ir clean -up personn el will SHALL sweep th is refuse from comm ercial buildings an d ar eas adjacent to con cessi on stan ds each night after th e buildings an d str eets ar e emptied. Fa ir clean -up personn el ar e for bidde n t o SHALL NOT ent er th e exhibitor's booth s with in buildings or con cessi on stan ds.

    (2)       IF AN EXHIBITOR OR CONCESSION AIRE DESTRO YS THE PREMIS ES IN ANY MANNE R, OR IF THE PREMIS ES IS LEF T IN AN UN CLEAN CONDITIO N AS A RESULT  OF  THE  USE  OF  THE  PREMIS ES  BY  THE  EXHIBITOR  OR CONCESSION AIRE, THEN THE GENE RAL MANAGER SHALL REP AIR OR CLEAN THE PREMIS ES AND CHARGE THE EXHIBITOR OR CONCESSION AIRE.
