3 NOTICE OF PUBLIC HEARING

    NOTICE OF PUBLIC HEARING

     

    The Michigan Liquor Control Commission will hold a public hearing on Wednesday, October 14, 2009 at 11:00 a.m. in the Commission’s Hearing Room, 2nd Floor, General Office Building, 7150 Harris Drive, Lansing, Michigan, to consider the follow proposed rule amendments:

     

    ·         R 436.1107 (2009-013 LG) of the Commission’s “Licensing Qualifications” rules to allow the extension of the 5-year escrow period.

    ·         R 436.1629 (2007-057 LG) of the “Beer” rules which sets the deposit and refund of beer barrels to a minimum of $30.00 and requires the deposit on all refillable containers over five gallons.

    ·         R 436.1865 (2009-012 LG) of the “Vendor Representative and Salesperson” rules to equalize the number of drinks that can be purchased by a vendor representative or salesperson of a manufacturer of beer, a wholesaler of beer, or an outstate seller of beer for promotional purposes to the number of drinks that can be purchased by a vendor representative or salesperson of spirits or wine.

    ·         R 436.1533 (2009-014LG) of the “Off- Premise Licenses” rules will be added to establish requirements for off-premises server training programs.

     

    These rules are being promulgated under the authority conferred on the Michigan Liquor Control Commission by section 215(1) of Act No. 58 of the Public Acts of 1998, as amended.  These rules will take effect immediately upon filing with the Secretary of State.

     

    The rules are published on the Michigan Government web site at http:www.michigan.gov/soahr and in the October 1, 2009 issue of the Michigan Register.  Copies of the proposed rules may be obtained at the Liquor Control Commission’s Lansing Office during regular business hours.     All interested persons are invited to attend the hearing to present data and views orally or in writing. Anyone unable to attend may submit comments in writing to Mrs. Hogan at the above address.  Written comments must be received by October 30, 2009.  The hearing site is accessible, including handicapped parking.  Individuals attending the meeting are requested to refrain from using heavily scented personal care products in order to enhance accessibility for everyone.  Persons needing accommodations for effective participation in the meeting should contact Mrs. Hogan at 517-322-1359 two weeks in advance.
