NOTICE OF PUBLIC HEARING BOARD OF OPTOMETRY - GENERAL RULES

MONDAY, NOVEMBER 23, 2009

9:00 A.M

RULE SET # 2008 – 018 CH

 

The Department of Community Health will hold a public hearing on Monday, November 23, 2009 at 9:00 a.m. at the Department of Community Health, Ottawa Building, 611 West Ottawa, Conference Room 1, Upper Level, Lansing, Michigan.

 

The public hearing is being held to receive comments from interested persons on amendments to the Michigan Board of Optometry Administrative Rules.  The rules are being amended to 1) require an applicant for licensure to have graduated from a professional optometric degree program and hold the doctor of optometry degree, and 2) establish requirements for a person who was first licensed in another

U.S. state or territory or Canadian province, including verifying that he or she had practiced optometry for the time specified in the rule and had passed Michigan’s jurisprudence examination.  New provisions will also be added to clarify the requirements for obtaining either an educational limited license or a clinical academic license.  In addition, the current rule on unethical and ethical conduct will be rescinded and replaced by a new rule that will specify activities, when performed by an optometrist, that will be considered prohibited conduct.

 

These rules are being promulgated under the authority of sections 16145 and 17401 et seq. of 1978 PA 368, MCL 333.16145 and MCL 333.17401 et seq. and Executive Reorganization Order Nos. 1996-1, 1996-2 and 2003-18, MCL 330.3101, 445.2001 and 445.2011. The rules will take effect immediately upon filing with the Secretary of State, unless specified otherwise in the rules.

 

Comments on the proposed rules may be presented in person at the public hearing.  Written comments may be submitted at the time of presentation and also will be accepted until November 30, 2009 at 5
