R 285 .808 .1  De finitio ns .

Rule 1. As used in th ese ru les:

(a)    "Breede r" mean s a person or persons domiciled in Michigan  an d owning a mar e at  th e t ime of breedi ng.

(b)   "Director" mean s th e director of th e Michigan dep artm ent of agricultur e.

(c)   "Domicile" mean s th e fixed, perman ent , an d principal home to which a person int ends to return .

(d) "Fa ir" mean s a count y, distr ict , commun ity, or 4-H fair; th e Upp e r P e n in s u la s tat e fa ir ; an d an y oth er stat e fair in Michigan which ha s been approved by th e director to con duct harn ess horse ra ces dur ing th e fair.

(e)      "Fa ir s an d ra cing division" mean s th e  fairs  an d  ra cing  division  of  th e  Michigan dep artm ent of agricultur e.

(f)  "Gross pur se" mean s th e tota l dollar am ount ra ced for in each individua l heat of ra cing.

(g)  "Lessee " mean s a person who is domiciled in Michigan an d who leases a sta llion which ha s been recor ded with th e U.S.T.A. register as th e lessee of a horse. A copy of th e lease sha ll be filed with th e fairs an d ra cing division.

(h)         "Licensed  ra cetra ck"  mean s  an  ass ociat ion  licensed  by   th e   Michigan   ra cing comm issioner to con duct harn ess horse ra ces in Michigan .

(i)     "Michigan -bred horse" mean s a horse which  is from  a  Michigan -own ed  stan dar dbred mar e  at  th e  t ime  of  breedi ng  an d  which  is  sired  by a   Michigan -own ed   or   leased stan dar dbred sta llion,  duly  registered  with  th e  fairs  an d  ra cing  division,  that  d id  n ot se r vice a  mar e  at  an y locat ion  out s ide of Mich igan  d ur in g th e  ca le n d ar  ye ar  in  w h ich se r vice occurr ed .

(j)  "Owner" mean s th e person or persons domiciled in Michigan an d recor ded with th e U.S.T.A. register.

(k)   "Person" mean s an individua l, partn ership, ass ociat ion, or cor porat ion.

(l)   "U.S.T.A." mean s th e Un ited Stat es tr ott ing ass ociat ion.

Rule 1a. Fa ctors to be con sidered in determ ining domicile ar e as follows : (a) Vot ing registrat ion or alien registrat ion showing a Michigan address .

(b)   Fede ra l in com e ta x return  showing a Michigan address .

(c)   Stat e in com e ta x return  showing a Michigan address .

Rule 2. (1) The director sha ll pay a breede rs' awar d, in an am ount of NOT TO EXCEE D 10% of th e gross pur se, to th e breede r of a Michigan -bred horse each t ime that  horse wins at a fair or licensed ra cetra ck in Michigan .

(2)   Breede rs' awar d ar e not assigna ble an d ar e not inh erita ble, an d th e director is un der no obligat ion to pay th e awar ds oth er than  as provided in th ese ru les.

(3)    Breede rs' awar ds sha ll only be payable for wins after th e dat e th e mar e is properly registered with th e fairs an d ra cing division.

Rule 2a. (1) To receive payment of a breede rs' awar d, a stan dar dbred mar e sha ll ha ve been registered by each owner with th e fairs an d ra cing division befor e a win.

(2)    Stan dar dbred sta llions sha ll be registered by each owner or  lessee  with  th e fairs an d ra cing division by J anuar y 1 of th e year in which that sta llion will be stan ding at service in Michigan for eligibili ty to qua lify for breede rs' awar ds. A copy of th e lease agreement sha ll a ccom pan y th e registrat ion for a leased sta llion.

(3)   A newly acquired sta llion, which ha s not been in Michigan for breedi ng pur poses befor e J anuar y 1 of a given year an d which ha s not serviced a mar e after December 31 of th e preceding year , sha ll be registered with th e dep artm ent of agricultur e before servicing a mar e if th e sta llion's get is to be eligible for breede rs' awar ds.

Rule 3. (1) Licensed ra cing ass ociat ions sha ll provide th e director with copies of each day's ra ce program at least once each week.  The winn er of each ra ce sha ll be checked on th e program an d sha ll be cert ified as being th e tru e winn er.

(2)     The secretar y of th e fair sha ll provide th e director with copies of each day's  ra ce program , togeth er with th e harn ess  horse  ra ce result  sheet. (Form  FF -18), for  th e fair's ra ces. The winn er of each ra ce sha ll be checked on th e program an d sha ll be cert ified as being th e tru e winn er.

(3)    If th e eligibili ty of a breede r to receive a breede r 's awar d is questioned, th e bur den of proving that th e horse is a Michigan -bred horse or is in com plian ce with th ese ru les rests with th e breede r or breede rs.
