    R 299 .921 De finitio ns .

    Rule 21. As used in th ese ru les: "Cam p" mean s an y of th e following:

    (i)   The erection of a tent .

    (ii)    The opening or sett ing up of a tent -type cam per.

    (iii)    The park ing an d occupan cy of a tra vel or house tra iler .

    (iv)    Sleeping in an y type motor vehicle, sleeping bag, or sleeping in an y oth er mann er between th e hour s of 10 pm an d 8 am .

    (b)  "Comm ercial operat ions" mean s an y activity that involves, directly or indirectly, th e buying or selling of goods or services, or th e exchan ge or att empt or offer to exchan ge goods or services for money, bart er, or for an yth ing of value.

    (c)   "Day-use ar ea" mean s a specific ar ea of a stat e park or recreat ion ar ea which is developed an d ma inta ined as an ar ea to be used by th e public for picnics, playgroun d use, swimm ing, organ ized meetings, or socia l gath erings, an d educat iona l displays an d exhibits an d which ha s a 450 -foot bu ffer zone ar oun d th e ar ea. "Day-use ar ea" also includes all park an d recreat ion ar ea offices , out -buildings, gara ges, ma int enan ce shops, mu seum s, th e 450 - foot bu ffer zone ar oun d all such buildings, an d an y ar ea of a stat e park or recreat ion ar ea that  th e chief of th e park s an d recreat ion division des ignat es as a "day-use ar ea," eith er on a temporar y or perman ent basis, by posting th e boun dar ies of that ar ea as a "day-use ar ea." (d) "Desig nat ed" mean s listed in a director's order, posted with a sign or signs at th e site, or reasona bly ident ified for a part icular use.

     

     

    (e)  "Desig nat ed  ar ea" mean s  an  ar ea  that   ha s  been  properly  signed  on  th e  groun d  for cross -countr y ORV use.

    (f) "Desig nat ed rout e" mean s for est roads that  ha ve been properly signed on th e groun d for ORV use.

    (g)  "Desig nat ed tra il" mean s a 1-tra ck path or way which is capable of tra vel  by a 2- to 4-wheel vehicle that is less than  50 inches in width an d which ha s been properly signed on th e groun d for ORV use.

    "Event "  mean  a   single,   stru ctur ed,   organ ized,   con solidat ed,   scheduled   meeting   or occurr ence which is on stat e-own ed lan ds an d to which 1 or both of th e following apply:

    A fee or donat ion is required for part icipat ion.

    (ii)  The num ber of people involved is 20 or more individua ls.

    (i)   "Forest road" mean s a har d sur faced road, a gra vel or dirt road, or an oth er rout e capable of being tra vele d by a 2-wheel drive 4-wheeled convent iona l vehicle des ignat ed for highway use, but does not include an int erstat e, stat e, or count y highway.

    (j)   "ORV" mean s a motor-driven off-r oad recreat iona l vehicle capable of cross -cou ntr y tra vel with out benefit of a road or tra il, on or imm ediat ely over lan d, snow, ice, mar sh, swam plan d, or oth er natura l terra in. "ORV" includes , but is not limited to, an y of th e followin g:

    (i)   A mu lt itra ck or mu ltiwheel drive or low press ur e t ire vehicle.

    (ii)   A motorcycle or relat ed 2 -wheel or 3 -wheel vehicle.

    (iii)    An am phibious ma chine.

    (iv)   groun d effect air cushion vehicle.

    (v)   Anoth er mean s of tran sportat ion deriving motive power from a sour ce oth er than  mu scle or wind.

    "ORV" does not include a registered snowmobile, a farm vehicle being used for farm ing, a vehicle used for militar y, fire, emergency, or law en for cement pur poses, a con stru ct ion or logging vehicle used in per forman ce of it s comm on fun ct ion, or a registered aircra ft .

    (k)   "Perm it or proper writt en perm ission" mean s a writt en perm it issued by th e dep artm ent .

    (l)   "Person" ha s th e sam e mean ing as defined in section 301 of 1994 PA 451 , MCL 324 .301 . (m) "Pr operly signed on th e groun d" mean s that  signs ha ve been posted by th e dep artm ent to mark  th e locat ion or boun dar y of a des ignat ed tra il, rout e, or ar ea.

    (n)    Stat e for est officer mean s a person comm issioned by th e director un der section 83107 of 1994 PA 451 , MCL 324 .83107 .

    (o)    "Stat e park  officer  or  stat e park  an recreat ion  en for cement  officer " mean s  a  person comm issioned by th e director un der section 74124 of 1994 PA 451 , MCL 324 .72124 .

     

    R 299 .922   Un law fu l acts  gene rally.

    Rule 22. On lan ds owned or un der th e contr ol of th e dep artm ent , it is un lawful for a person or persons to do an y of th e followin g:

    (a)   To ent er, use, or occu py stat e-own ed lan ds for an y pur pose when th ey ar e posted against entr y, use, or occu pan cy, as ordered by th e dep artm ent .

    (b) To dispose of refuse, ru bbis h, tra sh, or gar bage not resulting from th e use of stat e-own ed lan ds in recepta cles provided on stat e-own ed lan ds.

    (c) To set fire to th e cont ent s of a tra sh conta iner.

    (d)  To place  or  burn  gar bage  in  a  fire  r ing  or  stove,  or  bur y  refuse,  ru bbis h,  tra sh,  or gar bage, regar dless of it s origin.

     

     

    (e) To engage in an y violent , abusive, loud, boisterous, vulgar , lewd, or oth erwise disorderly con duct, or to loun ge, sit , or lie upon walks, roads, or path s obstru cting th e free passage of an oth er person.

    (f) To place or erect a fence or barr ier, to con stru ct or occu py improvement s, or to enclose th e lan ds.

    (g)   To move, remove, des tr oy, mut ilat e, or deface posters, notices, signs, or mark ers of th e dep artm ent of natura l resour ces or an y oth er agency of governm ent .

    (h)  To des tr oy, dama ge, or remove tr ees , shru bs, wildflowers, gra sses , or oth er vege tat ion. Except in wildli fe food  plots,  th is  subdivisi on  does  not  apply  to  picking  an d  removing mu shr oom s, berr ies, an d edible fru it s or nut s for persona l use.

    (i)   To pedd le or systemat ically solicit business  of  an y  natur e;  distr ibut e  or  post  an y han dbills or oth er advert ising matt er; post signs; paint or oth erwise mark an y tr ee or r ock on an y lan ds, wat ers, stru ctur es, or propert y; or use such ar eas for comm ercial operat ions.

    (j)     To possess a glass conta iner with in an y  lan d  or  wat er  ar ea  that is  des ignat ed  as  a bath ing beach or a lan d or wat er ar ea that is regular ly used for sun bath ing, swimm ing, or wading.

    (k) To obstru ct an y road or tra il in a mann er that  hinders public a ccess to th e lan ds.

    (l) To park vehicles of an y type in ar eas posted as no park ing; or, where des ignat ed park ing ar eas exist, to park vehicles of an y type in an ar ea oth er than th e des ignat ed park ing ar ea. If a motor vehicle is foun d park ed on stat e lan ds, th en th e license plat e displayed on th e motor vehicle sha ll con st itut e prima facie evide nce that th e owner of th e vehicle  is  th e person who park ed it th ere.

    (m)  To hold event s including, but not limited to, ra ces, enduran ce cont ests, tournam ent s, or tra il r ides, un less th e event s ar e con ducted pur suant to a perm it . The perm it ma y include a char ge to th e  sponsor  or  perm itt ee  for  th e  use  of  th e  lan d.  An  event  ma y  require  a per forman ce bond to insur e perm it com plian ce an d ma y require public liability insuran ce. The dep artm ent ma y waive th e requirement for a perm it for event s where th e num ber of part icipant s is 20 or more individua ls if th e dep artm ent determ ines that th e event will not require dep artm ent oversight an d th e event will ha ve a minima l impact on th e use of th e lan ds by oth ers.

    (n)  To use a loudspe ak er, public address system, or soun d-am plifying equipment of an y kind, except for an electr onic gam e-ca lling device that is lawfully used while hunt ing, or to operat e a motor, motorboat , motor vehicle, ra dio, televisi on, generat or, or an y oth er device in a mann er that  produces excessive noise.

    (o)   To use or operat e an y wheeled , motorized vehicle in th e Upp er Peninsula of th is stat e, except on a des ignat ed rout e, a  des ignat ed  tra il, a  des ignat ed  ar ea, or  a  for est  road not oth erwise posted as closed to th e use of motorized vehicles or entr y.

    (p)    To use or operat e an y wheeled , motorized vehicle in th e Lower Peninsula of th is stat e, except on a des ignat ed rout e, a des ignat ed tra il, or a des ignat ed ar ea. A wheeled , motorized vehicle that is properly registered un der 1949 PA 300 , MCL 257 .1 et seq. ma y be operat ed on a for est road not oth erwise posted as closed to th e use of motorized vehicles or entr y.

    (q) To cam p in a stat e park , recreat ion ar ea, public a ccess site, or des ignat ed cam pgroun d on oth er than  a des ignat ed site.

     

     

    (r)  ) To cam p in an y des ignat ed cam pgroun d, a ccess site, or locat ion in a stat e for est or stat e gam e ar ea for more than  15 consecut ive night s in a calendar year .  To be considered a  new cam p, th e locat ion sha ll be not less than  1/2 mile from th e previous cam p.

    (s)   To leave a cam psite un occu pied  for  more  than  a  24-hour  period  after  th e  cam p  is esta blished. A cam psite is con sidered to be occu pied if at least 1 member of th e cam ping part y is in att endan ce dur ing th e nightt ime hour s.

    (t) ) To store or leave a wat ercra ft , fish shant y, or oth er propert y on stat e lan ds for more than 24 hour s. This provision does not apply to lawfully occu pied des ignat ed cam ping sites  or to groun d blinds an d tr ee stan ds that  meet legal requirement s.

    (u) For more than 1 single fam ily or more than 4 unr elat ed persons to cam p on 1 des ignat ed cam psite. For th e pur poses of  th is  subdivisi on,  a  single  fam ily  includes  par ent s  or guar dian s an d th eir children.  A single fam ily ma y include oth er relat ives if not more than 1 recreat iona l vehicle, cam ping tra iler, or pickup cam per is used an d if th ere ar e fewer than 9 individua ls.

    (v)    To r ide or lead a horse, pack an ima l, or oth er r iding an ima l, or an y an ima l-driven vehicle on an y ar ea, except on roads that ar e open to th e use of motor vehicles, tra ils, bridle path s, an d cam pgroun ds des ignat ed for such  use  by th e dep artm ent  an d on  stat e for est lan ds not posted closed to such use or entr y.

    (w) To operat e th e motor or motors of a vesse l at more than idle speed at an y boat laun ch ram p administered by th e dep artm ent , un less th e propeller is disengaged.

     

    R 299 .923   Pu bli c access  sites  and  ha rb ors; un law fu l acts .

    Rule 23. In addition to th e un lawful acts spe cified in R 299 .922 , at  stat e-own ed public a ccess sites an d har bors, it is un lawful for a person or persons to do an y of th e followin g:

    (a)    To m oor or ra ft off a stat e dock with out ha ving paid th e dock ing fees auth orized by th e dep artm ent for use of th e facility.

    (b) To ent er, use, or occu py th e premises dur ing th e hour s of 11 pm to 4 am daily where such closing hour s ar e posted on th e premises; or to swim, wade, or bath e when specifically prohibited by notices posted on th e premises.

     

    R 299 .924 State  lands  othe r  than  pa rks ,  rec rea tio n  areas ,  game  and  w ildli fe areas , designated   campg rounds  and  access  sites ; un law fu l acts .

    Rule 24. In addition to th e un lawful acts specified in R 299 .922 , on stat e lan ds owned or un der th e contr ol of th e dep artm ent oth er than stat e park s, recreat ion ar eas, gam e an d wildli fe ar eas, designat ed cam pgroun ds, an d public a ccess sites, it is un lawful for a person or persons to do eith er of th e followin g:

    (a)  To park an y wheeled , motorized vehicle more than 50 feet from th e tra vele d port ion of a road, for est road, park ing lot, or tra il open to such vehicle use.

    (b)   To use, operat e, or possess a motorized vehicle on a designat ed stat e for est path way.

     

    R 299 .925   Designated   campg rounds ; un law fu l acts .

    Rule  25.  In  addition  to  th e  un lawful  acts  spe cified  in  R  299 .922 ,  in  des ignat ed dep artm ent of natura l resour ces-administered cam pgroun ds, oth er  than  th ose  in  stat e park s, recreat ion ar eas, an d a ccess sites, it is un lawful for a person or persons to do an y of th e following:

     

     

    (a)  To cam p or place a cam p of an y type in a des ignat ed cam pgroun d with out fir st properly filling out th e cam p registrat ion ta g, which includes th e payment of th e posted cam ping fee, as directed on th e cam p registrat ion ta g. The cam p registrat ion ta g is not  con sidered properly filled out unt il th e registrat ion an d fees ar e deposited in a recepta cle as directed an d th e proper port ion of th e ta g is posted at th e cam psite. The ta g sha ll be furn ished by th e dep artm ent an d be available at th e cam pgroun d.

    (b)   For an unr egistered cam per or cam pgroun d visitor to ent er or rema in in a cam pgroun d, day use ar ea, beach, or park ing lot between 10 pm an d 8 am .

    (c) To dischar ge firearm s, air gun s, bow-an d-arr ow, crossbow, gas gun s, spring-loaded gun s, or sling shots.

    (d)  To operat e an ORV, snowmobile, or an y motorized device, except for entran ce to an d dep artur e from a des ignat ed cam pgroun d.

    (e)   To allow, place, or drive  more  than  2  motor  vehicles  ont o  1  cam psite  or  int o  a cam pgroun d, except that 4 motorcycles ar e perm itt ed if each is operat ed by  a  registered cam per.

    (f)   To build fires, except in des ignat ed places or except in stoves or grills that ar e approved by an auth orized represe ntat ive of th e dep artm ent .

    (g)   To possess a dog or oth er an ima l, un less it is un der imm ediat e contr ol on a leash that is not more than  6 feet in length .

     

    R 299 .926   Game  areas ; un law ful acts .

    Rule 26. In addition to th e un lawful acts spe cified in R 299 .922 , on stat e-own ed lan ds in a stat e gam e ar ea, it is un lawful for a person or persons to do an y of th e followin g:

    (a)    To cam p between May 15 an d Sep tember 10, except in ar eas specifically des ignat ed for cam ping.

    (b) To park an y wheeled , motorized vehicle more than 20 feet from th e tra vele d port ion of a road, for est road, park ing lot, or tra il open to wheeled , motorized vehicle use.

    (c)       To operat e an y self-pr opelled motor or mechan ically driven vehicle, including snowmobiles an d bicycles, on oth er than a des ignat ed esta blished road open to th e public, a tra il or ar ea properly signed by th e dep artm ent as being open to such use, or a park ing lot .

     

    R 299 .927   State  pa rks and  rec rea tio n areas ; un law fu l acts .

    Rule 27. In addition to th e un lawful acts specified in R 299 .922 , in stat e park s an d stat e recreat ion ar eas, it is un lawful for a person or persons to do an y of th e followin g:

    (a)      To ent er or rema in in a cam pgroun d, out door cent er, cabin ar ea, or day cam psite between th e hour s of 10 pm an d 8 am , un less th e person is a lawfully registered occu pant . A person sha ll not ent er or rema in in a day-use ar ea between th e hour s of 10 pm to 8 am .

    (b) To carr y or ha ve in his or her possess ion a firearm , un less un loaded in both barr el an d ma gazine; to shoot an air gun , gas gun , spring-loaded gun , or slingshot; or to sh oot with a bow an d arr ow or crossbow, except dur ing esta blished hunt ing seasons on lan ds des ignat ed open to hunt ing un der th e auth ority of an order issued un der sections 40107 an d 40113 a of 1994 PA 451 , MCL 324 .40107 an d 324 .40113 a . This subdivisi on does not apply to a tar get ran ge  or  ar chery  ran ge  officia lly  esta blished  by  th e  dep artm ent  or  to  an   officia lly san ct ioned field tr ia l. A person sha ll not engage in tar get sh oot ing, except on des ignat ed sh oot ing ran ges.

     

     

    (c)    To obta in a cam ping perm it for use by a cam ping part y of which th e person is not a member.

    (d)      To  cam p  for  more  than  15  con secut ive   night  in   an y  sep arat ely   administered cam pgroun d in a park or recreat ion ar ea between May 15 an d Sep tember 15. If a cam ping part y is required to leave a cam pgroun d upon reaching th e 15-night limit, th en th e part y is not eligible to return  unt il 5 night s ha ve elapsed .

    (e) To use a cam pgroun d for a perman ent or semiperman ent reside nce.

    (f)   To r ide a bicycle of an y kind, except on paved an d nonpaved roads, park ing lots, an d des ignat ed, signed bicycle tra ils.

    (g)     To  allow,  place,  or  drive  more  than  2  motor  vehicles  ont o  1  cam psite  or  int o  a cam pgroun d, except 4 motorcycles ar e perm itt ed if each is operat ed by a registered cam per. (h) To build fires, except in des ignat ed places or except in stoves or grills that  ar e approved by an auth orized represe ntat ive of th e dep artm ent .

    (i) To walk int o, or drive a vehicle int o or thr ough, a contr olled cam ping  ar ea.  This provision does not apply to registered cam pers an d th eir vehicles or to persons legitimat ely visiting a specific, registered cam per.

    (j)   To a llow a dog or oth er an ima l with in a wat er or lan d ar ea des ignat ed as a bath ing beach or in an y oth er wat er ar ea used for swimm ing or wading; to bring a dog, except leader dogs for th e blind, or oth er an ima l int o an enclosed park building or leave a dog or oth er an ima l unatt ended at an y t ime; to perm it a dog or oth er an ima l to run loose or creat e a distur ban ce un less th e dog is being used in hunt ing, or in field tr ia ls, or while being tra ined, when upon lan ds open to such uses ; or to fail to properly contr ol a dog or oth er an ima l. Any dog foun d not in th e possess ion of, or un der th e imm ediat e contr ol of, it s owner or th e owner's agent , or an y dog creat ing a nu isan ce or distur ban ce, ma y be removed from th e park .

    (k)    To possess a dog or oth er an ima l un less it is un der imm ediat e contr ol on a leash that is not more than 6 feet in  length .  This  provision  does  not  apply to a  dog being used  for hunt ing, or in field tr ials, or while being tra ined, when upon lan ds open to such uses .

    (l)     To r ide, perm it , or allow  a  horse  or  oth er  r iding  an ima l  in  an y  ar ea,  except  for  a des ignat ed bridle tra il or horsepe rsons cam pgroun d, or when in com plian ce with a perm it issued for a field dog tr ia l.

    (m)      To cam p with out a cam ping perm it  issued  by  an  auth orized  represe ntat ive  of  th e dep artm ent of natura l resour ces.

     

    R 299 .928   Ros e lake  w ildli fe area ; un law fu l use  of skis ; area de fined .

    Rule 28. (1) In addition to th e un lawful acts spe cified in R 299 .922 an d R 299 .926 , on th e rose  lak e wildli fe ar ea, it  is un lawful for  a  person  to use  skis from  November  1 thr ough J anuar y 1.

    (2) For th e pur pose of th is ru le, "rose lak e wildli fe ar ea" mean s th e stat e-own ed lan ds an d wat ers in sections 13, 14, 21, 22, 23, 24, 25, 26, 27, an d 34 of T5N, R1W, an d sections 17, 20, 21, 22, 28, an d 29 of T5 N, R1 E.

     

     

     

     

     

    R 299 .929   Violatio n of ru les ; revoca tio n of pe rm it or ev ictio n .

    Rule 29. In addition to an y oth er pena lty prescribed by law, violat ion of an y of th ese ru les ma y result in th e revocat ion of a cam ping perm it or eviction from th e stat e park , recreat ion ar ea, a ccess site, gam e ar ea, or des ignat ed cam pgroun d, or both .

    Rule 30. Dep artm ent employees acting in th e line of dut y, an d persons per form ing specific acts or con ducting activity auth orized by writt en perm ission ar e exempt from th ese ru les.
