R 285 .820 .1 De finitio ns .

Rule 1. As used in th ese ru les:

(a)  "Comm issioner" mean s th e Michigan stat e ra cing comm issioner.

(b)   "Dep artm ent " mean s th e Michigan dep artm ent of agricultur e.

(c)  "Director" mean s th e director of th e dep artm ent .

(d)     "Licensed ra cing ass ociat ion" mean s an ass ociat ion  licensed  by  th e  comm issioner  to con duct stan dar dbred horse ra ces in Michigan .

(e)   "M.H.H.A." mean s th e Michigan harn ess horsemen's ass ociat ion.

(f)     "Michigan -bred horse" mean s a h or se FROM A REGIST ERED STANDARDBR ED MARE OWNE D EXCLUSI VELY BY A RESID EN T OR RESID EN TS OF MIC HIGAN AT THE TIM E OF CONCEP TIO N. s ir ed by a r egis t e r ed s tan d ar db r ed s ta lli on , w h ich s ta lli on is ow n ed or le a sed exclu s ively by a r eside nt or r eside nt s of Mich igan an d w h ich se r ve d n o mar es at an y locat ion out s ide of Mich igan d ur in g th e ca le n d ar  ye ar  in  w h ich  se r vice occurr ed . T h e t e rm a ls o m e an s a h or se  fr om  a  r egis t e r ed  s tan d ar db r ed  mar e  ow n ed exclu s ively by a r eside nt or r eside nt s of Mich igan at th e t im e at w h ich th e se r vice occurr ed .

(g)     “MIC HIGAN SIR ED  STANDARDBR ED  HORS E”  MEANS  STANDARDBR ED HORS ES:

CONCEIVED AFTER J ANU ARY 1, 2001 AND SIR ED BY  A  STANDARDBR ED STALLIO N REGIST ERED WITH THE MIC HIGAN DEP ARTM EN T OF AGRIC ULTURE THAT WAS LEASED OR OWNE D BY A RESID EN T OR RESID EN TS OF THIS STATE AND WHICH DID NOT SERVE A MARE AT A LOCATIO N OUTSID E OF THIS STATE FROM FE BRUARY 1 THROUGH J ULY 31 OF THE CALEN DAR YEAR IN WHICH THE CONCEP TIO N     OCCURRED.                       TRANSP ORTATIO N OF SEMEN FROM A STANDARDBR ED STALLIO N REGIST ERED WITH THE MIC HIGAN DEP ARTMEN T OF AGRIC ULTURE TO A LOCATIO N OUTSID E THE STATE OF  MIC HIGAN  DOES NOT AFFE CT THE ELIGIBILIT Y  OF  MIC HIGAN  CONCEIVED  FOAL  FOR  THE PU RSES PROVIDED IN THIS RULE.

 

 

A FOAL FROM A MARE OWNE D EXCLUSI VELY BY A RESID EN T OR RESID EN TS OF THIS STATE AT THE TIM E OF CONCEP TIO N, CONCEIVED OUTSID E THE STATE OF MIC HIGAN BY MEANS OF TRANSP ORTED SEMEN FROM A STANDARDBR ED STALLIO N REGIST ERED WITH THE MIC HIGAN DEP ARTMEN T OF AGRIC ULTURE IS ELIGIBL E FOR PU RSES PROVIDED FOR IN THIS RULE.

A FOAL FROM A MARE OWNE D EXCLUSI VELY OR IN PART BY A NON-RESID EN T OF MIC HIGAN AT THE TIM E OF  CONCEP TIO N,  CONCEIVED  OUTSID E  THE STATE OF MIC HIGAN BY MEANS OF SEMEN TRANSP ORTED FROM A STANDARDBR ED STALLIO N REGIST ERED WITH THE MIC HIGAN DEP ARTMEN T OF AGRIC ULTURE IS ELIGIBL E FOR PU RSES PROVIDE FOR IN THIS RULE, IF BY NOVEMBER 1, OF THE  YEAR  IN  WHICH  THE  FOAL  IS  CONCEIVED,  THE TRANSP ORT FEE IS PAID TO THE DEP ARTM EN T’S AGEN T.

(H)      “OFFEN DING” HORS E MEANS ONE THAT CAUSES A DISR UP TIO N OR AN ACCID EN T IN A RACE .

(I)     “REGIST ERED STALLIO N” MEANS A STALLIO N SHALL BE REGIST ERED ON FORMS PROVIDED BY THE DIR ECTOR , WITH THE DEP ARTMEN T BY J ANU ARY 1 EACH YEAR IN WHICH THE  STALLIO NS  WILL  BE  STANDING AT THE  SERVICE IN THIS STATE. A NE WLY ACQUI RED  STALLIO N,  WHICH  HAS  NOT  BEEN  IN MIC HIGAN FOR BREE DING PU RPOSES PRIOR TO J ANU ARY 1, OF A GIVEN YEAR, AND HAS NOT SERVICED ANY MARES AFTER DECEMBER 31 , OF THE PRECEDING YEAR, SHALL BE REGIST ERED WITH THE DEP ARTM EN T BEF ORE SERVICING ANY MARES, IF ITS FOALS ARE TO BE ELIGIBL E  FOR  MIC HIGAN TAX SU PP ORTED RACES.

Rule 2. (1) The fir st Michigan -bred foa ls eligible to be nominat ed for th ese Michigan -bred par i-mutu el ra ces  sha ll  be  Michigan -bred  foa ls  born  in  th e  officia l  1975  Un ited  Stat es tr ott ing ass ociat ion foa ling year .

(2) In 1979 an d th ereafter, th ey sha ll be ra ced as Michigan -bred 4-year -olds as follows : (a) Michigan -bred 4-year -old tr ot.

(b) Michigan -bred 4-year -old pace.

 

R 285 .820 .3 Fees  and  nom ina tio ns .

Rule 3. (1) The M.H.H.A. sha ll be th e holding agent for all fees colle cted.

(2)   The host licensed ra cing ass ociat ion is resp onsible for th e disbur sement of pur se money perta ining to th e Michigan -bred par i-mutu el ra ces.

(3)     All Michigan -bred foals sha ll be nominat ed on J uly 15 of th e foaling year or by supplementa l payment in th e year ling year as provided for in th e ra ce con ditions.

(4)    A start ing fee of 1% of th e stat e's contr ibut ion is due when th e Michigan -bred horses declar e in to start pur suant to th e ru les that exist  at  th e tra ck when  th e Michigan -bred par i-mutu el ra ce is to be cont ested.

(5)    All nominat ions sha ll be divided equa lly am ong th e Michigan -bred par i-mutu el ra ce divisions.

(6)   Susta ining an d start ing fees sha ll follow th eir respe ctive ra cing division.

Rule 4. (1) A licensed ra cing ass ociat ion requesting stat e fun ds for payment of Michigan - bred par i-mutu el ra ce pur ses sha ll submit a properly com pleted applicat ion to th e ra cing comm issioner.

(2) The ra cing comm issioner sha ll des ignat e annua lly at which par i-mutu el tra ck th e pace an d tr ot sha ll be held.

(3)  If becau se of un favora ble weath er or oth er una voidable circum stan ces  th e Michigan - bred par i-mutu el ra ces ar e postponed, th ey ma y be rescheduled at th e discretion of th e director of agricultur e an d th e ra cing comm issioner.

Rule 5. Rule 5. Eliminat ion heat s sha ll be ra ced pur suant  to U.S.T.A. ru les.

UN LESS PU BLIS HE D IN THE CONDITIO NS OF THE RACE  AND  APP ROVED  BY THE DIR ECTOR .

 (1 ) All ra ces s ha ll be con d u ct ed p ur s uant t o th e followin g elim inat ion p lan :

(a) ) I f m or e than  10 h or ses de clar e t o s tart , elim inat ion ra ces s ha ll be h eld 7 ca le n d ar d a ys p r ior t o th e fina l ra ce .

(b) ) I f 11 t o 20 h or ses de clar e t o s tart , 2 elim inat ion h e at s s ha ll be h eld , with th e fir s t 5 h or ses of e a ch h e at q ua lifyin g for th e fina ls .

(c)I f 21 t o 30 h or ses de clar e t o s tart , 3 elim inat ion h e at s s ha ll be h eld , with  th e fir s t 3 h or ses of e a ch elim inat ion h e at q ua lifyin g for th e fina ls .

(d)) I f 31 t o 40 h or ses de clar e t o s tart , 4 elim inat ion h e at s s ha ll be h eld , with th e fir s t 2 h or ses in e a ch h e at q ua lifyin g for th e fina ls .

(e) ) I f m or e than 40 h or ses de clar e t o s tart , elim inat ion h e at s s ha ll be ra ced s o that n ot m or e than 10 h or ses s tart in an y elim inat ion . Rule 6. (1) Ea ch pur se in th e Michigan -bred par i-mutu el ra ces s ha ll be d ivi ded am on g th e winn e r s of e a ch ra ce in th e followin g mann e r :

 

(a )       5 or m or e s tart e r s   50 %    25 %    12 %    8%        5% (b)       4 s tart er s                   50 %    25 %    15 %    10 %

(c)        3 s tart er s                   55 %    30 %    15 % (d )           2 s tart er s                   65 %    35 %

(e)       1 s tart e r                     100 %

 

 

WITH 5 OR MORE STARTERS SHALL BE DIVIDED: 50%-25%-12%-8%-5%, IN THE EVEN T THE RE ARE LESS THAN 5 STARTERS, ALL UN CONTESTED MONIES WILL BE PAID TO THE WINN ER. IF THE RE BE ANY PREMIUM OR PREMIUMS FOR WHICH HORS E HAVE STARTED BUT UN ABLE TO FINIS H, DUE TO AN ACCID EN T, ALL UN OFFEN DING HORS ES WHO DID NOT FINIS H WILL SHARE EQUALLY IN SUC H PREMIUMS PROVIDED HOWEVER, THAT  WHE RE  THE RE  ARE  FE WER UN OFFEN DING HORS ES FAILING TO FINIS H THAN THE RE ARE PREMIUMS FOR WHICH HORS ES HAVE STARTED BUT HAVE NOT FINIS HE D, THE NU MBER OF PREMIUMS IN EXCESS OF  THE  NU MBER  OF  UN OFFEN DING  HORS ES   NOT FINIS HING SHALL GO TO THE WINN ER.

(2) The pur ses for th ese eliminat ion heat s sha ll be derived from th e pur se pool of th e host tra ck.

Rule 7. A person or ent ity wilfully falsifying an y docum ent s required by th ese ru les or wilfully accepting an d reta ining an y pur se monies contrar y to th ese ru les sha ll be ineligible to part icipat e in an y futur e Michigan -bred par i-mutu el ra ce program s un der th e provisions of th ese ru les.
