    R 336 .1102   De finitio ns ; B.

    Rule  102 .  As used in th ese ru les:

    (a)      "Bes t available contr ol techn ology for toxics" or "T-BACT" mean s th e ma ximum degree of emission reduction which th e DEP ARTMEN T determ ines is reasona bly achievable for each pr ocess that emits toxic air contam inant s, tak ing int o a ccount energy, environm enta l, an d econ omic impacts an d oth er cost s.

    (b)     "Bes t available in format ion" mean s data which serves as th e basis for a r isk assess ment . Such in format ion ma y  be  tak en  from  th e  scient ific  lit eratur e  or  th e  int egrat ed  r isk in format ion system data base ma inta ined by th e Un ited Stat es environm enta l protection agency or from oth er data bases, as appropriat e. The term includes oth er pert inent stu dies or report s conta ining data which th e dep artm ent finds to be of adequat e qua lity for use in th e r isk assess ment .

    (c)     "Black coat ing" mean s a coat ing which meets both of th e followin g criteria:

    (i)     Maximum lightn ess 23 un it s.

    (ii)     Saturat ion: less than  2.8, where saturat ion equa ls th e squar e r oot of A² + B².

    These criteria ar e based on Cielab color space, 0/45 geometr y. For spherical geometr y, specular included , ma ximum lightn ess is 33 un it s.

    (d)      "Blending tank ," as it perta ins to R 336 .1631 , mean s an y vesse l in which organ ic resin an d solvent or oth er mat erials ar e added to produce a product blend.

    (e)     "Breakthr ough," with respe ct to a car bon adsorption system, mean s a con dition in which th e car bon bed is saturat ed with a volat ile organ ic com poun d to th e extent that th e contr ol efficien cy of th e system is substan t ially reduced.

     

     

    (f)        "Business ma chine"  mean s  a  device  that  uses  electr onic or  mechan ical  meth ods  to pr ocess in format ion, per form calculat ions, print or copy in forma t ion or con vert soun d int o electr ical impulses for tran smission, including devices listed in stan dar d  industr ial classificat ion num bers 3572 , 3573 , 3574 , 3579 , an d 3661 an d phot ocopy  ma chines,  a subcat egory of stan dar d industr ia l classificat ion num ber 3861 .

    Rule 104 .  As used in th ese ru les:

    (a ) "Dam pered -off cok e oven" mean s a cok e oven that is isolat ed from th e cok e oven  gas collector ma in by closing every dam per valve on all stan dpipes of that oven  dur ing th e decar bonizat ion period.

    (b)       "Decar bonizat ion period," with respe ct to cok e ovens, mean s th e t ime for com busting car bon form ed at th e oven r oof an d in th e stan dpipe asse mbly. The decar bonizat ion period comm ences when a char ging-hole lid or lids or a stan dpipe lid or lids ar e removed or opened near th e end of th e cok ing cycle an d ends with th e initiat ion of th e next char ging period.

    (c)     "Delive ry vesse l" mean s an y tank tru ck, tank -equipped tra iler, ra ilroad tank car , or an y similar vesse l equipped with a stora ge tank used  for  th tran sport  of a  volat ile organ ic com poun d from sour ces of supply to an y stat ionar y vesse l.

    (d)           Demolition waste mat erial mean s waste building mat erials that result from demolition operat ions on houses an d comm ercial an d industr ial buildings.

    (e)      "Dep artm ent " mean s th e director of th e dep artm ent of EN VIRONM EN TAL QUALIT Y or his or her des ignee.

    (f)       "Difficu lt -t o-m onitor com ponent " mean s a com ponent that can only be monitored by elevat ing th e monitoring personn el more than  6 feet above a support sur face.

    (g)       "Dry organ ic resin" mean s th e organ ic resin solids from which all liquids ha ve been removed, as delivera ble for sale or use.

    (h)      "Dispe nsing facility" mean s a locat ion where gasoline is tran sferr ed to a motor vehicle tank  from a stat ionar y vessel.

     

    R 336 .1105   De finitio ns ; E.

    Rule 105 .  As used in th ese ru les:

    (a)     "Electr ostat ic prep coat " mean s a coat ing that is applied to a plastic part solely to provide con ductivity for th e subseq uent applicat ion of a prime, a topcoat , or oth er coat ing thr ough th e use of electr ostat ic applicat ion meth ods. An electr ostat ic prep coat is clear ly ident ified as an electr ostat ic prep coat on it s a ccom pan ying mat erial safety data sheet.

    (b)     "Em ission un it " mean s an y part of a stat ionar y sour ce that emits or ha s th e potent ial to emit an air contam inant .  Exam ples of emission un it s include th e followin g:

    (i)     A foss il fuel-fir ed, steam -generat ing un it .

    (ii)     topcoat paint ing line.

    (iii)      A solid waste incinerat or.

    (iv)     A clink er cooler at a port lan d cement plant . (v) A pr ocess un it at a chemical plant .

    (c)       "Equipment ut ilize d in th e manu factur ing of pharma ceut ical products" mean s equipment ass ociat ed with th e stora ge, tran sfer, or manu factur ing of pharma ceutical products, including ra w mat erials an d int erm ediat e products, by chemical synth esis .  This

     

     

    definition does not include equipment ass ociat ed with th e manu factur ing of pharma ceut ical products by ferm entat ion or extra ct ion, th e formu lat ion or packa ging of bulk pharma ceu- t icals, or th e pr ocessi ng of waste resulting from pharma ceutical synth esis .

    (d)         "Equivalent meth od," with  respe ct  to  sour ce  sam pling,  mean s  a  meth od  or  set  of pr oced ur es for obta ining sour ce sam ples that ha s been demonstrat ed to th e departm ent 's sat isfaction to ha ve a con sistent an d quant ita tively kn own relat ionship to an applicable reference test meth od.

    (e)     "Excess air" mean s an y air in  excess  of  th e  am ount   of  air  required  for  com plete com bustion of a mat erial as determ ined by using reference test meth od 3 of appe ndix A to th e dep artm ent 's ru les.

    (f)      "Excess  emissions"  mean s  emissions  of  an  air  contam inant  in   excess   of  ANY APP LIC ABLE emission LIMIT ATIO N.

    (g)     "Externa l float ing r oof stat ionar y vesse l" mean s an open top stat ionar y vesse l equipped with a cover or r oof which rests upon an d is support ed by th e liquid being conta ined an d which ha s a closur e seal or seals to reduce th e space between th e cover or r oof edge an d th e vessel wall.

    (h)     "Extr eme environm enta l con ditions" mean s an y of th e followin g:

    (i)  Out door weath er.

    (ii)     Temperatur es con sistent ly above 95 degrees Celsi us (203 degrees Fahr enh eit).

    (iii)      Detergent s.

    (iv)     bra sive an d scour ing agent s. (v) Solvent s.

    (vi)  Corr osive atm ospheres.

    (vii)  Oth er similar har sh con ditions.

    (i) "Extr eme per forman ce coat ing" mean s a coat ing which is des igned to protect a coat ed part from extr eme environm enta l con ditions an d which is applied to a part that , in it s use as a finished product, is int ended to be subjected to extr eme environm enta l con ditions.

    Rule 107 .  As used in th ese ru les:

    (a)   "Gasoline" mean s an y petr oleum distillat e which ha s a Reid vapor press ur e equa l to or great er than  4.0 psia an d which is used for aut omotive fuel.

    (b)   "Geogra phical site" mean s cont iguous lan d ownership by 1 lan downer. A public right of way, such as a road, ra ilroad, an d wat er cour se, thr ough part of th e site, is not con sidered to break th e cont inu ity. Where tran smission an d fuel delivery right s-of-wa y or a str ip of lan d that serves no oth er pur pose than  as a tran sportat ion or mat erials han dling link conn ects 2 or more oth erwise sep arat e geogra phical  sites,  th e  conn ected  sites  sha ll  be  con sidered sep arat e geogra phical sites.

    (c)    "Good engineering pra ct ice des ign" mean s, with respe ct to sta ck height s, th e height necess ar y to EN SUR E that emissions from th e sta ck result in a ccep ta ble con centrat ions of air contam inant s  in  th e  imm ediat e  vicinity  of  th e  stat ionar y  sour ce  as  a  result  of atm ospheric downwash , eddies , an d wak es which ma y be creat ed by th e stat ionar y sour ce itself, near by stru ctur es, or near by terra in obsta cles an d sha ll not exceed th e great est of th e followin g limits:

    (i)     Two hun dred an d th irt een feet (65 meters).

     

     

    (ii)      Two an d one-ha lf t imes th e height of th e stru ctur e or near by stru ctur e for th ose sta cks for which con stru ct ion or modificat ion comm ended on or befor e J anuar y 12, 1979 , if th e owner or operat or produces  evide nce  that th is  relat ionship  was  actua lly  relied  upon  in des igning th e sta ck to EN SUR E protection against downwash.

    (iii)       The sum of th e height of th e stru ctur e or near by stru ctur e plus 1.5 t imes th e lesse r of th e height or  width  of  th e  stru ctur e  or  near by  stru ctur e  for  th ose  sta cks  for  which con stru ct ion or modificat ion comm enced after J anuar y 12 , 1979 .

    (iv)         Such height as an owner  or  operat or  of  a  stat ionar y  sour ce  demonstrat es,  to th e sat isfaction of th e DEP ARTMEN T, is necess ar y thr ough th e use of field stu dies or fluid models after notice an d opportun ity for public hear ing.

    (d)    "Gloss reducer" mean s a coat ing that is applied to a plastic part solely to reduce th e shine of th e part . A gloss reducer sha ll not be applied at a th ickn ess of more than 0.5 mils of coat ing solids.

    (e)       "Gra phic art s line" mean s an operat ion or series of operat ions in which print ing (th e format ion of words), designs, or pictur es on a substrat e by mean s of part ial covera ge of th e substrat e ar e employed. A gra phic art s line ma y also employ 1 or more coat ing operat ions in which a un iform layer of coat ing is applied eith er across th e ent ire width of th e substrat e or across only certa in port ions of th e substrat e.

    Rule 108 .  As used in th ese ru les:

    (a)        "Har dboar d" mean s a pan el manu factur ed primar ily from int erfelted lign o-cellu losic fibers which ar e con solidat ed un der heat an d press ur e in a hot press .

    (b)     "Har dwood plywood" mean s plywood whose sur face layer is a veneer of har dwood.

    (d)   "High bak e coat ing" mean s a coat ing which is des igned to cur e only at temperatur es of more than  90 degress Celsi us (194 degrees Fahr enh eit).

    (e)   "High-speed dispe rsion mill" mean s a mixer THAT HAS 1 or more blades which rotat e at high speed to dispe rse coat ing solids.

     

    R 336 .1113   De finitio ns ; M.

    Rule 113 .  As used in th ese ru les:

    (a)    "Major nonatta inm ent air contam inant " mean s a nonatta inm ent air contam inant for which th e potent ial to emit is significant  for  a  proposed  ma jor  offse t  sour ce or  for  which th ere is a significant net emissions increase for a proposed ma jor offse t modification.

    (b)       "Major offse t modificat ion" mean s th e addition of a pr ocess or pr ocess equipment or a physical chan ge in, or chan ge in th e meth od of operat ion of, a pr ocess or pr ocess equipment

     

     

    at a ma jor offse t sour ce which results in a significant net emissions increase  of an y air contam inant  regulat ed un der th e clean air act.

    (c)     "Major offse t sour ce" mean s eith er of th e followin g:

    (i)     A stat ionar y sour ce which ha s a potent ial to emit of 100 or more tons per year of an y air contam inant  regulat ed un der th e clean air act.

    (ii)         A part icular chan ge at a minor offse t sour ce which results in  an  increase  in  th e potent ia l to emit of 100 or more tons per year of an y air contam inant regulat ed un der th e clean air act.

    (d)       "Malfun ct ion" mean s an y sudde n, IN FREQUEN T AND NOT REASON ABLY PREVEN TABLE fa ilur e of a sour ce, pr ocess , pr ocess equipment , or air pollut ion contr ol equipment to operat e in a norma l or usua l mann er. Fa ilur es THAT ARE CAUSE D IN PART   BY   POOR   ma int enan ce   OR   CARELESS   OPE RATIO  ARE   NOT MALFUN CTIO NS.

    (e)    "Manu factur ing locat ion" mean s a place where a person is engaged in th e mak ing of goods or war es, including th e generat ion of electr icity in th e pr ocessi ng of mat erial  or primar ily in th e disposal or tr eatm ent of solid or liquid waste.  For th e pur pose of assess ing a sur veill an ce fee, "manu factur ing locat ion" includes all such places, wheth er publicly or privat ely owned an d conta ined with in 1 geogra phical site, except places  owned  an d operat ed by th e stat e governm ent . A power plant , as defined  in  ta ble  42 of R 336 .1401 , con st itut es a sep arat e manu factur ing locat ion when used to supply steam or energy to more than  1 oth er manu factur ing or comm ercial locat ion.  In an y case, a power plant THAT HAS a capacity of more than 500 ,000 poun ds of  steam  per  hour  is  con sidered  a  sep arat e manu factur ing locat ion. For  a  lar ge  industr ia l  com plex  or  oth er  unu sua l  cases ,  th e dep artm ent ma y determ ine that th e  com plex  con st itut es  more  than  1  manu factur ing locat ion, based on such factors as sep arat e cor porat e operat ing divisions, un it s, or sections.

    (f)  "Mark et testing an d mark et development " mean s th e limited or genera l distr ibut ion of a product to th e con sum er to gath er in format ion con cern ing th e deman d for th e product.

    (g)      "Mat erial han dling equipment ," as referenced in ta ble 31, mean s a device, contr ivan ce, or equipment used to bag, blend, con vey, cru sh, grind, load, mill, mix, shed, store, tran sfer, or un load a physical substan ce.

    (h)         "Mat erial recover y equipment " mean s an y equipment ut ilize d in th e tran sport an d recover y of styrene monomer an d oth er impur it ies from oth er products an d by-products in th e manu factur e of polystyrene resin by cont inu ous  pr ocess ,  including  th e  styrene devolat ilize r un it an d styrene recovery un it .

    (i)    "Minor offse t sour ce" mean s a stat ionar y sour ce which ha s a potential to emit of less than  100 tons per year for each air contam inant  regulat ed un der th e clean air act.

    (j)   "Modify" mean s mak ing a physical chan ge in, or chan ge in th e meth od of operat ion of, existing pr ocess or pr ocess equipment which increases th e am ount of an y air contam inant emitt ed int o th e out er air which is not already allowed to be emitt ed un der th e con ditions of a perm it or order or  which  results in  th e emission  of an y toxic air  contam inant  int o th e out er air not previously emitt ed. An increase in th e hour s of opera t ion or an increase in th e production rat e up to th e ma ximum capacity of th e pr ocess or pr ocess equipment sha ll not be con sidered to be a chan ge in th e meth od of operat ion un less th e pr ocess or pr ocess equipment is subject to en for ceable perm it con ditions or en for ceable orders which limit th e production rat e or th e hour s of operat ion, or both , to a level below th e proposed increase.

     

     

    (k)     "Motor vehicle" mean s an y self-pr opelled vehicle registered for , or requiring registrat ion for, use on th e highway.

     

    R 336 .1118   De finitio ns ; R.

    Rule 118 .  As used in th ese ru les:

    (a)     "Reactor" mean s a vesse l which ma y be jacketed to perm it temperatur e contr ol an d which is des igned to conta in mat erials dur ing chemical reaction.

    (b)       “Recon stru ct ion mean s th e replacement of com ponent s of an  existing facility so that th e fixed capita l cost of th e new com ponent s is more than 50% of th e fixed capita l cost that would be required to con stru ct a com para ble ent irely new emission un it an d so that it is techn ologically an d econ omically feasible to meet th e applicable requirement .

    Fixed capita l cost ,” as used in th is subdivisi on, mean s th e capita l needed to provide all of th e dep reciable com ponent s.

    (c)  "Red coat ing" mean s a coat ing which meets all of th e followin g criteria:

    (i)     Yellow limit: th e hu e of hosta perm scar let.

    (ii)     Blue limit:  th e hu e of mona stra l red-violet.

    (iii)      Lightn ess limit for meta llics: 35% alum inum flak e.

    (iv)     Lightn ess limit for solids: 50% t itan ium dioxide white.

    (v)     Solid reds :  hu e an gle of -11 to 38 degrees an d ma ximum light ness of 23 to 45 un it s.

    (vi)     Meta llic reds :  hu e an gle of -16 to 35 degrees an d ma ximum light ness of 28 to 45 un it s. These  criteria  ar e based  on  Cielab color  space, 0/45  geometr y.    For  spherical  geometr y, spe cular included , th e uppe r limit is 49 un it s.  The ma ximum  lightn ess  var ies as th e hu e moves from violet to oran ge.  This is a natura l con sequence of th e str ength of th e colorant s, an d real color s show th is effect .

    (d)    "Reference test meth od," with respe ct  to sour ce sam pling, mean s a  meth od or  set  of pr oced ur es, as described in appe ndix A to th ese ru les, for obta ining sour ce sam ples.

    (e)   "Refinery un it " mean s a set of com ponent s an d oth er equipment which ar e a part of a basic pr ocess operat ion, such as distillat ion,  hydrotr eat ing,  cra cking,  or  reform ing  of hydr ocar bons.

    (g)   "Repe t itive production of a product" mean s, for bat ch pr ocesses or pr ocess equipment , producing 10 or more bat ches of th e product. For cont inuous pr ocesses or pr ocess equipment , th is phra se mean s runn ing th e pr ocess or pr ocess equipment for  a  period of more than 10 t imes th e length of t ime for th e ra w mat erials to becom e th e finished product or 24 hour s, whichever is longer.

    (h)         “Rese ar ch an d development activities mean s  activities  con ducted  for  th e  primar y pur pose  of  developing  new  production  pr ocesses   an d  products,  testing  more  efficient

     

     

    production pr ocesses , or testing meth ods for prevent ing or reducing adverse environm enta l impacts, if th e activities ar e in com plian ce with both of th e followin g provisions:

    (i)   The activities do not include th e production of an int erm ediat e or fina l product for sale or exchan ge for comm ercial pr ofit , except in a de minimis mann er.

    (ii) The activities ar e con ducted at a rese ar ch or laborat ory facility that is operat ed un der th e close supervision of techn ically tra ined personn el.

    (i) "Resis t coat " mean s a coat ing that is applied to a plastic part befor e meta llic plat ing to prevent deposits of meta l on port ions of th e plastic part .

    (j)         "Resp onsible  officia l"  mean s,  for  th e  pur poses  of  signing  an d  cert ifying  th e  truth , a ccura cy, an d com pleteness of perm it applicat ions,  monitoring  an d  oth er  report s,  an d com plian ce cert ificat ions, an y of th e followin g:

    (i)      For a cor porat ion, a preside nt , secretar y, tr easur er, or vice-preside nt of th e cor porat ion who is in char ge of a principal business fun ct ion or an y oth er person who per form s similar policy or decision-mak ing fun ct ions for th e cor porat ion. The person ident ified in th e preced- ing sent ence ma y appoint an oth er person as his or her  auth orized represe ntat ive un der eith er of th e followin g circum stan ces:

    (A)     The represe ntat ive is resp onsible for th e overa ll operat ion of 1 or more manu factur ing, production, or operat ing facilities applying for or subject to a perm it an d eith er th e facilities employ more than  250  persons or  ha ve gross  annua l sales or  expe nditur es of more than

    $25 ,000 ,000 .00.

    (B)        The represe ntat ive ha s resp onsibili ties for th e overa ll operat ion of a sour ce an d is approved in advan ce by th e dep artm ent . A resp onsible officia l sha ll submit  a  writt en request for approval from th e  dep artm ent  to  des ignat e  an  auth orized  represe ntat ives pur suant to th is para gra ph. The dep artm ent sha ll resp ond, in writing, with in 30 days of receipt of th e request.

    (ii)     For a partn ership or sole proprietorship, a genera l partn er or th e proprietor.

    (iii)        For a count y, city, village, township, stat e, fede ra l, or oth er public agency, eith er a principal execut ive officer or rank ing elected officia l. For th is pur pose, a principal execut ive officer includes th e chief execut ive officer who ha s resp onsibili ty for th e overa ll operat ions of a principal geogra phic un it of th e agency.

    (iv)      For a ffect ed sour ces un der t itle IV of th e clean air act, th e des ignat ed represe ntat ive as defined in t itle IV of th e clean air act.

    (k)        "Rotogra vur e print ing" mean s th e applicat ion of words, designs, pictur es, or sur face coat ing to a substrat e by mean s of a roll print ing techn ique that involves  inta glio  or recessed ima ge ar eas in th e form of cells .

     

    R 336 .1120   De finitio ns ; T.

    Rule 120 .  As used in th ese ru les:

    (a)         "Temporar y sour ce" mean s a stat ionar y sour ce, pr ocess , or pr ocess equipment  that comm ences operat ion an d is locat ed at a geogra phic site for not more than 12 con secut ive month s.

    (b)       "Textur e coat " mean s a coat ing that is applied to a plastic part which, in it s finished form , con sists of discrete ra ised spots of th e coat ing.

     

     

    (c)       "Thin part icleboar d" mean s a  manu factur ed  boar d which  is 1/4 of an  inch  or  less  in th ickn ess an d which is ma de of individua l wood part icles that ha ve been coat ed  with  a binder an d form ed int o flat sheets by press ur e.

    (d)       "Thinn ing tank ," as it perta ins to R 336 .1631 , mean s an y vesse l which receives  resin from a reactor an d to which solvent s or oth er mat erials ar e added to th in th e resin.

    (e)     "Tileb oar d" mean s pan eling that  ha s a color ed, wat erpr oof sur face coat ing.

    (f)       "Toxic air contam inant " or "TAC" mean s an y air contam inant  for  which  th ere is  no nat iona l am bient air qua lity stan dar d an d which is or ma y becom e harm ful to public health or th e environm ent when prese nt in th e out door atm osphere in su fficient  quant it ies an d durat ion. For th e pur pose of th is definition, ALL OF th e followin g substan ces sha ll not be con sidered to be toxic air contam inant s:

    (i)     Acet ylene.

    (ii)     Alum inum meta l dust.

    (iii)      lum inum oxide (nonfibrous form s).

    (iv)     Amm onium sulfat e. (v)  Argon.

    (vi)     Calcium car bonat e.

    (vii)      Calcium hydroxide. (viii)  Calcium oxide.

    (ix)  Calcium silicat e. (xCalcium sulfat e.

    (xi)     Car bon dioxide.

    (xii)      Car bon monoxide. (xiii)  Cellulose.

    (xiv)      Coal dust.

    (xv)     Crysta lline silica emissions from an y of th e followin g pr ocesses :
