R 325 .77101 of th e Michigan Administrat ive Code is am ended as follows :

 

R 325 .77101   Scope .

Rule  1.     (1)  These  ru les  apply  to  all  occu pat iona l  exposur es  to  benzene,  chemical abstra cts service registr y no. 71-43-2, except as provided in subru les (2) an d (3) of th is ru le.

(2)   These ru les do not apply to an y of th e followin g:

(a)    The stora ge, tran sportat ion, distr ibut ion, dispe nsing, sale, or use of gasoline, motor fuels, or oth er fuels that conta in benzene after it s fina l dischar ge from bulk wholesale stora ge facilities, except that operat ions which dispe nse gasoline or motor  fuels  for  more than  4 hour s per day in an indoor locat ion ar e cover ed by th ese ru les.

(b)    Loading an d un loading operat ions at bulk wholesale stora ge facilities which use vapor contr ol systems for all loading an d un loading operat ions. However, such operat ions ar e subject to th e  provisions  of R  325 .77107  an d  R  325 .77109 (10 )  R  325 .77109 (9)  an d  th e ha zar d commun icat ion provisions of sections 14a to 14m of 1974 PA 154 , MCL Act N o. 154 of th e Pu blic Act s of 1974 , a s am e n ded , bei n g §§ 408 .1014 a to 408 .1014 m of th e Mich igan Com p ile d L a ws .

(c)     The stora ge, tran sportat ion, distr ibut ion, or sale of benzene or  liquid  mixtur es  that conta in more than 0.1% benzene in inta ct conta iners or in tran sportat ion pipelines while sealed  in  a  mann er   to  conta in   benzene  vapors   or   liquid.   However,  such   stora ge, tran sportat ion, distr ibut ion, or sale is  subject  to  th e  provisions  of  R  325 .77107  an d  R 325 .77109 (10 ) R 325 .77109 (9) an d th e ha zar d commun icat ion provisions of sections 14a to 14 m 1974 PA 154 , MCL of Act N o. 154 of th e Pu blic Act s of 1974 , a s am e n ded , bei n g §§ 408 .1014 a to 408 .1014 m   of th e Mich igan C om p ile d L a ws .

(d)  Conta iners an d pipelines that  carr y mixtur es which ar e less than  0.1% benzene.

(e)    Natura l gas-pr ocessi ng plant s that pr ocess gas which conta ins less than 0.1% pe r ce nt benzene.

 

 

(f)  Work operat ions where th e only exposur e to benzene is from liquid mixtur es that conta in 0.5% or less of benzene, by volum e, or th e vapors released from THE  s u ch  liquids  unt il Sep tember 12, 1988 ; work operat ions where th e only exposur e to benzene is from liquid mixtur es that  conta in 0.3% or less of benzene, by volum e, or th e vapors released from THE s u ch liquids from Sep tember 12, 1988 , to Sep tember 12, 1989 ; an d work operat ions where th e only exposur e to benzene is from liquid mixtur es that conta in 0.1% or less of benzene, by volum e, or th e vapors released from THE s u ch liquids after Sep tember 12, 1989 ; except that t ire-building ma chine operat ors who use solvent s which conta in more than 0.1% benzene ar e subject to th e provisions of R 325 .77109 .

(g)   Oil an d gas drilling, production, an d servicing operat ions. (h) Coke oven batt eries.

(3)    Clean ing an d repair operat ions of bar ges an d tank ers THAT w h ich ha ve conta ined benzene ar e excluded from th e provisions  of R  325 .77106 , R  325 .77105 (1) to (4), an d  R 325 .77105 (6). En gineering an d work pra ct ice contr ols sha ll be  used  to keep  exposur es below 10 ppm, un less it is proven to be not feasible.

(4)   These ru les replace th ose port ions of O.H. ru les 2101 (5), 2101 (8), an d 2103 that perta in to benzene for th ose industr ies cover ed by subru le (1) of th is ru le.
