    WHE REAS, Art icle V, Section 20, of th e Michigan Constitut ion of 1963 stat es that no appropriat ion is a man dat e to spe nd, an d that th e Govern or, with th e approval of th e appropriat ing comm itt ees of th e House of  Rep rese ntat ives  an d  Senat e,  sha ll  reduce expe nditur es auth orized by appropriat ions whenever it appe ar s that actua l revenu es for a fiscal period will fall below th e revenu e estimat es on which appropriat ions for that period were based , an d that reductions sha ll be ma de in a ccor dan ce with pr oced ur es prescribed by law; an d

     

    WHE REAS, it appe ar s that actua l revenu es for th e fiscal period October 1, 2001 to Sep tember 30, 2002 , will fall below th e revenu e estimat es on which appropriat ions for that period were based , said estimat es ha ving been determ ined by th e Legisl atur e in a ccor dan ce with Art icle IV, Section 31, of th e Constitut ion of th e Stat e of Michigan ; an d

     

    WHE REAS, un der provisions of Section 391 , Act 431 of th e Pu blic Acts of 1984 , on th e basis of writt en in format ion from th e Stat e Budget Director an d th e Stat e Treasur er, a finding ha s been ma de that  actua l revenu e will fall below such revenu e estimat es; an d

     

    WHE REAS, th ere is an unant icipat ed loss of fun ding which th e dep artm ent s an d agencies of stat e governm ent do not expe ct to obta in or mak e up dur ing th e curr ent fiscal year ; an d

    restr icted  revenu e  sour ces  tota ling  $144 ,571 ,000 .00  to be  used  as  genera l  fun d-genera l

    Sec. 18. (5) A licensee sha ll request th e dep artm ent to con duct a backgroun d check of each  prospe ctive employee  based  upon  a  nam e check. The licensee  sha ll obta in  a com plete an d signed  employment  applicat ion  for  all individua ls for  whom  a  nam e check is requested an d con ducted. The employment applicat ion sha ll be reta ined for at  least  1 year  from  th e dat e of it s submission. The dep artm ent  sha ll con duct  th e backgroun d check upon a writt en or telep honic request of a licensee a ccom pan ied by a fee of $5.00.
