    ALCOHOL AND DRUG TESTING OF BIOLOGICAL AND NON-BIOLOGICAL SPECIMENS

    The Michigan Department of State Police will hold a public hearing on Friday, December 17, 2004, to take comments on proposed revisions to the administrative rule sets entitled, “Alcohol Testing of Blood and Urine.” The hearing will be held at 1:00 p.m. at the Forensic Science Division, Lansing Laboratory, North Entrance, 7320 N. Canal Rd, Lansing, Michigan.

    N. Canal Rd, Lansing, Michigan 48913. Written comments must be post marked no later than January 2, 2005.

     

    The rule set entitled, “Alcohol Testing of Blood and Urine,” outlines the testing procedures for determining the level of alcohol in blood and urine samples. The rules are being revised by the Department of State Police to include alcohol and drug testing procedures for biological and non- biological specimens to comply with Section 257.625a of Act No. 95 of the Public Acts 1991, which establishes alcohol and drug testing of biological and non-biological specimens.

     

     

    The hearing is being conducted in compliance with the Administrative Procedures Act; 1969 PA 306, as amended, being MCL 24.201 et seq. The Michigan Department of State Police has the authority for rule promulgation pursuant to section 190 of Act No. 327 of the Public Acts of 1945, as amended, Section 625a of Act No. 300 of the Public Acts of 1949, as amended, and Section 8 of Act No 4 of the Public Acts of 1985, being MCL 259.190, 257.625a, and 470.208.
