    Rulemaking authority that required the Department of Education to promulgate administrative rules governing the Identification of Students Eligible for Bilingual Education Funding under section 1153 of 1976 PA 451, MCL 380.1153 is obsolete and unnecessary by the repeal of funding for educating students of limited English-speaking ability under section 41 of 1979 PA 94 through the enactment of 2011 PA 62.  The rules are obsolete and unnecessary.

     

    The Department is writing the Office of Regulatory Reinvention to request that corrections of the Administrative Code be made pursuant to the Administrative Procedures Act, sections 31(2) and 56(1), MCL 24.231 and MCL 24.256.

     

    Funding for educating students of limited English-speaking ability was repealed by 2011 PA 62, for the following administrative rules, effective October 1, 2011.
