    SUBJECT:      Request for correction of Michigan Administrative Code

    R 338.2101, R 338.2179f, and 338.2179g, pursuant to Administrative Procedures Act, Section 56(1), MCL 28.256.

     

    DATE:           (1999 MR 11, Eff. Nov. 17, 1999) Cosmetology Rules

     

    The Department of Consumer & Industry Services, Bureau of Commercial Services, as promulgating agency, is writing to request that the Office of Regulatory Reform exercise its discretion to correct three obvious errors in the Michigan Administrative Code, pursuant to Administrative Procedures Act, Section 56(1), MCL 28.256.

     

    The errors are contained in R 338, 2101, R 338.2179f, and 338.2179g. The rules were promulgated as part of general revisions to the Cosmetology rules, 1999 MR 11, effective 11/17/1999.

     

    The certified version of the rule filed with the Office of the Great Seal contains an obvious error in Rule 338.2101(f), in that it was drafted with a duplicate word.

     

    The affected line in subsection (2) currently reads:

    “Minimum practical application “means a service performed on a mannequin, student, student, or patron.” (Error highlighted.)

     

    The language should read:

    “Minimum practical application “means a service performed on a mannequin, student, or patron.” Another error was discovered in R 338.2179f involving an incorrect rule number.

     

     

    The affected line currently reads:

    “Rule 79g. If a cosmetologist or natural hair culturist fuses hair using an open flame, then the owner or practitioner of the establishment …” (Error highlighted)

     

    The language should read:

    “Rule 79f. If a cosmetologist or natural hair culturist fuses hair using an open flame, then the owner or practitioner of the establishment …”

     

    Finally, the language in R338.2179g contains an incorrect rule number as it currently reads: “Rule 79h. (1) A student, apprentice, or licensee shall not do any of the following:”

     

    The language should read:

    “Rule 79g. (1) A student, apprentice, or licensee shall not do any of the following:”
