Section 1. App li ca bility ; de fin itio ns
Sec. 1. (1) This adde ndum supplement s th e Cert ificat e of Need Review Stan dar ds for Hospita l Beds an d ma y be used for determ ining th e need for pr oject s esta blished to meet th e needs of HIV infected individua ls.
(2) Except as provided by sections 2 an d 3 below, th ese stan dar ds supplement an d do not supercede th e requirement s an d term s of approval required by th e Cert ificat e of Need Review Stan dar ds for Hospita l Beds .
(3) The definitions that apply to th e Cert ificat e of Need Review Stan dar ds for Hospita l Beds apply to th ese stan dar ds.
(4) "HIV infected" mean s that term as defined in Section 5101 of th e Code.
(5) Plann ing ar ea for pr oject s for HIV infected individua ls mean s th e Stat e of Michigan .
Section 2. Re qu iremen ts for app rova l; change in bed capacity
Sec. 2. (1) A pr oject which, if approved, will increase th e num ber of licensed hospita l beds in an overbedded subar ea or will result in th e tota l num ber of existing hospita l beds in a subar ea exceedi ng th e needed hospita l bed supply as determ ined un der th e Cert ificat e of Need Review Stan dar ds for Hospita l Beds ma y, neverth eless , be approved pur suant to subsection (3) of th is adde ndum .
(2) Hospita l beds approved as a result of th is adde ndum sha ll be included in th e Dep artm ent invent ory of existing beds in th e subar ea in which th e hospita l beds will be locat ed. Increases in hospita l beds approved un der th is adde ndum sha ll cau se subar eas curr ent ly showing a curr ent sur plus of beds to ha ve that sur plus increased .
(3) In order to be approved un der th is adde ndum , an applicant sha ll demonstrat e all of th e following:
(a) The Director of th e Dep artm ent ha s determ ined that action is necess ar y an d appropriat e to meet th e needs of HIV infected individua ls for qua lity, a ccessible an d efficient health car e.
(b) The hospita l will provide services only to HIV infected individua ls.
(c) The applicant ha s obta ined an obligat ion, en for ceable by th e Dep artm ent , from existing licensed hospita l(s) in an y subar ea of th is stat e to voluntar ily delicense a num ber of hospita l beds equa l to th e num ber proposed in th e applicat ion. The effect ive dat e of th e delicensur e action will be th e dat e th e beds approved pur suant to th is adde ndum ar e licensed. The beds delicensed sha ll not be beds already subject to delicensur e un der a bed reduction plan .
(d) The applicat ion does not result in more than 20 beds approved un der th is adde ndum in th e Stat e.
(4) In mak ing determ inat ions un der Section 22225 (2)(a ) of th e Code, for pr oject s un der th is adde ndum , th e Dep artm ent sha ll con sider th e tota l cost an d qua lity out com es for overa ll commun ity health systems for services in a ded icat ed port ion of an existing facility com par ed to a sep arat e aids facility an d ha s determ ined that th ere exists a special need , an d th e justificat ion of an y cost increases in term s of important qua lity/a ccess improvement s or th e likelih ood of futur e cost reductions, or both .
Section 3. P rojec t de li ve ry re qu ir emen ts --additiona l te rms of app rova l for projec ts invo lving HIV in fec ted ind ivid ua ls app roved unde r th is addendum .
Sec. 3. (1) An applicant sha ll agree that , if approved, th e services provided by th e beds for HIV infected individua ls sha ll be delivered in com plian ce with th e followin g term s of cert ificat e of need approval:
(a) The license to operat e th e hospita l will be limited to serving th e needs of pat ient s with th e clinical spe ctrum of HIV infection an d an y oth er limitat ions esta blished by th e Dep artm ent to meet th e pur poses of th is adde ndum .
(b) The hospita l sha ll be subject to th e genera l license requirement s of Part 215 of th e Code except as waived by th e Dep artm ent of Consum er & Industr y Services to meet th e pur poses of th is adde ndum .
(c) The applicant agrees that th e Dep artm ent of Consum er & Industr y Services sha ll revoke th e license of th e hospita l if th e hospita l provides services to inpat ient s oth er than HIV infected individua ls.
Section 4. Compa rative rev ie w s
Sec. 4. (1) Pr oject s proposed un der Section 3 sha ll be subject to com parat ive review .
