    PART 1.  GENER AL PROVISIONS

     

    R 29 .1801   App li ca bility .

    Rule 1.  (1) These  ru les apply to all of th e followi ng new an d exis ting health car e an d menta l health car e facilities:

    (a)  Fr ees tan ding sur gical out pat ient facilities.

    (b) Hospitals.

    (c) Nurs ing homes.

    (d) Homes for th e aged.

    (e) Psychiatr ic hospita ls an d psychiatr ic un its.

    (2)     Count y  medical car e facilities  ar e con sidered  nur sing  homes for  th e pur pose of th ese rules.

     

    R 29.1802   Life sa fety code ; adoption   by reference .

    Rule 2.  The provisions of cha pters 1 to 7, 12, 13, 26, 27, 32, an d 33 of th e nat iona l fire protection associat ion stan dar d no. 101 , 1997 edi tion, ent itled “Life Safety Code,” referr ed to in  th ese  ru les  as “code,”  ar e  adopted  by  reference  as  part  of  th ese  ru les.  Copies  of  th e adopted  provisions ar e available for inspection an d distr ibut ion eith er at  th e office of th e Stat e Fire Safety Boar d, Michigan Dep artm ent of Consum er an d Industr y Services, Office of Fire Safety, P.O.     Rule 3.  As used in th ese ru les:

    (a)    “Act mean s 1941 PA 207 , as am ended , being §29.1 et seq. of th e Michigan Compiled Laws.

    (b)   “Auth ority ha ving jur isdiction mean s th e  director  of  th e  Michigan  dep artm ent  of con sum er an d industr y services, an employee of th e dep artm ent of con sum er an d industr y services appoint ed by th e director to implement th e act, or an employee of a city, village, or township delegat ed to en for ce th e code un der th e provisions of section 2b of th e act.

    (c)  “Code” mean s nat iona l fire protection ass ociat ion stan dar d no. 101 , 1997 edition, ent it led “Life Safety Code.

    (d)   Cosmetic remodeling mean s sur face chan ges ma de solely to th e wall, floor , or ceiling, that do not decrease th e fire rat ing of th e wall, floor , or ceiling, including th e replacement of windows an d door s.

    (e)  “Count y medical car e facility mean s a nur sing car e facility, oth er than a hospita l long-term car e un it , which provides organ ized nur sing car e an d medical tr eatm ent to 7 or more unr elat ed individua ls who ar e su ffer ing or recover ing from illness , injur y, or infirm ity an d which is owned by a count y or count ies. For th e pur pose of th ese  ru les, a  count y medical car e facility sha ll be con sidered a nur sing home.

    (f)  Existing facility mean s a facility that is licensed as a health car e or menta l health car e facility un der th e provisions of 1978 PA 368 , as am ended , being §333 .1001 et seq. of th e Michigan Compiled Laws, an d 1974 PA 258 , as am ended , being §330 .1001 et seq. of th e Michigan Compiled Laws, on th e dat e th ese ru les becom e effect ive.

    (g)    “Fr ees tan ding sur gical out pat ient facility mean s a facility, oth er than th e office of a physician , dent ist , podiatr ist , or oth er privat e pra ctice office, that offer s a sur gical pr oced ur e an d relat ed car e which, in th e opinion of th e att ending physician , can be safely per form ed with out requiring overn ight inpat ient hospita l car e. The term does not include a sur gical out pat ient facility owned by, an d operat ed as part of, a hospita l.

    (h)    “Fr ees tan ding sur gical out pat ient facility, type I facility mean s a frees tan ding sur gical out pat ient facility that does not use an esth etics or medicat ions which render a person incapable of tak ing action in an emergency with in 2 minut es of being notified of an emergency.

    (i)   “Fr ees tan ding sur gical out pat ient facility, type II facility mean s a frees tan ding sur gical out pat ient facility that uses an esth etics or medicat ions which render a person incapable of tak ing action in an emergency with in 2 minut es of being notified of an emergency.

    (j)    Health car e facility mean s a facility as defined in section  20106  of 1978  PA 368 , as am ended , being §333 .20106 of th e Michigan Compiled Laws, an d includes th e facilities defined in subdivisi ons (e), (g), (h), (i), (j), (k), (l), (m), (n), (o), (q), (r), an d (s) of th is ru le.

    (k) Home for th e aged mean s a supervised persona l car e facility, oth er than a hotel, adult fost er  car e facility, hospita l, nur sing home, or  count y medical car e facility, that  provides r oom , boar d, an d supervised persona l car e to  21  or  more  unr elat ed,  nontran sient individua ls who ar e 60 year s of age or older. Home for th e aged includes a supervised persona l car e facility for 20 or fewer individua ls who ar e 60 year s of age or older if th e facility is operat ed in con jun ct ion with , an d as a distinct part of, a licensed nur sing home.

     

     

    (l)   Hospita l” mean s a facility that offer s inpat ient ,

    overn ight car e an d services for obse rving, diagnosing, an d actively tr eat ing an individua l who ha s a medical, sur gical, obstetr ic, chr onic, or reha bilitat ive con dition that requires th e daily direction or supervision of a physician . For th e pur poses of th ese ru les, th e term includes a hospita l long-term car e un it .

    (m)  Limited car e facility mean s a home for th e aged.

    (n)  Menta l health car e facility mean s a facility as defined in section 135 of 1974 PA 258 , as am ended , being §330 .1135 of th e Michigan Compiled Laws.

    (o)   Menta l hospita l,” psychiatr ic hospita l,” or psychiatr ic un it mean s an esta blishm ent that offer s inpat ient services for th e obse rvat ion, diagnosis, active tr eatm ent , an d overn ight car e of persons who ha ve  a  menta l  disease  or  who  ha ve  a  chr onic  menta l  disease  or con dition that requires th e daily direction or supervision of physician s who ar e licensed to pra ctice in th e stat e.

    (p)     “Mobile” mean s capable of removing or protecting onesel f from dan ger by ones own effort s.

    (q)  “Mobile an d tran sporta ble health car e stru ctur es mean tra ilers an d motor homes. Mobile an d tran sporta ble health car e stru ctur es sha ll com ply with part 6 of th ese ru les.

    (r)   Modular un it s mean s prefabricat ed un it s that ar e placed on piers or foun dat ions. Modular un it s sha ll com ply with th e requirement s of part 3 an d part 4 of th ese ru les.

    (s)    “Nurs ing home mean s a nur sing car e facility, including a count y medical car e facility, but excluding a hospita l or a facility that is or was creat ed pur suant to th e provisions of 1885 PA 152 , as am ended , being §36.1 et seq. of th e Michigan Compiled Laws, which provides organ ized nur sing car e an d medical tr eatm ent to 7 or more unr elat ed individua ls who ar e su ffer ing or recover ing from illness , injur y, or infirm ity.

    (t) ) Remodeling mean s an alterat ion or chan ge of fire-rat ed asse mbly, or th e insta llat ion  of new equipment required by th ese ru les.

    (u)   Typical smoke zone mean s th e avera ge size smoke zone with in th e facility.

     

    R 29 .1804   P lans  and  speci ficatio ns .

    Rule 4. (1) A health car e facility, or des ignat ed represe ntat ive sha ll submit plan s an d specificat ions to th e office of fire safety for all pr oject s that involve con stru ct ion, remodeling, or an addition.

    (2)     A health car e facility is not  required  to submit  plan s  an d  specificat ions  for  rout ine ma int enan ce fun ct ions or cosm etic remodeling; however, a health car e facility sha ll ensur e that  all work is in com plian ce with th ese ru les.

    (3)      Plan s an d specificat ions for work that involves th e pra ct ices of ar chitectur e or engineering, as defined by th e provisions of 1980 PA 299 , as am ended , being §339 .101 et seq. of th e Michigan Compiled Laws, an d kn own as th e occu pat iona l code , sha ll bear th e seal of an ar chitect or pr ofessi ona l engineer who is licensed pur suant to th e provisions of 1980 PA 299 , as am ended .

    (4)   Plan s an d specificat ions sha ll conta in all of th e followin g in format ion, as applicable: (a) A com plete floor plan an d layout of th e building dra wn a ccurat ely to scale.

    (b)   The use of each r oom .

    (c)  The dimensions of each r oom .

    (d)   The size, locat ion, direction of swing, an d fire rat ing of each door an d fram e asse mbly.

     

     

    (e)   The size an d locat ion of windows.

    (f)  The wall con stru ct ion, including th e fire-resis tan ce rat ing.

    (g)   The type of con stru ct ion as ident ified in th e nat iona l fire protection ass ociat ion stan dar d no. 220 , 1995 edition, ent it led Stan dar d on Types of Building Constru ct ion, as adopted in th ese ru les.

    (h)   The num ber of stories, including basement an d att ic ar eas.

    (i)   The int erior finish classificat ion.

    (j)   The locat ion of fuel-fir ed equipment . (k) The type of furna ce an d wat er heat er.

    (l)   Air-han dling system specificat ions.

    (m)    Fire detection an d alarm  system plan s an d specificat ions that  ar e in com plian ce with th e provisions of th e act.

    (n)    Sprink ler or oth er suppressi on system plan s an d specificat ions that  ar e in com plian ce with th e provisions of th e act.

    (o)  The type, size, an d locat ion of fire extinguishers.

    (p)   Oth er pert inent in format ion that  is required to determ ine com plian ce with th ese ru les.

    (5)    Plan approval that is given befor e th e effect ive dat e of th ese ru les sha ll term inat e 6 month s after th e effect ive dat e of th ese ru les if con stru ction ha s not start ed. However, upon writt en request, th e office of fire safety ma y grant an  approval  extension  in  a  specific instan ce.

     

    R 29 .1805   Inspec tio ns du ri ng const ruc tio n ; app rova l for occupancy  .

    Rule 5. (1) Dur ing con stru ct ion, addition, or remodeling, th e ar chitect, pr ofessi ona l engineer, or owners represe ntat ive sha ll notify th e office of fire safety, in writing, when th e building is ready for inspe ct ion un der both of th e followin g con ditions:

    (a)    When th e building is fram ed an d mechan ical systems ar e substant ially com plete, but befor e con cealment .

    (b) Upon com pletion of con stru ct ion.

    (2)  A  person  sha ll  not  occu py  a  newly  con stru cted  facility  or  a  facility  that   is  being remodeled or added to, in whole or in part , with out th e approval of th e office of fire safety.

     

    R 29 .1806 P rojec ts affec ti ng  outside  con fig u ration  of  bu ildi ng ;  site  plan  and speci ficatio ns ; offic e of fire  sa fe ty  or  loca l  fire  depa rt men t  speci ficatio ns ; fire sa fe ty measu res du ri ng const ruc tio n .

    Rule 6. (1) For pr oject s that  involve con stru ct ion, addition, or remodeling which a ffect th e out side con figurat ion of a building, an d as part of th e building plan s an d spe cificat ions oth erwise required by th ese ru les, befor e th e con stru ct ion begins, th e owner or th e owners auth orized represe ntat ive sha ll provide th e office of fire safety an d th e loca l fire dep artm ent with a site plan an d specificat ions that  deta il all of th e followin g:

    (a)   The available wat er supply.

    (b)   Hydrant  locat ions.

    (c)  Vehicle a ccess rout es. (d) Fire lan es.

    (2)    The auth ority ha ving jur isdiction or th e loca l fire dep artm ent  ma y spe cify an y of th e following:

     

     

    (a)   The size of th e wat er ma ins that  supply th e hydrant s.

    (b)   The locat ion of hydrant s.

    (c)   The locat ions an d dimensions of fire dep artm ent vehicle a ccess rout es.

    (d)  The posting of fire lan es.

    (3)   As soon as possible dur ing con stru ct ion, th e health car e facility sha ll ensur e that appropriat e fire safety measur es ar e tak en, including th e provision of fire extinguishers an d fire suppressi on systems an d th e esta blishm ent of a ccess rout es to th e building that can be tra vele d by fire dep artm ent vehicles.

     

    R 29 .1807   Elec trical  e qu ip men t; inspec tio ns ; ce rtifi cate .

    Rule 7. (1) The health car e facility or auth orized represe ntat ive sha ll ensur e that th e electr ical wiring an d equipment , including an emergency electr ical supply if insta lled, is in com plian ce with th e applicable provisions of R 408 .30801 et seq. of th e Michigan Administrat ive Code. Copies of th e ru les ar e available from th e Michigan Dep artm ent of Consum er an d Industr y Services, Bur eau of Constru ct ion Codes , P.O. Box 30254 , Lan sing, Michigan 48909 or from th e int ern et address www.stat e.mi.us/orr .

    (2)    Electr ical inspe ct ion sha ll be ma de by an electr ical inspe ct ion auth ority a ccep ta ble to th e office of fire safety. The auth ority sha ll issue a fina l cert ificat ion of com plian ce cover ing th e insta llat ion. The health car e facility, or auth orized represe ntat ive sha ll provide a copy of th e cert ificat e to th e office of fire safety.

     

    R 29 .1808   Unive rsa l amendments  .

    Rule 8.  Sections 1-3.11.1, 6 -4.3, 7 -1.1, 7 -4.2, 7-4.3, 7-6.4, 7-6.5.2, 33-1.1, an d 33-1.2 of th e

    code ar e am ended, section 7-6.5.2.1 is added , an d sections 7-1.2, 7-4.4, 7-4.5, an d 7-6.5.3 , ar e deleted, as follows :

    1-3.11.1. A person ma y occupy a building or port ion of a building dur ing constru ct ion, repair, alterat ions, or additions only if all mean s of egress an d all fire protection featur es in th e building an d on-site ar e in place an d cont inu ously ma inta ined for th e part occu pied an d if th e occu pied port ion is sep arat ed from th e part un der con stru ct ion by a wall that ha s a 1-hour -fir e-resis tan ce  rat ing.  The  temporar y  1-hour -rat ed  wall  that  is  used  for  th is sep arat ion ma y be con stru cted of com bustible mat erial. Instead of ha ving all mean s of egress an d fire protection featur es in place, th e health car e facility  ma y  tak e  oth er measur es that would provide equivalent safety if approved by th e office of fire safety. A health car e facility or part of a health car e facility sha ll not be occu pied, in whole or in part , with out approval from th e office of fire safety an d th e dep artm ent of con sum er an d industr y services, bur eau of health systems.

    6-4.3. The health car e facility sha ll store an d han dle flamma ble an d com bustible liquids in com plian ce with ru les promu lgat ed un der th e act.

    7-1.1. The health car e facility sha ll ensur e that equipment which ut ilize s gas an d relat ed gas piping is insta lled in  com plian ce  with  th e  provisions  of th e  nat iona l fire  protection ass ociat ion stan dar d no. 54, 1996 edition, ent it led “Nat iona l Fu el Gas Code, as adopted in th ese ru les or ru les promu lgat ed un der th e act, as applicable.

    Exception: Existing insta llat ions ma y be cont inu ed in service subject to approval by th e auth ority ha ving jur isdiction.

    7-1.2.  Deleted.

     

     

    7-4.2. The health  car e facility sha ll ensur e that  new elevat ors, escalat ors, dum bwaiters, an d moving walks ar e insta lled in com plian ce with R 408 .8101 et seq. of th e Michigan Administrat ive Code.

    7-4.3. The health car e facility sha ll ensur e that existing elevat ors, escalat ors, dum bwaiters, an d moving walks ar e in com plian ce with R  408 .8101  et  seq.  of  th e  Michigan Administrat ive Code.

    7-6.4. When emergency for ces notificat ion is specified by  an oth er  section  of  th e  code, actuat ion of emergency for ces notificat ion sha ll provide signa l notificat ion to alert th e loca l fire brigade or mun icipal fire dep artm ent of fire or oth er emergency. When fire dep artm ent notificat ion is required by an oth er section of th e code , th e health car e facility sha ll ensur e that th e fire alarm system is arran ged to aut omat ically tran smit an alarm to th e mun icipal fire dep artm ent thr ough an y of th e followin g mean s:

    (a)   An au xiliar y alarm system in com plian ce with th e provisions of th e nat iona l fire protection ass ociat ion stan dar d no. 72, 1996 edition, ent it led “Nat iona l Fire Alarm Code, as adopted in th ese ru les.

    (b)     A centra l stat ion conn ection in com plian ce with th e provisions of th e nat iona l fire protection ass ociat ion stan dar d no. 72, 1996 edition, ent it led “Nat iona l Fire Alarm Code.

    (c)    A proprietar y system operat or in com plian ce with th e provisions of th e nat iona l fire protection ass ociat ion stan dar d no. 72, 1996 edition, ent it led “Nat iona l Fire Alarm Code.

    Exception: A facility is in com plian ce with th is section if it ha s writt en policy an d pr oced ur e which is approved by th e facilitys govern ing body an d which is a ccep ta ble to th e auth ority ha ving jur isdiction.  The policy an d procedur e sha ll provide for all of th e following:

    (a)   The des ignat ion of a sta ff member on each shift to be resp onsible for notifying a loca l fire departm ent .

    (b)    The availability at all t imes of a nonpay telep hone for employees who ar e des ignat ed pur suant to th e provisions of subdivisi on (a) of th is subsection to notify a  loca l  fire departm ent .

    (c)    The telep hone num ber of th e loca l fire dep artm ent is con spicuously posted  near  th e telep hone.

    (d)  A requirement that notificat ion of th e fire dep artm ent be in cor porat ed int o all fire drills. 7-6.5.2. When required by an oth er section of th e code , th e health car e facility sha ll ensur e that  all of th e followin g fun ct ions ar e actuat ed by th e fire alarm system:

    (a)   The release of aut omat ic door closers.

    (b)   Sta irwell or elevat or sha ft press ur izat ion.

    (c)  A smoke mana gement or smoke contr ol system.

    (d)  The initiat ion of aut omat ic fire-extinguishing equipment .

    (e)   Em ergency light ing contr ol.

    (f)  The un lock ing of door s.

    (g)   Em ergency shut off of gas an d fuel supplies that ma y be ha zar dous, if th e cont inuat ion of service is not esse nt ial to th e prese rvat ion of life.

     

     

    7-6.5.2.1. Elevat or captur e an d contr ol -elevat or contr ols sha ll not be conn ected to th e fire alarm system.

    (b)     The building is protected  against  fire  by  blank  or  closed  walls  directly  un der  th e sta irway an d for a distan ce of 6 feet in all oth er directions, with a window perm itt ed with in th is ar ea in a fixed fire window asse mbly in a ccor dan ce with section 6-2.3.2.2 of th e code.

    (c)    The bott om r iser term inat es at groun d level, with th e last r iser not  more  than  th e spacing of a r iser above.

    (d)   A door way leading to a fire escape is at floor level.

    13 -2.2.6. The width of class A or B ram ps sha ll be as specified in section 13-2.3.3 of th e code or existing ram ps ma y rema in subject to th e auth ority ha ving jur isdiction.

    13 -2.3.4. The minimum clear width for evacuat ion pur poses only for door s in th e mean s of egress from  hospita l, nur sing home, an d limited  car e sleeping r oom s an d diagnostic an d tr eatm ent ar eas, such as X-ra y, sur gery, or physical th era py ar eas, sha ll be not less than 32 inches (86 cm). For am bulat ory pat ient an d reside nt use, an  existing 30-inch door width sha ll be perm itt ed.

    13 -2.5.9.     Exception: Existing dead-end corr idors ma y be cont inu ed in use if it is not pra ct ical an d feasible to alter th em so that exits will be a ccessible in at least 2 differ ent directions from all point s in aisles, passageways, an d corr idors.

    13 -3.1.1. Any sta irway, ram p, light or vent ilat ion sha ft , chut e, an d oth er vert ical opening between stories sha ll be enclosed in a ccor dan ce with th e provisions of section 6-2.4 of th e code.  The  enclosur e  sha ll  be  constru cted  of mat erial  that  ha s  a  ½-h our -fir e-resis tan ce rat ing.     (c)    The bott om r iser term inat es at groun d level, with th e last r iser not  more  than  th e spacing of a r iser above.

Direct supervision by facility sta ff is not required for th e waiting ar eas if th e lobby is sep arat ed from th e corr idors that ent er th e lobby by walls an d door s that ar e in com plian ce with th e sam e fire-resis tan ce rat ing an d con stru ct ion requirement s as a smoke barr ier wall.

    12-3.5.1. All nur sing homes, including additions to existing buildings, regar dless of height , floor ar ea, or con stru ct ion types , sha ll be protected thr oughout by an approved aut omat ic sprink ler system, except as follows :

    (a)   This section does not apply to th e remodeling of ar eas of an existing nur sing home where th e remodeling is cosm etic or th e ar ea involved is sma ller than a typical smoke zone of th e facility.

    (b)  This section does not apply to an addition to an existing r oom ar ea un less aut omat ic sprink lers ar e required by th e type of r oom use.

    (c)  In modular health car e un it s, alternat ive fire suppressi on systems, a ccep ta ble to th e auth ority ha ving jur isdiction, sha ll be perm itt ed in place of required aut omat ic sprink ler systems.

    12 -3.6.1. Corr idors sha ll  be  sep arat ed  from  all  oth er  ar eas  by  part it ions  that  ar e  in com plian ce with section 12-3.6.2 to section 12-3.6.5 of th e code.

    Exception no. 1: Spaces ma y be un limited in ar ea an d open to th e corr idor if all of th e followin g provisions ar e sat isfied:

    (a)   The spaces ar e  not  used  for  pat ient  sleeping  r oom s,  tr eatm ent  r oom s, or  ha zar dous ar eas.

    (c)  The open space is protected by an electr ically supervised aut omat ic smoke detection system insta lled in a ccor dan ce with section 12-3.4 of th e code or th e ent ire space is arran ged an d locat ed to perm it direct supervision by th e facility sta ff from a nur sing stat ion  or similar space.

    (d) The space does not obstru ct a ccess to required exits.

    Exception no. 2 : Waiting ar eas ma y be open to th e corr idor if all of th e followin g provisions ar e sat isfied:

    (a)  The aggregat e waiting ar ea in each smoke com partm ent is not more than 600 squar e feet (55.7 squar e meters).

    (b)  Ea ch ar ea is protected by an electr ically supervised aut omat ic smoke detection system insta lled in a ccor dan ce with section 12-3.4 of th e code or each ar ea is arran ged an d locat ed to perm it direct supervision by th e facility sta ff from a nur sing stat ion or similar space.

    (c) The ar ea does not obstru ct a ccess to required exits.

    Exception no. 3:  A nur sing an d contr ol stat ion that  is su fficient  in size for th e num ber of occu pant s served ma y be open to th e corr idor if all of th e followin g provisions ar e sat isfied: (a) The stat ion is sta ffed 24 hour s a day.

    (b)   The stat ion does not reduce th e required corr idor width .

    (c)   The stat ion conta ins only commun icat ion an d monitoring equipment , a desk or count er, seat ing, an d a stora ge space for use in chart ing.

    (d)    Wall an d ceiling int erior finishes sha ll ha ve a class A fire ha zar d classificat ion. The perm itt ed desk or count er an d enclosed stora ge space sha ll not be con stru cted of mat erials that  ar e more ha zar dous than  class B for all exposed sur faces.

    Exception  no.  4:    Gift  shops  which  open  to  th e  corr idor  an d  which  ar e  protected  in a ccor dan ce with section 12-3.2.5 of th e code.

    12-3.6.3.1. Door s protecting corr idor openings sha ll be con stru cted to resis t th e passage of smoke.

    12-3.8.1. Every pat ient sleeping r oom sha ll  ha ve  an  out side  window  or  out side  door arran ged an d locat ed so that it can be opened from th e inside to perm it th e vent ing of products of com bustion an d to perm it an y occu pant to ha ve direct a ccess to fresh air in case of emergency. The ma ximum  a llowable sill height sha ll not be more than  36 inches above th e floor . If windows require th e use of t ools or keys for operat ion, th en th e t ools or keys sha ll be locat ed at a prominent locat ion a ccessible  to sta ff on th e floor where th e windows ar e situat ed.

    Exception: Smoke com partm ent s that ar e protected thr oughout with an aut omat ic extinguishing system which is in com plian ce with section 13-3.5.3 of th e code.

    (iii)    Secur ity roun ds sha ll be con ducted an d key-recor ded on th e chart s at least once every hour in each locat ion between th e hour s of 11 p.m. an d 7 a.m.  If  th e  exception  to subdivisi on (ii) is ut ilize d, th e secur ity roun ds do not need to be  key-recor ded. Secur ity roun ds sha ll be con ducted  an d  recor ded  on  form s  a ccep ta ble  to  th e  auth ority  ha ving jur isdiction. The facility administrat ion sha ll keep th e key-recor ded  chart s,  or  form s docum ent ing roun ds if a llowed , on file for 1 year an d mak e th em available for review by fire safety inspection auth orities.

     

     

    (iv)   An att endant who is required pur suant to th e provisions of th is ru le sha ll be physically an d menta lly capable of per form ing th e dut ies of evacuat ion. Only th e mana gement or an employee of th e mana gement sha ll be con sidered an att endant .

    (v)   Existing home for th e aged facilities sha ll only house mobile reside nt s un less th e smoke com partm ent s that house non-mobile reside nt s ar e protected thr oughout by an aut omat ic extinguishing system that is in com plian ce with section 13-3.5.3 of th e code . The facility owner or des ignat ed represe ntat ive sha ll com ply with th is requirement with in 2 year s of th e effect ive dat e of th ese ru les.

    13 -2.2.1. Component s of mean s of egress sha ll be restr icted to th e perm issible types described in section 13-2.2.2 to section 13-2.2.10 of th e code.

    Exception: A health facility which, befor e th e effect ive dat e of th ese ru les, ha d an out side fire escape or escapes as required mean s of egress or which ha d an out side fire escape or escapes to corr ect an existing deficiency creat ed by a dead-end corr idor sha ll not be required to replace th e fire escape or escapes to com ply with th is ru le if all of th e followin g provisions ar e sat isfied:

    (a)    Upon a request of th e office of fire safety, th e fire escape or escapes ar e cert ified by an ar chitect or pr ofessi ona l engineer, in a ffida vit form , att esting to th eir stru ctura l sta bility.

    (b)     The building is protected  against  fire  by  blank  or  closed  walls  directly  un der  th e sta irway an d for a distan ce of 6 feet in all oth er directions, with a window perm itt ed with in th is ar ea in a fixed fire window asse mbly in a ccor dan ce with section 6-2.3.2.2 of th e code.

    (c)    The bott om r iser term inat es at groun d level an d th e last r iser is not more than th e spacing of a r iser above.

    (d)   A door way leading to a fire escape is at floor level.

    13 -2.2.6. The width of class A or B ram ps sha ll be as specified in th e provisions of section 13 -2.3.3 of th e  code  or  existing  ram ps  ma y  rema in  subject  to  th e  auth ority  that  ha s jur isdiction.

    13 -2.3.4. For evacuat ion pur poses only th e minimum clear width for door s in th e mean s of egress from  hospita l, nur sing home, an d limited  car e sleeping r oom s an d diagnostic an d tr eatm ent ar eas, such as X-ra y, sur gery, or physical th era py, sha ll be not less than 32 inches (81 cent imeters). For am bulat ory pat ient an d reside nt use, an existing 30-inch door sha ll be perm itt ed.

    13 -2.5.9. Every corr idor sha ll provide a ccess to not less than 2 approved exits in a ccor dan ce with th e provisions of  sections  5-4  an d  5-5  of  th e  code  with out  passing  thr ough  an y int ervening r oom s or spaces oth er than corr idors or lobbies .  Waiting ar eas ma y be locat ed in lobby ar eas if th e waiting ar eas ar e in com plian ce with th e waiting ar ea exceptions listed in th e provisions of section 13-3.6.1 of th e code.     13 -3.1.1. Any sta irway, ram p, light or vent ilat ion sha ft , chut e, an d oth er vert ical opening between stories sha ll be enclosed in a ccor dan ce with th e provisions of section 6-2.4 of th e code The enclosur e sha ll be constru cted  of mat erials that  ha ve a  ½-h our -fir e-resis tan ce

    13 -3.5.9.  The ma in sprink ler contr ol valve or valves sha ll be electr ically supervised so that at least a loca l alarm will soun d at a con stant ly att ended locat ion when th e valve is closed . If a constant ly att ended locat ion is not available, th en  th e  local alarm  ma y soun d  at  a rout inely monitored locat ion when th e valve is closed .

    (d)   The ar ea is equipped with an electr ically supervised aut omat ic smoke detection system insta lled in a ccor dan ce with section 13-3.4 of th e code .

    (e) The ar ea does not obstru ct an y a ccess to required exits.

    Section 13-3.6.3.1. Door s protecting corr idor openings in oth er than required enclosur es of vert ical openings, exits, or ha zar dous  ar eas  sha ll  be  substant ial  door s,  such  as  door s con stru cted of 1 3/4-inch (4.4 cent imeters) th ick solid bonded cor e wood or con stru cted to resis t fire for 20 minut es an d sha ll be con stru cted to resis t th e passage of smoke.

    (iv)   An att endant who is required pur suant to th e provisions of th is ru le sha ll be physically an d menta lly capable of per form ing th e dut ies of evacuat ion. Only th e mana gement or an employee of th e mana gement sha ll be con sidered an att endant .

    (v)   Existing home for th e aged facilities sha ll only house mobile reside nt s un less th e smoke com partm ent s that house non-mobile reside nt s ar e protected thr oughout by an aut omat ic extinguishing system that is in com plian ce with section 13-3.5.3 of th e code . The facility owner or des ignat ed represe ntat ive sha ll com ply with th is requirement with in 2 year s of th e effect ive dat e of th ese ru les.

    Rule 52. (1) The provisions of cha pters 1 to 7, 12, an d 33 of th e code that apply to new limited car e occu pan cies, except  as am ended  by th ese  ru les, ar e adopted  by reference in th ese ru les.     12 -1.1.3.1.  (i) Homes for th e aged sha ll be sta ffed as follows :

    (A)  For 19 to 100 reside nt s -2 att endant s who ar e awak e an d fully dressed .

    (B)   For 101 to 180 reside nt s -3 att endant s who ar e awak e an d fully dressed .

    (C)   For 181 to 260 reside nt s -4 att endant s who ar e awak e an d fully dressed .

    (D)   For each additiona l 80 reside nt s -1 additiona l att endant who is awak e an d fully dressed .

    (ii)      Secur ity roun ds sha ll be con ducted an d docum ent ed  on  form s  a ccep ta ble  to  th e auth ority ha ving jur isdiction at least once every hour between th e hour s of 11 p.m. an d 7 a.m.  Secur ity roun ds sha ll include all ar eas of th e facility.

     

     

    (iii)    An att endant who is required pur suant to th e provisions of th is ru le sha ll be physically an d menta lly capable of per form ing th e dut ies of evacuat ion. Only th e mana gement or an employee of th e mana gement sha ll be con sidered an att endant .

    12 -2.5.9. Every corr idor sha ll provide a ccess to not less than 2 approved exits in accordan ce with th e provisions of  sections  5-4  an d  5-5  of  th e  code  with out  passing  thr ough  an y int ervening r oom s or spaces oth er than corr idors or lobbies .  Waiting ar eas ma y be locat ed in lobby ar eas if th e waiting ar eas ar e in com plian ce with th e waiting ar ea exceptions listed in section 12-3.6.1 of th e code. Direct supervision by facility sta ff is not required for th e waiting ar eas if th e lobby is sep arat ed from th e corr idors that ent er th e lobby by walls an d door s that ar e in com plian ce with th e sam e fire-resis tan ce rat ing an d con stru ct ion requirement s as a smoke barr ier wall.

    12 -3.4.5.1. An approved aut omat ic smoke detection system sha ll be insta lled in all corr idors of limited car e facilities. The system sha ll be insta lled in a ccor dan ce with section 7-6 of th e code.

    Exception: If each pat ient sleeping r oom is protected by an approved smoke  detection system an d a loca l smoke detector is provided at smoke barr iers an d horizonta l exits, th en an approved aut omat ic smoke detection system need not be insta lled in th e corr idors on th e pat ient sleeping r oom floor s.

    12-3.5.1. All homes for th e aged, including additions to existing buildings, regar dless of height , floor ar ea, or  con stru ct ion  types sha ll  be  protected  thr oughout  by  an  approved aut omat ic sprink ler system.  The following exceptions apply:

    (a)     This provision sha ll not apply to th e remodeling of ar eas of an existing home for th e aged if th e remodeling is cosm etic or th e ar ea involved is sma ller than a typical smoke zone of th e facility.

    (b) This provision sha ll not apply to an addition to an existing r oom ar ea un less aut omat ic sprink lers ar e required by th e type of r oom use.

    12 -3.5.5.  The ma in sprink ler contr ol valve or valves sha ll be electr ically supervised so that at least a loca l alarm will soun d at a con stant ly att ended locat ion when th e valve is closed . Where a constant ly att ended locat ion is  not  available, th e  local  alarm  ma y  soun d  at  a rout inely monitored locat ion when th e valve is closed .

    12 -3.6.1. Corr idors sha ll  be  sep arat ed  from  all  oth er  ar eas  by  part it ions  that  ar e  in com plian ce with sections 12-3.6.2 thr ough 12-3.6.5 of th e code .

    Exception no. 1: Spaces ma y be un limited in ar ea an d open to th e corr idor if all of th e followin g provisions ar e sat isfied:

    (a)   The spaces ar e  not  used  for  pat ient  sleeping  r oom s,  tr eatm ent  r oom s, or  ha zar dous ar eas.

    (b) The corr idors ont o which th e spaces open in th e sam e smoke com partm ent ar e protected by an electr ically supervised aut omat ic smoke detection system insta lled in a ccor dan ce with section 12-3.4 of th e code or th e smoke com partm ent in which th e space is locat ed is protected thr oughout by quick-resp onse sprink lers.

    (c)  The open space is protected by an electr ically supervised aut omat ic smoke detection system insta lled in a ccor dan ce with section 12-3.4 of th e code or th e ent ire space is arran ged an d locat ed to perm it direct supervision by th e facility sta ff from a nur sing stat ion  or similar space.

    (d) The space does not obstru ct a ccess to required exits.

     

     

    Exception no. 2 : Waiting ar eas ma y be open to th e corr idor if all of th e followin g provisions ar e sat isfied:

    (a)  The aggregat e waiting ar ea in each smoke com partm ent is not more than 600 squar e feet (55.7 squar e meters).

    (b)  Ea ch ar ea is protected by an electr ically supervised aut omat ic smoke detection system insta lled in a ccor dan ce with section 12-3.4 of th e code or each ar ea is arran ged an d locat ed to perm it direct supervision by th e facility sta ff from a nur sing stat ion or similar space.

    (c) The ar ea does not obstru ct a ccess to required exits.

    Exception no. 3:  A nur sing an d contr ol stat ion that  is su fficient  in size for th e num ber of occu pant s served ma y be open to th e corr idor if all of th e followin g provisions ar e sat isfied: (a) The stat ion is sta ffed 24 hour s a day.

    (b)   The stat ion does not reduce th e required corr idor width .

    (c)   The stat ion conta ins only commun icat ion an d monitoring equipment , a desk or count er, seat ing, an d a stora ge space for use in chart ing.

    (d)    Wall an d ceiling int erior finishes sha ll ha ve a class A fire ha zar d classificat ion. The perm itt ed desk or count er an d enclosed stora ge space sha ll not be con stru cted of mat erials that  ar e more ha zar dous than  class B for all exposed sur faces.

    Exception  no.  4:    Gift  shops  which  open  to  th e  corr idor  an d  which  ar e  protected  in a ccor dan ce with section 12-3.2.5 of th e code.

    Exception no. 5: In a limited car e facility, group meeting or  mu lt ipur pose  th era peut ic spaces sha ll be perm itt ed  to  open  to  th e  corr idor  if  all  of  th e  followin g  provisions  ar e sat isfied:

    (a)   The space is not a ha zar dous ar ea.

    (b)    The space is protected by an electr ically supervised aut omat ic smoke detection system insta lled in a ccor dan ce with section 12-3.4 of th e code or th e space is arran ged an d locat ed to perm it direct supervision by th e facility sta ff from th e nur sing stat ion or similar locat ion.

    (c)   The ar ea does not obstru ct a ccess to required exits.

    12-3.6.3.1. Door s protecting corr idor openings sha ll be con stru cted to resis t th e passage of smoke.

    Exception:  Deleted.

    12-3.6.3.2. Door s sha ll be provided with positive-lat ching har dwar e. Roller lat ches ar e prohibited.

    Exception:  Deleted.

    12 -3.6.4. Tran sfer grilles, wheth er or not protected by fusible link-ope rat ed dam pers, sha ll not be used in corr idor walls or door s.

    Exception:  Deleted.

    12-3.8.1. Every pat ient sleeping r oom sha ll  ha ve  an  out side  window  or  out side  door arran ged an d locat ed so that it can be opened from th e inside to perm it th e vent ing of products of com bustion an d to perm it an y occu pant to ha ve direct a ccess to fresh air in case of emergency. The ma ximum a llowable sill height sha ll not be more than 36  inches  (91 cent imeters) above th e floor . If windows require th e use of t ools or keys for operat ion, th en th e t ools or keys sha ll be locat ed at a prominent locat ion a ccessible to sta ff on  th e floor where th e windows ar e situat ed.

    Exception no. 1 : Deleted.

    Exception no. 2 : Room s int ended for occu pan cy for less than  24 hour s.

    P ART 6.  MOBILE AND TRANS P ORTABLE UN IT HE ALTH CARE STRU CTURES

    Rule 61.   (1) This section  applies to new an d existing mobile  an d tran sporta ble un it health car e stru ctur es.

    (2)  New an d existing mobile an d tran sporta ble un it  health  car e  stru ctur es  sha ll  be  in com plian ce with all of th e followin g provisions:

    (a) If a dock seal-type conn ector is ut ilize d between th e mobile or tran sporta ble un it an d th e health car e facility, th en th e dock seal manu factur er's specificat ions sha ll be submitt ed to th e auth ority ha ving jur isdiction for review an d approval. The ma ximum length of a dock seal conn ector is 10 feet (3 meters).

    (b)  If con vent iona l building con stru ct ion is used for th e conn ecting link between th e un it an d th e health car e facility, com plian ce, as applicable, with section 12-1.6.2 or 13-1.6.2 of th e code is required.

    (c) A un it sha ll be locat ed not less than 10 feet (3 meters) from an y un protected building opening. Building openings include door s, windows, an d louvers. A un it sha ll be locat ed not less than 20 feet (6.1 meters) from a pat ient sleeping r oom window un less perm itt ed by th e dep artm ent of con sum er an d industr y services bur eau of health systems.

    (d)   The un it sha ll be protected thr oughout  by an  approved fire suppressi on system that  is insta lled,  tested,  an d  ma inta ined  in  a ccor dan ce  with  th e  manu factur ers  requirement s, applicable nat iona l fire protection ass ociat ion stan dar ds, an d is in com plian ce with th e act. Exception:  Existing un it s that  do not ha ve a fire suppressi on system ma y cont inu e in use. Any ma jor renovat ion  to an  existing un it sha ll require com plian ce with  subse ct ion (d) of th is ru le.  Major renovat ion includes replacement of diagnostic or tr eatm ent equipment or chan ges to th e int erior of th e un it that  a ffect s more than  50% of th e squar e foota ge ar ea of th e un it .

    (e)     At  least  one  porta ble  fire  extinguisher  that   is  insta lled,  tested,  an d  ma inta ined  in a ccor dan ce with th e nat iona l fire  protection  ass ociat ion  stan dar d  no.  10,  1994  edition, ent it led "Stan dar d for Porta ble Fire Extinguishers," as adopted in th ese ru les, sha ll be provided in th e contr ol r oom or oth er sta ffed locat ion with in th e un it .

    (f) The administrat ion of th e health car e facility sha ll provide a writt en plan an d tra ining to sta ff assigned to work  in  th e  un it  that  includes  evacuat ion  of  pat ient s,  secur ing  an d sep arat ing th e un it from th e health car e facility in th e case of a fire or oth er emergency, an d notificat ion of appropriat e emergency personn el. The writt en plan an d docum entat ion of tra ining sha ll be ma de available to th e auth ority ha ving jur isdiction upon request.

    (g) If th e mobile or tran sporta ble un it is shar ed with oth er health car e facilities, a fire pull stat ion sha ll be insta lled in th e dock ing ar ea of each of th e shar ed health  car e facilities. The pull stat ion sha ll initiat e th e health car e facility fire alarm system.

     

     

    (h)    If an overh ead door is used for pat ient a ccess between th e un it an d th e building, th en a side-hinged, swinging-type door that is a minimum 41.5 inches (105 cent imeters) in clear width sha ll be provided on th e un it .

    Exception no. 1: If pat ient s ar e tran sport ed ont o th e un it on a str etcher that is 28 inches (71.1 cent imeters) or less in width , th en a side-hinged door that is a minimum of 32 inches (81 cent imeters) in clear width sha ll be perm itt ed.

    Exception no. 2: Existing swinging door insta llat ions that ar e less than 41.5 inches (105 cent imeters) in clear width ma y cont inu e to be used subject to th e approval of th e auth ority ha ving jur isdiction.

    (i)   Int erior finish mat erials sha ll be a minimum class C as defined in section 6-5 of th e code .
