    NOTICE OF PUBLIC HEARING

    Licensing of Substance Abuse Service Programs Methadone Treatment and Other Chemotherapy Substance Abuse Service Program

    Case Finding Prevention

     

    The Department of Community Health will hold a public hearing on Thursday, April 13, 2006, at 9:00

    a.m. at the Department of Community Health, 201 Townsend, 1st Floor, Conference Center B & C,

    Lansing, Michigan.

     

    The public hearing is being held to receive comments from interested persons on the Substance Abuse administrative rules. The department will rescind outdated rules as follows: R 325.14521 through R325.14530(2) Part 5; Prevention Subpart 2; Problem Assistance; R325.14621 through R325.14623 Casefinding Subpart 2 Organizational Development. These rescissions are necessary as the rules are outdated, and not consistent with current best practice. Corresponding revisions are proposed for R325.14101 (f), R325.14102(m) and R325.14208(b)(c).

     

    The department will amend rules as follows: R325.14103(g); R325.14208, R325.14213(c ); R325.14419(2)(g)(m); R325.14419(2)(m) and R325.14419(2)(g).

     

    Revision to R325.14103 (g) will amend the definition of “substance abuse program” to exclude activities necessary to determine eligibility, authorize and/or manage substance abuse services. These activities are recognized as administrative by the funders of treatment services.

     

    The department will amend rules R325.14208 (1) Service Categories to reflect current best practice by adding categories for case management, integrated treatment for persons with mental health and substance use disorders, early intervention and peer recovery and support as substance abuse programs. These services are currently recognized as best practice and current rules are a barrier to implementation. R325.14213(2)( c) will be amended to require an evaluation of a demonstration project, provide sufficient time for an evaluation to be completed and for continuation of the waiver if waiver requirements have been met.

     

    R325.14419(2)(g)(m) will be amended so that the frequency of counseling and required progress notes for persons receiving Methadone treatment are based on their treatment plan rather than set at twice monthly.

     

    These rules are being promulgated under the authority conferred by the authority conferred on the director of the department of community health by section 6231 of 1978 PA 368, MCL 333.6231 and Executive Reorganization Order Nos. 1991-3, 1996-1, and 1997-4, MCL 333.26321, 330.3101, and 333.26324. These rules are proposed to take effect immediately upon filing with the Secretary of State.
