SUBJECT: Request for correction of the Part 10, Michigan Uniform Energy Code R 408.31065, pursuant to Administrative Procedures Act, Section 56(1), MCL
24.256 (1).

The Bureau of Construction Codes, as a promulgating agency, is writing to request that the State Office of Administrative Hearings and Rules exercise its discretion to correct an obvious error in the Part 10, Michigan Uniform Energy Code Rules as published in the Michigan Administrative Code.
The error is contained in R 408.31065. The rule was promulgated as part of the revisions to the Part 10, Michigan Uniform Energy Code, 2010 MR 21, Eff. March 9, 2011.
The agency adopted the 2009 version of the International Energy Conservation Code, amending Table 402.1.3 to reflect only Michigan specific equivalent U-factors. When the Table was typed for inclusion as the Michigan rule the anchor of footnote “a” was inadvertently left from the table title.
The affected Table currently reads (italics added):

d. Foundation U-factor requirements shown in Table 402.1.3 include wall construction and interior air films, but exclude soil conductivity and exterior air films. U-factors for determining code compliance in accordance with
section 402.1.4 (total UA alternative ) of section 405 (simulated performance alternative) shall be modified to include soil conductivity and exterior air films.

The error is contained in R 408.31060e. The rule was promulgated as part of the revisions to the Part 10, Michigan Uniform Energy Code, 2010 MR 21, Eff. March 9, 2011.
The agency adopted the 2009 version of the International Energy Conversation Code, amending Table 301.3(2) to reflect only Michigan specific climate zones. When the Table was typed for inclusion as the Michigan rule the SI Units column Heating Degree Days (HDD) were incorrectly listed as Farenheit (F). This Table corresponds with Table 301.3(1), which defines the major climate types. SI Units are a metric measurement. Showing these measurements as Farenheit will create conflict and result in incorrect thermal measurements when calculating the proper insulation to be used in residential structures.
The affected Table currently reads:
