The Department of Labor and Economic Growth, Michigan Public Service Commission, will hold a hearing to receive public comments on a rule being promulgated under 2004 PA 241 as amended by 2005 PA 298, MCL 752.1063 et seq. Public Act 298 creates an exemption from the prohibition on sending messages regarding adult products and services if certain conditions are met. Among the conditions that must be met by senders is a requirement that prior to sending an otherwise prohibited message, the sender must obtain from an age-verified adult an affirmative statement of consent to receive the message at an adult designated contact point. The Department expects that this rulemaking process will take nine months.
The rule (ORR #2006-012) is published on the Michigan Government web site at http://www.michigan.gov/orr and in the April 15 issue of the Michigan Register. Comments may be submitted to the following address by 5:00 p.m. on April 28, 2006. This rule becomes effective immediately upon filing with the Secretary of State unless adopted under sections 33, 44, or 45a (6) of 1969 PA 306. Rules adopted under these sections become effective seven days after filing with the Secretary of State.
