    Rule 405 .  Section 106 .1 of th e code is am ended to read as follows :

    106 .1. Submitta l docum ent s. Constru ct ion docum ent s, special inspection an d stru ctura l program s an d oth er data sha ll be submitt ed in 1 or more sets with each applicat ion for a perm it . The con stru ct ion docum ent s sha ll be prepar ed by, or un der th e direct supervision of, a registered des ign  pr ofessi ona l  when  required  by  art icle  20  of 1980  PA 299 MCL 339 .101 et seq.     Rule 406 .  Section 103 .2 of th e code is am ended to read as follows :

    103 .2. Building officia l mean s th e  person  who  is  appoint ed  an d  employed  by  a governm enta l subdivisi on char ged with th e  administrat ion  an d  en for cement  of  th e  stat e code or codes an d who is registered in  a ccor dan ce  with  th e  requirement s  of 1986  PA 54, MCL  338 .2301  et  seq.

     

    R 408 .30408   Fees .

    Rule 408 .  Section 108 .1 of th e code is am ended to read as follows :

     

    108 .1.  Pa yment  of fees .   The fees prescribed by section 22 of th e act sha ll be paid to th e en for cing agency of th e jur isdiction befor e a perm it to begin work for new con stru ct ion, alterat ion, removal, demolition, or oth er building operat ion ma y be issued. In addition, an am endment to a perm it necessi tat ing an additiona l fee sha ll not be approved unt il th e additiona l fee ha s been paid.

     

    R 408 .30409   Pe rmit .

    Rule 409 . Sections 105 .1.1, 105 .1.2, an d 105 .2 of th e code ar e am ended to read as follows : 105 .1.1. Annua l perm it . In place of an individua l perm it for each alterat ion to an already approved electr ical, gas, mechan ical, or plum bing  insta llat ion,  th e  en for cing  agency  is auth orized to issue an annua l perm it upon  applicat ion  th erefor e to an y person, firm , or cor porat ion. The applicant sha ll be licensed in a ccor dan ce with th e requirement s of 1956 PA 217 , MCL 338 .881 et seq., 1984  PA 192 , MCL 338 .971 et seq., or 1929  PA 266 , MCL

    338 .901 et seq.

    105 .1.2.  Annua l perm it recor ds.  The person to whom an annua l perm it is issued sha ll keep a deta iled recor d of alterat ions ma de un der an annua l perm it . Access to th e recor ds sha ll be provided at all t imes an d th e recor ds sha ll be filed with th e en for cing agency.

    105 .2. Work exempt from perm it . Exemptions from perm it requirement s of th e code sha ll not be deemed to grant auth orizat ion for an y work to be done in an y mann er in violat ion of th e provisions of th e code or an y oth er laws or ordinan ces of th is jur isdiction. Perm it s sha ll not be required for an y of th e following:

    (a)    Building perm it s sha ll not be required for an y of th e followin g:

    (i)   One-story deta ched a ccess ory stru ctur es used as t ool an d stora ge sheds , playhouses an d similar uses, provided th e floor ar ea does not exceed 120 squar e feet (11.15 m 2).

    (ii)    A fence that  is not more than  6 feet (1829 mm ) high.

    (iii)    Oil derr icks.

    (iv)    A reta ining wall that is not more than 4 feet (1219 mm ) in height  measur ed from th e bott om of th e foot ing to th e top of th e wall, un less support ing a sur char ge or impoun ding class I, II or III -A liquids.

    (v)    A wat er tank support ed directly  upon gra de if th e capacity is not more than 5,000 gallons (18 927 L) an d th e rat io of height to diam eter or width is not great er than  2 to 1.

    (vi)    A sidewalk or drivew ay that is not more than 30 inches (762 mm ) above gra de an d is not over an y basement or story below an d which ar e not part of an a ccessible rout e.

    (vii)    Pa int ing, papering, t iling, car peting, cabinets, count er tops an d similar finish work . (viii) Temporar y motion pictur e, televisi on an d th eat er sta ge sets an d scenery.

    (ix)     Pr efabricat ed swimm ing pools a ccess ory to a group R-3 occu pan cy, as applicable in section 101 .2, which ar e less than 24 inches (610 mm ) deep , do not exceed 5,000 gallons (19 000 L) an d ar e insta lled ent irely above groun d.

    (x)      Sha de cloth stru ctur es con stru cted for nur sery or agricultura l pur poses an d not including service systems.

    (xi)   Swings an d oth er playgroun d equipment a ccess ory to 1- an d 2-fam ily dwellings.

    (xii)    Window awnings support ed by an exterior wall of group R-3, as applicable in section 101 .2, an d group U occu pan cies.

    (xiii)    Movable cases, count ers, an d part it ions.

    (b)   Electr ical perm it s sha ll not be required for an y of th e followin g:

     

    (i)   Rep airs an d ma int enan ce: Minor repair work , including th e replacement of lam ps or th e conn ection of approved porta ble electr ical equipment to approved perman ent ly insta lled recepta cles.

    (ii)    Radio an d televisi on tran smitt ing stat ions: The provisions of th e code do not apply to electr ical equipment used for ra dio an d televisi on tran smissions, but do apply to equipment an d wiring for power supply an d to th e insta llat ion of towers an d ant enna s.

    (iii)      Temporar y testing systems: A perm it is not required for th e insta llat ion of  an y temporar y system required for th e testing or servicing of electr ical equipment or apparatu s.

    (c)   Mechan ical perm it s sha ll not be required for an y of th e followin g:

    (i)   Porta ble gas heat ing applian ce.

    (ii)    Repl acement of an y minor part that does not alter approval of equipment or mak e th e equipment un safe.

    (iii)    Porta ble heat ing applian ce.

    (iv)   Porta ble vent ilat ion equipment .

    (v)   Porta ble cooling un it .

    (vi)    Steam , hot or chilled wat er piping with in an y heat ing or coolin g equipment regulat ed by th e code .

    (vii)    Repl acement of an y part that  does not alter it s approval or mak e it un safe. (viii) Porta ble evaporat ive cooler .

    (ix) Self-conta ined porta ble refrigerat ion un it that is not more than 1.5 horsepower (1119 W).

    (d)   Plum bing perm it s sha ll not be required for an y of th e followin g:

    (i)    The stopping  of  leak s  in  dra ins,  wat er,  soil,  waste,  or  vent  pipe.  However,  if  an y con cealed tra p, dra inpipe, wat er, soil, waste, or vent pipe becom es defective an d it becom es necess ar y to remove an d replace th e dra in or pipe with  new  mat erial, th en  th e work  is con sidered new work an d a perm it sha ll be obta ined an d inspection ma de as provided in th e code.

    (ii)    The clear ing of stoppages or th e repairing of leak s in pipes , valves, or fixtur es, an d th e removal an d reinsta llat ion of wat er closets, if th e repairs do not involve  or require th e replacement or rearran gement of valves, pipes , or fixtur es.

     

    R 408 .30410   Violatio ns .

    Rule 410 .  Section 113 .4 of th e code is am ended to read as follows :

    113 .4. Violat ion pena lt ies. It is un lawful for an y person, firm , or cor porat ion to violat e a provision of th e code or  fail  to con form  with  an y of th e  requirement s  th ereof, or  erect, con stru ct , alter, extend, repair, move, remove, demolish, or occu py an y building, stru ctur e, or equipment regulat ed by th e code , or cau se work to be per form ed or done, in con flict with or in violat ion of th e approved con stru ct ion docum ent s or directive of th e en for cing agency, or  a  perm it  or  cert ificat e issued  un der  th e code  A violat or  sha ll be  assessed  a  fine in a ccor dan ce with section 23 of th e act.

     

    R 408 .30411   Stop -w ork orde r.

    Rule 411 .  Section 114 .2 of th e code is am ended to read as follows :

    114 .2. Notice to owner. Upon notice from th e en for cing agency, work on an y building or stru ctur e that  is being done contrar y to th e code or in a dan gerous or un safe mann er sha ll

     

    imm ediat ely cease. Notice sha ll be in a ccor dan ce with section 12 of th e act. A person who is served with a stop work order, except for work that th e person is directed to per form to remove a violat ion or un safe con dition is subject to th e pena lty provisions prescribed in section 23 of th e act.

     

    R 408 .30412   Ce rtifi cate  of use  and  occupancy  .

    Rule 412 .  Section 110 .1 of th e code is am ended to read as follows :

    110 .1.  Use an d occupan cy. A building or stru ctur e sha ll not be used or occupied, an d a chan ge in th e existing occu pan cy classificat ion of a building or stru ctur e or port ion th ereof sha ll not be ma de unt il a cert ificat e of occu pan cy ha s been issued in a ccor dan ce with section 13 of th e act.

    Rule 415 a.  The definitions of building, registered des ign pr ofessi ona l, an d stru ctur e in section 202 of th e code ar e am ended to read as follows :

    202 .  Definitions.

    Building mean s a com binat ion of mat erials, wheth er porta ble or fixed, form ing a stru ctur e a ffor ding a facility or shelter for  use  or  occu pan cy  by  persons, an ima ls, or  propert y.  The term does  not  include a  building incidenta l to th e use for  agricultura l pur poses  of th e lan d on which th e building is locat ed  if it  is not  used  in  th e business  of reta il tra de.  The term sha ll be con stru ed as th ough followed by th e words or part or part s of th e building an d all equipment  in th e building un less th e cont ext clear ly requires a different  mean ing.

     

    Regis tered des ign pr ofessi ona l mean s an individua l who is licensed un der art icle 20, 1980 PA 299 , MCL 339 .2001 et seq.

     

    Stru ctur e mean s that which is built or con stru cted, an edifice or building of an y kind, or a piece of work art ificially built up or  com posed  of  part s  joined  togeth er  in  some  definite mann er.  Stru ctur e  does   not   include    stru ctur e  incident   to  th e  use   for   agricultura l pur poses of th e lan d on which th e stru ctur e is locat ed an d does not include work s of heavy civil constru ct ion  including with out  limitat ion  an y of th e following:

    (a)   A highway.

    (b)   A bridge.

    (c)  A dam .

    (d)   A rese rvoir

    (e)   A lock.

    (f)  A mine.

    (g)   A har bor.

    (h)   A docks ide port facility.

    (i)   An airport lan ding facility.

    (p)    Sleeping un it mean s a r oom or space in which people sleep, which can also include perman ent provisions for living, eat ing, an d eith er  san itat ion  or  kitchen  facilities, but  not both .  Such r oom s an d spaces that  ar e also part  of a dwelling un it ar e not sleeping un it s.

    (q)    Techn ically infeasible mean s an alterat ion of a building or a facility that ha s litt le likelih ood of being a ccom plished becau se th e existing stru ctura l con ditions require th e removal or alterat ion of a load-bear ing member that is an esse nt ial part of th e stru ctura l fram e, or becau se oth er existing physical or site con stra int s prohibit modificat ion or addition of element s, spaces, or featur es that ar e in full an d str ict com plian ce with th e minimum   requirement  for   new   con stru ct ion   an  which   ar  necess ar  to  provide a ccessibili ty.

    (r)    Wheelcha ir space mean s a space for a single wheelcha ir an d it s occu pant .

    (s)     Wheelcha ir space cluster mean s locat ions of 2 or more adjacent  wheelcha ir  spaces along with  com pan ion seat ing in asse mbly ar eas.

    1103 .1.  Where required.   Buildings  an stru ctur es, temporar y or  perman ent , including th eir ass ociat ed sites an d facilities, sha ll be a ccessible to persons who ha ve physical disabilities in accordan ce with 1966 PA 1, MCL 125 .1351 et seq.

    1103 .2.1. Specific requirement s. Accessibili ty  is  required  in  buildings  an d  facilities  or port ions th ereof, to th e extend defined by sections 1104 to 1109 of th e code .

    1103 .2.13.  Day car e facilities.  Where a day car e facility (Group A-3, E, I-4, an d R-3) is part of a dwelling un it , only th e port ion of th e stru ctur e ut ilize d for th e day car e facility is required to be a ccessible .

    1104 .4.  Multilevel buildings an d facilities.   At least 1 a ccessible  rout e sha ll conn ect each a ccessible  level, including mezzan ines, in mu lt istory buildings an d facilities.

    Exceptions:

    1.  An a ccessible rout e is not required to floor s above an d below a ccessible  level s that  ha ve an aggregat e ar ea of not more than 3,000 squar e feet (278 .7m 2), un less th e level conta ins offices of health car e providers (group B or group I), passe nger tran sportat ion facilities an d airport s (group A-3 or group B) or mu lt iple tenant  facilities of group M.

    2.  In groups A, I, R, an d S occu pan cies, level s that do not conta in a ccessible element s or oth er spaces required in a ccor dan ce with section 1107 of th e code ar e not required to be served by an a ccessible rout e from an a ccessible level.

    1107 .3. Accessible spaces.  Room s an d spaces available to th e genera l public or available for  th e  use  of th e  reside nt s  of a ccessible  un it s,  type  A un it s  or  type  B  un it s  sha ll  be a ccessible . Accessible spaces  sha ll include toilet an d bath ing r oom s, kitchen, living, an d dining ar eas, an d an y exterior spaces, including pat ios, terra ces an d balcon ies.

    1107 .4. Accessible rout e.     Exceptions:

    1.   If th e slope of th e finished groun d level between a ccessible facilities  an d  buildings exceeds 1 un it vert ical in 12 un it s horizonta l (1:12), or where physical barr iers prevent th e insta llat ion of an a ccessible rout e, a vehicular rout e with park ing that com plies with section 1106 of th e code at each public or comm on use facility or building is perm itt ed in place of th e a ccessible rout e.

    2.  Exterior decks, pat ios, or balcon ies that ar e part of type B un it s an d ha ve impervious sur faces, an d that ar e not more than 4 inches (102 mm ) below th e finished floor level of th e adjacent int erior space of th e un it .

    1107 .7.1.1. One story with type B un it s required.  At least 1 story conta ining dwelling un it s or sleeping un it s int ended to be occu pied as a reside nce sha ll be provided with an a ccessible entran ce from th e exterior of th e building. All un it s int ended to be occu pied as a reside nce on that  story sha ll be type B un it s.

    1107 .7.1.2. Additiona l stories with type B un it s. On all oth er stories that ha ve a building entran ce in proximity to arr ival point s int ended to serve un it s on that story, as indicat ed in sections 2.1 an d 2.2 of th e  code ,  all  dwelling  un it s  an d  sleeping  un it s  int ended  to  be occu pied as a reside nce served by that  entran ce on that  story sha ll be type B un it s.

    2.1.   Where th e slopes of th e un distur bed site measur ed between th e plann ed entran ce an d all vehicular or pedes tr ian arr ival point s with in 50 feet of th e plann ed entran ce ar e 10% or less; an d

     

    2.2.   Where th e slopes of th e plann ed finished gra de measur ed between th e entran ce an d a ll vehicular or pedes tr ian arr ival point s with in 50 feet of th e plann ed entran ce ar e 10% or less.

    Where such arr ival point s ar e not with in 50 feet (15,240 mm ) of th e entran ce, th e closes t arr ival point sha ll be used un less that arr ival point serves th e story required by section 1107 .7.1.1 of th e code.

    1107 .7.2. Multistory un it s. A mu lt istory dwelling or sleeping un it that is not provided with elevat or service is not required to be a type B un it . Where a mu lt istory un it is provided with externa l elevat or service to only 1 floor , th e floor provided with elevat or service sha ll be th e primar y entr y to th e un it , sha ll com ply with th e requirement s for a type B un it , an d a toilet facility sha ll be provided on that  floor .

    1107 .7.3. Elevat or  service to th e lowes story with un it s. Where elevat or service in th e building provides an a ccessible rout e only to th e lowes t story conta ining  dwelling  or sleeping un it s int ended to be occu pied as a reside nce, only th e un it s on that story that ar e int ended to be occu pied as a reside nce ar e required to be type B un it s.

    1107 .7.4. Site impra cticality.  On a site with mu lt iple non-elevat or buildings, th e num ber of un it s required by section 1107 .7.1 of th e code to be type B un it s is reduced to a percenta ge that  is equa l to th e percenta ge of th e ent ire site ha ving gra des , befor e development , which ar e less than  10%, when all of th e followin g con ditions ar e met:

    1. Not less than 20% of th e un it s required by section 1107 .7.1 of th e code on th e site ar e type B un it s.

    2.  Un it s required by section 1107 .7.1 of th e code , where th e slope between th e building entran ce serving th e un it s on that story an d a pedes tr ian or vehicular arr ival point is not more than  8.33%, ar e type B un it s.

    3.  Un it s required by section 1107 .7.1 of th e code , where an elevat ed walkway is plann ed between a building entran ce serving th e un it s on that story an d a pedes tr ian or vehicular arr ival point an d th e slope between th em is 10% or less ar e type B un it s.

    4.  Un it s served by an elevat or in a ccor dan ce with section 1107 .7.3 of th e code ar e type B un it s.

    1107 .7.5. Base flood elevat ion. The required num ber of type A an d type B un it s sha ll not apply to a site where th e lowes t floor or th e lowes t stru ctura l building members of non- elevat or buildings ar e required to be at or above th e base flood elevat ion resulting in:

    1.  A differ ence in elevat ion between th e minimum required floor elevat ion at th e primar y entran ces an d vehicular an d pedes tr ian  arr ival  point s  with in  50  feet  (15,240  mm ) exceedi ng 30 inches (762 mm ), an d

    2.  A slope exceedi ng 10% between th e minimum required floor elevat ion at th e primar y entran ces an d vehicular an d pedes tr ian arr ival point s with in 50 feet (15,240 mm ).

    Where no such arr ival point s ar e with in 50 feet (15,240 mm ) of th e primar y entran ces, th e closes t arr ival point sha ll be used.

    1108 .1. Genera l. In addition to th e oth er requirement s of th is cha pter, th e requirement s of sections 1108 .2 to 1108 .2.5 of th e code sha ll apply to specific occu pan cies.

    1108 .2. Asse mbly ar ea seat ing. Asse mbly ar eas that ha ve fixed seat ing sha ll com ply with sections 1108 .2.1 to 1108 .2.4.1 of th e code. Dining ar eas sha ll com ply with sections 1108 .2.5 to 1108 .2.5.2 of th e code.
