    SOAHR #2008-011 NOTICE OF PUBLIC HEARING

    MICHIGAN DEPARTMENT OF AGRICULTURE FAIRS, EXHIBITIONS AND RACING DIVISION

     

    The Michigan Department of Agriculture, Fairs, Exhibitions and Racing Division, will conduct a public hearing on June 19, 2008 beginning at 10:00 AM at Constitution Hall, Van Dusen Conference Room, 6th Floor, North Tower, 525 West Allegan Street, Lansing, Michigan, 48909. The hearing will be held to receive comments on proposed changes to the rules of Regulation No. 811 Premium Allotments to Fairs and Exhibitions and Regulation No. 816 Stabling and Training Facilities for Standardbred Harness Horses. Written comments may be submitted by 5:00 p.m. on June 19, 2008 to the address below.

     

    The proposed amendments to Regulation 811 are being promulgated to address changing the date of determining the age of an exhibitor from December 31 to January 1; to allow for electronic publishing of premium books; and eliminate the requirement to print animal health requirements. The proposed amendments to Regulation 816 are being promulgated to address updating the payment schedule to reflect industry seasonal track obligations; clarify the condition that the track must be maintained because of safety concerns; and give fairs the option to file with the department the names of the horseme             n who are 90 days past due on payment of rental charges for stabling and training and have the department withhold purse payments or breeders’ award payments, until payment is made in full to the fair.

    Promulgation of these rules is pursuant to the authority conferred on the Department of Agriculture by Section 20 of Act 279 of the Public Acts of 1995, as amended, being 431.320 of the Michigan Compiled Laws.
