    Dear Mr. Nederhood:

     

    Portions of the Michigan Administrative Code (MAC) have been repealed through the enactment of the Public Health Code, 1978 PA 368.  The Department of Environmental Quality (DEQ) is writing the Office of Regulatory Reinvention to request that corrections to the MAC be made pursuant to the Administrative Procedures Act, Section 31(2), MCL 24.231 and Section 56(1), MCL 24.256.

     

    The Peacetime Nuclear Incident rules (R 325.5901–R 325.5934) cite Radiation Control, 1972 PA 305, and the State Health Commissioner—State Council of Health, 1919 PA 146, as the promulgation authority.  Both of these acts have been repealed by the Public Health Code.  Nothing in the Public Health Code mandates the promulgation of the Peacetime Nuclear Incident rules. Therefore, the following administrative rules should be repealed:

     

    §    R 325.5901–R 325.5934

     

    There are extensive federal regulations for the management of emergencies at nuclear power plants. In Michigan, the State Police Emergency Management and Homeland Security Division has the responsibility to coordinate the state response for nuclear power plant emergencies in Michigan.
