Sec. 57. (1) The office of regulatory reform may omit from the Michigan regis ter, the Michigan Ad ministrativ e Code, and the Michigan Ad ministrativ e Code's annu al supplement any rule, the publication of which would be unreasonably expensive or lengthy if the rule in printed or reprodu ced form is made availabl e on appli cation to the promulgati ng agency, if the Michigan Ad ministrativ e Code publication and the Michigan regis ter contai n a notice stati ng the general subject of the omitted rule and how a copy of the rule may be obtai ned.
Pursuant to MCL 24.257(1), Offi ce of Regulatory Reform has decided to omit from the Michigan Register the En vironmental Response Divisi on Proposed Ad ministrativ e Rules promulgated by the Michigan Depart ment of En vironmental Quality und er the identifyi ng nu mber #1995 -020 . ORR has determined that publication of the rule would be unreasonably expensive or lengthy.
In # 1995 -020 , the Michigan Depart ment of En vironmental Quality proposes a revision of a series of administrativ e rules promulgated pursuant to Part 201 , En vironmental Remediati on, of the Natural Resources and En vironmental Protection Act, 1994 PA 451 , as amended (Act 451); R 299 .5101 et seq. These rules bri ng the Part 201 rules up to date with stat utory amend ments enacted in 1995 and 1996 . The rules provide for full implementation of the land use-bas ed cleanu p criteria, set forth algorit hms for calculati on of generic cleanu p criteria, explai n requirements for remedial action plans and other stages of response activity , clarify which types of response activity require DEQ approval, clarify affir mative obligati ons of liabl e persons, and update rules that deal with program administrati on, such as the inventory of con ta minated sites, public fund ing for the cleanu p program, and alternate water servi ce.
