7 NOTICE OF PUBLIC HEARING

ORR # 2003-013 and ORR # 2003-014 DEPARTMENT OF COMMUNITY HEALTH BOARD OF MEDICINE GENERAL RULES

BOARD OF OSTEOPATHIC MEDICINE AND SURGERY GENERAL RULES

The Department of Community Health will hold a public hearing on Friday, July 30, 2004 from 9 a.m. to 10 a.m. at the Department of Community Health, Ottawa Building, 611 West Ottawa, Conference Room One, Upper Level, Lansing, Michigan.

The public hearing is being held to receive comments from interested persons on amendments to the Michigan Board of Medicine and the Board of Osteopathic Medicine and Surgery Administrative Rules. The administrative rules for these boards prohibit the prescribing or administering of Schedule 2 sympathomimetic amine drugs, except dextroamphetamine when used in treating a hyperkinetic child and in the treatment of narcolepsy. In recognition of innovative medical practices, however, the rules permit allopathic or osteopathic physicians to apply for a written waiver to the rules’ requirements. Consequently, an allopathic or osteopathic physician must apply for a waiver to prescribe amphetamine and its salts when treating adults with Attention Deficit/Hyperactivity Disorder (ADHD). The rules are being revised to permit allopathic and osteopathic physicians to prescribe amphetamine and its salts when treating adults with ADHD and to establish requirements that physicians must meet before prescribing this drug.

These rules are being promulgated under the authority of sections 17001 and 17501 of 1978 PA 368, MCL 333.17001 et seq. and MCL 333.17501 et seq. and Executive Reorganization Order Nos. 1996-1, 1996-2 and 2003-018 MCL 330.3101, 445.2001 and 445.2011.

Hearing comments may be presented in person, with written comments available at the time of presentation. Written comments will be accepted at the following address or E-mail address until Friday, August 6, 2004 at 5:00 p.m. Address communications to:
