    SUB JECT:  Req ues t for Corr ection of R 408 .40625 in th e Michigan Administrat ive Code.

     

    Pur suant to Administrat ive Pr oced ur es Act, Section 56(1), MCL 28.256 , th e  Bur eau  of Safety an d Regulat ion reques ts that th e Office of Regulatory Reform corr ect an  obvious error in th e Michigan  Administrat ive  Code.  The  error  is  conta ined  in  R  408 .40625 Cert ificat ion an d use of foot protection, a ru le appe ar ing in Constru ction Safety Stan dar d Part  6. Persona l Protective Equipment.  The corr ected ru le should read as follows:

     

    R 408 .40625  Cert ificat ion an d use of foot protection.

     

    Rule 625 . (1) Safety toe footwe ar sha ll  bear  a  perman ent  mark  to  show  th e manu factur ers nam e or tra demark an d to show cert ificat ion  of  com pliance  with ANSI stan dar d Z.41-1991 protective foot wear persona l protection, which is adopted in th ese ru les by reference  an d  ma y  be  inspected  at  th e  Lan sing  office  of  th e dep artm ent of con sum er an d industr y services. The stan dar d ma y be purcha sed at a cos t of $20 .00 as of th e time of adoption of th ese ru les from th e American Nat iona l Stan dar ds Institut e, 1430 Broadway, New York , New York 10018 , or from th e Michigan Dep artm ent of Consum er an d Industr y Services, 7150 Harr is Drive, Box 30643 , Lan sing, Michigan 48909 .

    (2)    An employee sha ll wear foot protection or toe protection, or both, if con ditions of th e job ar e likely to cau se a foot injur y. The employee sha ll provide th e foot protection or toe protection un less specifically oth erwise provided for in a collective bar gaining agreement or oth er employer-employee agreement .

    (3)   Where toe protection oth er than safety toe footwe ar prescribe d in subru le (1) of th is ru le is worn, th e toe protection sha ll ha ve an impact value of not less than that required for th e safety toe footwe ar .

     

     

    (4)    Where a ha zar d is creat ed from a pr ocess , a chemical or mechan ical irr itant which cou ld cau se an injur y or impairm ent to th e feet by absorption or from physical conta ct oth er than from impact, foot wear such as boot s, overshoes, ru bbers, woode n- soled shoes, or th eir equivalent sha ll be worn  by th e employee an d provided for by th e employer.

    (5)    The foot protection sha ll be ma inta ined with out holes  due to wear , r ips, or tear s which reduce th e int ended protection.

     

    R 408 .40625 was promu lgat ed as part  of  # 1998 -098CI , a ru le set that  becam e effect ive on J uly 23, 1999 . R 408 .40625 perta ins to th e “cert ificat ion an d use of foot protection. It was th e int ent ion of th e Bur eau of  Safety  an d  Regulat ion  to  am end  subse ct ion  (1),  th e “cert ificat ion port ion of th e R 408 .40625 . It was also th e int ent ion of th e  Bur eau  to eliminat e subse ct ion (2) an d renum ber th e rema ining subse ct ions, th e use port ions of R 408 .40625 .

     

    In prepar ing #1998 -098CI , th e Bur eau ina dvert ent ly submitt ed text to th e Office of th e Great Seal that conta ined th e int ended am endment s to subsections (1) an d (2), but ma de no reference to th e renum bering of th e rema ining subse ct ions.1      As result, th e am ended  R

    408 .40625 , as it prese nt ly  appe ar s  in  th e  Michigan  Administrat ive  Code,  gives  th e appe aran ce that th e ru le addresses th e cert ificat ion of foot protection, but not it s use. We believe that th is err or is obvious in that it would be pur poseless for th e agency to cert ify a stan dar d for protective foot protection but not specify con ditions un der which such foot protection should be used. The obviousness of th is err or is un derscor ed when it is com par ed with th e deta iled stat ement s of cert ificat ion an d use that ar e provided for oth er types of protective gear des cribed thr oughout th e surr oun ding ru les.

     

    The requested corr ection would mak e clear that th e use provisions of R 408 .40625 were not rescinded by th e 1999 am endment .
