    R 340 .1734     Deviations   from rules .

    Rule 34. (1) A deviat ion from th ese ru les sha ll FOLLOW BOARD-APP ROVED PROCEDURES AND be requested in  writing  from  th e  stat e  boar d  of  educat ion  or  it s des ignee by an int erm ediat e SCHOOL DISTRICT , or loca l sch ool distr ict , OR PU BLIC SCHOOL ACADEMY that operat es or contra cts for special educat ion program s an d services. A copy of th e request sha ll be filed con curr ent ly with th e int erm ediat e sch ool distr ict  in  which  a ffect ed  pe r s on s  STUD EN TS  with  disabilities  reside   an  all  loca l con stitu ent sch ool distr icts in which th e a ffect ed pe r s on s STUD EN TS with  disabilities reside . A copy of th e request sha ll be filed con curr ent ly with th e par ent advisory comm itt ee of th e int erm ediat e sch ool distr ict that requests th e deviat ion  an d  th e  par ent  advisory comm itt ee of an y int erm ediat e sch ool distr ict in which a ffect ed pe r s on s STUD EN TS with disabilities reside .

    (2)               With in 7 days of receipt of th e request, th e int erm ediat e sch ool distr ict sha ll review an d inquire int o th e request an d sha ll file, with th e dep artm ent , it s position regar ding th e appropriat eness of th e request an d it s objections to, or endorsement of, th e request, togeth er with th e rat iona le regar ding it s position.

    (3)               The stat e boar d of educat ion or it s des ignee sha ll initiat e action with in 30 calendar days of receipt of th e request. The boar d or des ignee ma y grant th e request in writing for a period not to extend beyond th e end of th e curr ent sch ool year an d upon such term s an d con ditions as it sha ll specify only when, in it s judgment , th e bes t int erests of th ose THE pe r s on s STUD EN TS with disabilities a ffect ed by th e deviat ion ar e served an d good cau se is shown.

    (4)               A deviat ion sha ll not be  grant ed  when  th e int ent  of th e deviat ion  is to exclude  a pe r s on STUD EN T with a disability from, or deny a pe r s on  STUD EN T with  a  disability part icipat ion in, a special educat ion program or service that  is required.

    (5)               A program deviat ion that is grant ed by th e stat e boar d of educat ion or it s des ignee is public in format ion. The a ffect ed int erm ediat e sch ool distr icts, an d loca l constitu ent LOCAL SCHOOL distr icts, OR PU BLIC SCHOOL ACADEMIES sha ll inform th eir involved personn el of grant ed deviat ions in an y mann er th ey deem appropriat e. At a minimum , th e par ent advisory comm itt ee sha ll be in form ed of th e disposition of th e request.

    (6)               A deviat ion sha ll not be requested  for  th e  pur pose  of  avoiding  or  postponing corr ections directed by th e dep artm ent p ur s uant t o UN DER part 8 of th ese ru les.

    (7)               If a fina l decision to deny a deviat ion request is ma de, THEN th e sch ool distr ict that mak es  th e  request  sha ll  corr ect  th e  con dition  that   precipitat ed  th e  request  an d  sha ll

     

     

    for war d, to th e dep artm ent , office of  spe cial educat ion AND EARLY  INT ERVEN TIO N SERVICES, with in 30 sch ool days of th e denial, it s assuran ce that th e matt er is now in com plian ce with th e respe ctive ru le.

    (8)               Noth ing in th is ru le or an y oth er provision of statut e or regulat ion sha ll perm it th e stat e boar d of educat ion to waive an y of th e requirement s of Part B of th e individua ls with disabilities educat ion act of 1990 , AS AMEN DED, 20 U.S.C. §1400 et seq.
