PART 1.  GENER AL PROVISIONS

 

R 285 .1101    De finitio ns.

Rule 101 .  As used in th ese ru les:

(a)  "Agricultura l exhibi tor" mean s a person who ent ers an  exhibi t in th e agricultura l an d live stock dep artm ent s of th e fair.

(b) "Boar d" mean s th e uppe r peninsula stat e fair boar d of mana gers.

(c) "Commission" mean s th e comm ission of agricultur e.

(d)  "Commun ity  art s  or  youth  exhibi tor"  mean s  a  person  who  ent ers  an  exhibi t  in  th e commun ity art s or youth dep artm ent s of th e fair.

(e)  "Concessi ona ire or exhibi tor lice n se PE RMIT " mean s a license agreement to operat e a stan d or exhibi t, th e ma in pur pose of which is to exhibi t comm ercial products, to solicit prospective buyers, or to mak e direct sales at th e fair.

"Concessi on  stan d"  mean s  a  stan d  w h ic h  THAT  sells  an d  imm edi at ely  delive rs  food, beve ra ges, specialty items, balloons, art work, novelties, or oth er like items to fair patr ons. "Dep artm ent" mean s th e dep artm ent of agricultur e.

(h) "Director" mean s th e director of agricultur e.

(i)   "Educat iona l  exhibi tor"  mean s  an  ed ucat iona l,  char ita ble,  or  nonprofit  cor porat ion exhibi tor grant ed a lice n se PE RMIT by th e fair.

 

 

(j)  "Exhibit" mean s an  art icle, item, livest ock, or poultr y ent ered for public display at  th e fair.

(k)  "Exhibitor" mean s  a  holder  of an  exhibit   lice n se  PE RMIT ,  his  OR  HE R  agent ,  or des ignat ed represe ntat ive.

(l) "Fa ir" mean s th e uppe r peninsula stat e fair sta ged in Escana ba, Michigan .

(m) "F ood con cessi on" mean s a place or stan d w h ich THAT sells or serves food or bevera ges. or b oth , an d in clu des a r es taurant  an d gra bs tan d .

(n)  "Gam es of sk ill" mean s a single locat ion at th e fair that conta ins 1 or more un it s of play of a gam e of sk ill.  T h e num be r of un it s of p la y is of n o im p ortan ce a s lon g a s a ll un it s of p la y ar e in th e s am e locat ion an d ar e n ot sep arat ed fr om e a ch oth e r by w a ll, can va s , or oth e r p art it ion .

(o)               "Mana ger" mean s th e duly appoint ed stat e civil service mana ger of th e fair.

(p)               "Non -fa ir lice n se PE RMIT " mean s a lice n se a gr ee m e nt PE RMIT , oth er than  a lease, for use of an y part of th e buildings or fairgroun ds when th e fair is not in operat ion.

(q)               "Pr emium   book"   mean s     th e    publicat ion    WHICH   r elat in g    RELATES   to   th e administrat ion of th e annua l fair event , AND WHICH IS prepar ed by th e mana ger.

(t ) "Res taurant " m e an s a p la ce se r vin g p lat e lun ch es , d inn e r s , or an y oth e r m e a l con s is t in g of 2 or m or e foods .

(r)                 "LIVESTOCK " MEANS THOSE SPE CIES OF ANI MALS USE D FOR HU MAN FOOD AND FIBER OR THOSE SPE CIES  OF  ANI MALS  USE D  FOR  SERVICE  TO HU MANS. LIVESTOCK INCLUD ES, BUT IS NOT LIMIT ED TO ANY OF THE FOLLOWI NG:

(t)           )    "SABOTAGE"    MEANS     THE     INT ERFE REN CE     WITH     ANY     LIVESTOCK BELONGING  TO   OR   OWNE D   BY   ANOTHE R   PE RSO N   WHICH    HAS BEEN REGIST ERED WITH, EN TERED IN , OR EXHIBIT ED AT, THE UPPE R  PEN INSUL A STATE FAIR, OR WHICH WAS RAIS ED WITH THE INT EN T OF BEING  EN TERED IN AN EXHIBITION .

 

R 285 .1102 Scope ; bus iness tra nsac tio ns ; prem ium book ru les ; rates and fees ; concession   ri ghts .

Rule 102 .  (1)  R 285 .1101 applies to th e operat ion of th e fairgroun ds dur ing th e fair an d at oth er t imes.

(2)    Business tran sactions of th e fair sha ll be con ducted a ccor ding to esta blished pra ct ices an d pr oced ur es  of th e stat e of Michigan .  s u b je ct  t o s u ch  spe cia l p r oced ur es  a s  ma y be es ta blis h ed by r es olut ion of th e comm iss ion .

(3)    All ru les as print ed in th e annua l premium book sha ll be binding upon all persons or event s where applicable. The mana ger, as delegat ed by th e director, rese rves th e right to int erpret all of th e ru les in th e premium book.

(4)    The mana ger an d th e  fair  boar d  sha ll recomm end  admission  char ges, license  renta l rat es an d fees , an d th e comm iss ion DIR ECTOR OR HIS OR HE R DESIGN EE sha ll approve or adjust th e recomm ended rat es.

(5) ) T h e comm iss ion r e ta in s a ll con cessi on r ight s un le ss spe cifica lly grant ed t o a lice n see . I f th e lice n see is grant ed con cessi on r ight s , th e lice n see s ha ll s u pe r vise h is ow n con cessi on s or th e contra ct s for s u ch con cessi on s .

(6) ) T h e p ark in g p r ivilege s ha ll r e ma in th e exclu s ive d oma in of th e comm iss ion .

Rule 103 . (1) The comm iss ion DIR ECTOR , after consultat ion with th e Upp er Peninsula stat e fair boar d, rese rves th e right to int erpret th ese ru les an d to sett le an d determ ine questions an d disput es in regar d th ereto or oth erwise ar ising out of, conn ected with , or incident to, th e operat ion of business .

The provisions print ed in th e premium book , th e con cessi ona ire lice n se PE RMIT , exhibitor lice n se PE RMIT ; an d non-fair lice n se PE RMIT  sha ll  be  followed  in  th e  operat ion  an d con duct of business dur ing an d after th e fair or event .

 

R 285 .1104   Inspec tio n of prem is es .

Rule 104 . The fa ir mana gement an d auth orized agent s for governm enta l agencies, at an y t ime, ma y ent er upon an d inspect an y port ion of th e licensed premises to en for ce provisions of a lice n se PE RMIT , applicable statut es, ordinan ces, an d ru les. IN SIGNING THE CONCESSION AIRE AGREE MEN T, VEN DORS CONSEN T TO ALLOW FAIR MANAGEMEN T AND AUTHORI ZED AGEN TS FOR  GOVERNMEN TAL  AGEN CIES, AT ANY TIM E, TO EN TER UP ON AND INS PE CT ANY PORTIO N OF THE PREMIS ES TO ENF ORC E COM PLIANCE WITH APP LIC ABLE STATUTES, ORDI NANCES AND RULES.

Rule 106 . The uppe r peninsula stat e fair mana gement rese rves th e right to mak e substitut ions at an y t ime in program s an d ent erta inm ent with out refun ding admission fees .

R 285 .1201   Reg istratio n of bus inesses  w it h state ; hiri ng of mino rs.

R 285 .1202   Adve rti sing ; vio lation .

Rule 202 . (1) A lice n see PE RMIT HOLDER, patr on, or oth er person sha ll not place an y advert ising matt er on a building, tr ee, or an y oth er place on th e groun ds or distr ibut e advert ising matt er or  lit eratur e  out side  th e  place  assigned  by  th e  term s  of th e  lice n se PE RMIT .

(2) A person WHO IS foun d in violat ion of TO HAVE VIOLATED th is ru le by th e mana ger s ha ll be IS subject to expulsion from th e fairgroun ds an d for feitur e of his OR HE R contra ct an d fees with out recour se.

 

R 285 .1203   In toxicati ng beve rages .

Rule 203 . Liq u or or oth e r int oxicat in g ALCOHOLIC beve ra ges sha ll  n ot be perm itt ed on th e fa irgroun ds. THE FAIR MAY GRANT A PE RMIT TO SELL ALCOHOL DURING EVEN TS IF THE CONCESSION AIRE HAS THE APP ROPRIATE LIC EN SES AND IF APP ROVED BY THE BOARD AND THE DEP ARTMEN T DIR ECTOR .

 

R 285 .1204   Dogs .

Rule 204 . Owners sha ll register th eir dogs with th e mana ger an d com ply with all term s of th e registrat ion form . If an owner fails to register a dog, th e owner sha ll be ordered to remove  th e  dog  from  th e  fairgroun ds.  A  dog  sha ll  be  un der  leash  by  owner   or represe ntat ive at all t imes on th e fairgroun ds.

 

P ART 3. CONCESS IONAIRE , EXHIBITOR, AND NON-FAIR LIC ENSEES                                                                                       P ER MITS

 

 

 

R 285 .1301   Concessionai  re ,    exh ibitor ,    and     non -fai r     li censes     P ER MITS; app li cation  and  iss uance  procedu re ; space  ren tal ; revoca tio n .

Rule   301 .       (1)   The   pr oced ur e   des cribed  in    th is    ru le    govern s    th e    issuan ce    of con cessi ona ire, exhibitor, an d non -fa ir lice n ses PE RMITS .

(2)    A person OR ORGANIZATIO N seek ing concessi on or exhibit space TO DISTRIB UTE, EXHIBIT , OR SELL ANY MATERIALS OR ITEMS ON THE FAIRGROUNDS  s ha ll w r it e t o th e mana ge r r eq u es t in g a sp a ce a pp licat ion form , s tat in g art icle s t o be s old or d isp la ye d , ele ctr ica l r eq u ir e m e nt s , an d sp a ce r eq u ir ed SHALL COM PLETE AN APP LIC ATIO N FOR A PE RMIT . THE APP LIC ANT SHALL COM PLETELY AND CORR ECTLY FILL OUT AND SIGN THE APP LIC ATIO N.

(3) ) A pe r s on or or gan izat ion des ir in g t o d is tr ib ut e , exh ibi t , or se ll p r int ed mat e r ia l or it e m s on th e fa ir gr oun ds s ha ll a pp ly t o th e mana ge r for a lice n se .   An a pp licat ion for a lice n se s ha ll be com p le t ely an d corr e ct ly fille d out an d s ign ed .  An om iss ion or m is r ep r ese ntat ion is s u fficie nt cau se for r e fu s a l or r evocat ion of th e lice n se by th e mana ge r .   I f th e mana ge r q u es t ion s th e leg a lit y or fe a s ibili t y of th e r eq u es t , th e a pp licant ma y r eq u es t a r eview by th e d ir e ct or . A lice n se , if give n  fina l  a pp r ova l,  s ha ll  be  s ign ed  an d  exe cut ed  by  th e mana ge r .

(3) Concessi ona ires an d exhibitors with THAT H AVE esta blished sat isfactory per forman ce recor ds at th e fair, as determ ined by th e mana ger, ma y be grant ed lice n ses PE RMITS upon request befor e lice n ses PE RMITS ar e issued to new con cessi ona ires an d exhibitors. The mana ger sha ll determ ine th e eligibili ty an d des ira bility BASED ON VEN DOR MIX AND FAMIL Y EN TERTAINM EN T VALUE of a ll lice n se PE RMIT  requests, subject to review by th e director.

(4)    All THE MANAGER SHALL NOTI FY BOTH  FAIR  AND NON-FAIR  concessi ona ir e an d exhibitor lice n se PE RMIT applicant s s ha ll be n ot ifie d in writing of approval or disapproval.  If th e lice n se PE RMIT requires th e signatur es of cor porat e officer s, oth er than th e individua ls supervising th e exhibit, s u ch THEN THE tran saction ma y be carr ied out by ma il. At th e t ime of signing of th e lice n se PE RMIT , th e  exhibitor  sha ll  agree  on  th e locat ion of h is THE exhibit space AND SHALL PAY REN TALS FEE S AS APP ROVED BY THE DIR ECTOR THAT ARE STATED ON THE APP LIC ATIO N FOR PE RMIT OR ARE PU BLIS HE D BY THE DEP ARTM EN T.

(6) ) At th e t im e of th e s ign in g of th e con cessi on or exh ibi t lice n se , th e con cessi ona ir e or exh ibi t or s ha ll p a y 50 % of th e sp a ce r e nta l, an d h e s ha ll p a y th e r e ma in in g 50 % be for e th e close of th e se con d d a y of th e fa ir . (7) ) At th e t im e of s ign in g th e n on -fa ir lice n se , th e n on -fa ir lice n see s ha ll p a y 50 %, t o a ma ximum of $100 .00 , of th e sp a ce r e nta l, an d h e s ha ll p a y th e r e ma in in g am ount of th e lice n se fee 1 d a y p r ior t o th e fir s t d a y of r e nta l un de r th e lice n se .   Pa ym e nt s s ha ll be in ca s h , or by m on ey or de r , ce rt ifie d ch eck , or ca s h ie r 's ch eck .

(5) A con cessi ona ire, exhibitor, an d non -fa ir lice n see PE RMIT HOLDER sha ll abide  by th e p r ovis ion s of th e a pp r op r iat e lice n se form s an d by th e ru les AND PROCEDURES of th e . fa ir s d ivi s ion DEP ARTM EN T.  A  lice n se  PE RMIT  ma y  be  revoked  by  th e  lice n s or DEP ARTMEN T, an d no claim for dama ges sha ll accru e to a lice n see PE RMIT HOLDER, if

 

 

a lice n see PE RMIT HOLDER defau lt s in th e s tr ict per forman ce of an y provision, term , or con dition of th e lice n se PE RMIT OR RULES OF THE DEP ARTM EN T.

R 285 .1302   Re jec tio n or conditiona  l acceptance   of app li cation .

Rule 302 . The mana ger ma y  reject,  or  a ccep t  con d it iona lly  CONDITIO NALLY ACCEP T, an applicat ion for a lice n se PE RMIT  BASED ON VEN DOR MIX AND IN THE BE ST INT E RE ST OF THE FAIR.

 

R 285 .1303   Space  a llocation .

Rule 303 . The a llocat ion, num ber, an d locat ion of con cessi ona ire, exhibitor, an d non -fa ir lice n see PE RMIT HOLDER spaces sha ll be determ ined by  th e  mana ger  BASED  ON VEN DOR MIX AND IN THE BEST INT EREST OF THE FAIR.

 

R 285 .1304   Cance llation  of space  allotm en t and  li cense .

(2)     A con cessi ona ire or exhibitor ma y can cel th e space a llott ed t o h im for th e fair by advising th e mana ger in writing on or before J uly 1. of th e ye ar in w h ich h e ha s a lice n se , or for feit th e 50 % p a ym e nt with out r ecour se .

(3)    The  mana ger  ma y   refun d   80%   of   th e   payment   received   fr om   fa ir   lice n sed con cessi ona ir es or exh ibi t or s if a  lice n se PE RMIT  is properly can celed  p r ior  t o BEF ORE J uly 1 of th e year th e lice n se PE RMIT is issued.

(4) The mana ger ma y refun d UP TO 80% of th e payment received from A non-fair lice n sees PE RMIT HOLDER if a lice n se PE RMIT is properly can celed by th e mana ger not less than 14 30 days p r ior t o BEF ORE th e start of th e event . Re fun ds ar e n ot p a ya ble if a n on -fa ir lice n se is can celed with in 13 d a ys of th e s tart of th e eve nt or d ur in g th e eve nt . THE MANAGER MAY DEDUCT  THE  COSTS  OF  ANY  EXPEN SES  INCURR ED  BY  THE F AIR.

 

R 285 .1305   Re location  of concession   or exh ibit .

Rule 305 . The mana ger rese rves th e right to require a concessi ona ire or exhibitor to locat e at , or  move his con cessi on  or  exhibit  to, some oth er  site if th e mana ger  dee m s  it a d vis a ble or for DETERMI NES A PU BLIC SAFE TY NEE D OR IT IS th e bes t int erest of th e fair. If th e mana ger cann ot find a suita ble alternat e site, th e con cessi ona ire  or exhibitor is ent it led to a pro rata  refun d of space rent paid.

 

R 285 .1306   Access  to fai rgrounds  be fore opening   day .

Rule 306 . A con cessi ona ire or exhibitor sha ll be grant ed a ccess to th e fairgroun ds an d exhibit buildings fr om 8:30 a .m . t o 5 p .m . d a ily, in clu d in g S atur d a y an d S un d a y, for 5 d a ys AS DEF IN ED BY PE RMIT before th e opening day of th e fa ir for th e pur pose of prepar ing

R 285 .1307   Const ruc tio n of exh ibits ; st ruc tu ral changes .

Rule 307 . (1) An exhibit in a building sha ll be con stru cted so it does not obstru ct th e public's view of an adjacent exhibit.

(2)    A con cessi ona ire's or exhibitor's displays an d advert ising w h ich THAT form th e back wall of his OR HE R con cessi on or exhibit sha ll not exceed BE MORE THAN 8  feet  in height , excep t if UN LESS he OR SHE ha s obta ined  writt en  perm ission  from  th e  fair mana gement .

(3)    A con cessi ona ire, exhibitor, or non -fa ir lice n see PE RMIT HOLDER sha ll not  mark , paint , drill, dig, or in an y  mann er  deface  th e  lice n sed  premises,  except  by  writt en perm ission of th e mana ger, an d at th e expirat ion of th e  lice n se PE RMIT , sha ll surr ender th e lice n sed premises in as good A con dition as when first occu pied.

(4)   A lice n see PE RMIT HOLDER sha ll discuss with , an d secur e writt en approval of, th e fair mana gement befor e electr ical wiring, decorat ions, part it ions, or oth er  stru ctura l chan ges ar e ma de in th e rent ed buildings or on th e groun ds.

 

R 285 .1308   Signs  and  adve rti sing ; concession   pe rm its .

Rule 308 . (1) A con cessi ona ire or exhibitor sha ll not place a sign or advert isement , which han gs over an a isle, in a building.

(2)   A con cessi ona ire, exhibitor, or non -fa ir lice n see PE RMIT HOLDER sha ll post on his OR HE R lice n sed premises only s u ch THE signs a s th e mana ge r pe rm it s THAT  PROVIDE S IN FORMATIO N ABOUT THE PRODUCT OR SERVICES OUTLI NE D  UN DER  THE APP LIC ATIO N AND/OR PE RMIT .

(3)   A con cessi on perm it issued by th e mana ger sha ll be posted in a con spicuous locat ion on th e con cessi on stan d befor e th e con cessi ona ire ma y start  to operat e.

 

R 285 .1309   Set  up and  e lec trical  hookup  autho riz ations .

Rule 309 .  An auth orizat ion for set up an d electr ical h ookups sha ll be grant ed only after a con cessi ona ire, exhibitor, or non -fa ir lice n see PE RMIT HOLDER applies in person at th e mana ger's office, an d prese nt s a copy of his or HE R lice n se PE RMIT or receipts which denote com plian ce with payment requirement s.
