    R 336 .1210   Rene w ab le ope rating  pe rmits .

    Rule 210 . (1) A person sha ll not operat e an y emission un its locat ed at  a  stat ionar y source required to obta in a renewable  operat ing  perm it  un der  R  336 .1211 ,  excep t  in com pliance with all applicable term s an d con ditions of a renewable operat ing perm it, un less a timely an d administrat ively com plete applicat ion for a renewable operat ing perm it ha s bee n received by th e dep artm ent in accor dance with th e followi ng provisions of th is ru le. The ability to operat e th e emission un its at a stat ionar y source while a timely an d administrat ively com plete applicat ion is being reviewed an d acted upon by th e dep artm ent sha ll be referr ed to  as th e "applicat ion shield." The applicat ion shield  provided  by  th is subru le sha ll not apply if an applicat ion submitta l is not timely un der th e applicable provision of subru les (4) to (7) of th is ru le or administrat ively com plete un der subru le (2) of th is ru le or an additiona l informat ion submitta l is not timely or com plete un der subru le (3) of th is ru le. The loss of th e applicat ion shield after th e applicable time specified in th is ru le for a person to ha ve filed a timely an d administrat ively com plete applicat ion for a renewable operat ing perm it is groun ds for enforcement action un der th e act. Any enforcement action pur suant to loss of th e applicat ion shield sha ll con sider th e time period betwee n th e applicable deadline an d when a person actua lly submits  th e  required administrat ively com plete applicat ion or additiona l informat ion.

    (2)   An applicat ion submitta l, including an applicat ion submitta l for renewal or modificat ion of a renewable  operat ing  perm it,  sha ll  be  con sidered  an  administrat ively  com plete applicat ion if it conta ins reasona ble responses to all reques ts for informat ion in th e perm it applicat ion form  required  by  th e dep artm ent  an d  a cert ificat ion  by  a  responsible official

     

     

    which stat es that , based on in format ion an d  belie f form ed  after  reasona ble  inquiry, th e stat ement s an d in format ion in th e applicat ion ar e tru e, a ccurat e, an d com plete.  The applicat ion form required by th e dep artm ent sha ll be con sistent with th e requirement s of section 5507 of th e act, except as provided for genera l renewable operat ing perm it s un der R 336 .1218 . The applicat ion form sha ll also require a cert ificat ion of com plian ce with all applicable requirement s, a stat ement of meth ods used for  determ ining  com plian ce, including a des cription of monitoring, recor dkeep ing an d report ing requirement s, an d test meth ods, an d a stat ement indicat ing th e stat ionar y sour ce's com plian ce statu s with an y applicable enhan ced monitoring an d com plian ce cert ificat ion requirement s of th e clean air act. All of th e followin g provisions apply to th e  administrat ive  com pleteness  of  an applicat ion for a renewable operat ing perm it :

    (a)    On an d after November 1, 1995 , th e dep artm ent sha ll notify th e person who submitt ed th e applicat ion for a renewable operat ing perm it an d th e resp onsible officia l, in writing, regar ding th e administrat ive com pleteness of th e applicat ion submitta l. If th e applicat ion submitta l  is  con sidered  not  to  be  an   administrat ively   com plete   applicat ion   by   th e dep artm ent , th en th e  notificat ion  sha ll  specify  th e  deficiency  an d  all  supplementa l mat erials required for an administrat ively com plete applicat ion. A person's resp onse to a notificat ion by th e dep artm ent of th e in com pleteness  of an  applicat ion sha ll include all of th e  supplementa l  mat erials  requested  by  th e  dep artm ent  in  th e  notificat ion  an d  a cert ificat ion by th e resp onsible officia l which stat es that , based on in format ion an d belie f form ed after reasona ble inquiry, th e stat ement s an d in format ion in th e resp onse ar e tru e, a ccurat e, an d com plete.  All of th e followin g provisions apply to dep artm ent notificat ion:

    (i)    If th e dep artm ent fa ils to notify a person that an applicat ion submitta l, including th e submitta l of an y supplementa l mat erials requested  by  th e  dep artm ent  un der  th is subdivisi on, is not administrat ively com plete by th e followin g deadlines, th en th e submitta l sha ll be con sidered an administrat ively com plete applicat ion as of th e dat e th e dep artm ent received th e submitta l or th e supplementa l mat erials, whichever is lat er:

    (A)     By J anuar y 5, 1996 , or with in 60 days of th e dat e th e dep artm ent receives th e submitta l, whichever is lat er, if th e submitta l is received on th e paper form s specified by th e departm ent .

    (B)    By November 15, 1995 , or with in 15 days of th e dat e th e dep artm ent receives th e submitta l, whichever is lat er, if th e submitta l is received in an electr onic format specified by th e dep artm ent .

    (ii)   If a person submits all of th e supplementa l mat erials ident ified in a notificat ion from th e dep artm ent un der th is subru le, th en th e applicat ion sha ll be con sidered administrat ively com plete.

    (iii)      Except as provided in para gra ph (i) of th is subdivisi on, th e dat e th e dep artm ent receives all in format ion required for an administrat ively com plete applicat ion, including a ll supplementa l mat erials requested by th e dep artm ent un der th is subdivisi on, sha ll be th e dat e of receipt of th e administrat ively com plete applicat ion.

    (b)     ) Any  person  who  fa ils  to  submit  an y  relevant  facts  or  who  ha s  submitt ed  in corr ect in format ion in an applicat ion for a renewable operat ing perm it , including an applicat ion for renewal or modificat ion of a renewable operat ing perm it , sha ll, upon becom ing awar e of th e failur e  or  in corr ect  submitta l,  promptly  submit  all  supplementar y  facts  or corr ected in format ion. Ea ch submitta l of an y relevant facts or corr ected in format ion sha ll include a

     

     

    cert ificat ion by a resp onsible officia l which stat es that , based  on  in format ion  an d  belie f form ed after reasona ble inquiry, th e stat ement s an d in format ion in th e submitta l ar e tru e, a ccurat e, an d com plete.

    (c)       A person sha ll promptly provide an y additiona l in format ion necess ar y for  an administrat ively  com plete  applicat ion  for  an y  applicable  requirement s  to  which   th e stat ionar y sour ce becom es subject after th e dat e that  th e  person  submitt ed  th e administrat ively com plete applicat ion, but befor e release of a dra ft renewable operat ing perm it for public part icipat ion un der  R 336 .1214 (3).  For  administrat ively  com plete applicat ions submitt ed un der subru le (4)(e) or (f) of th is ru le, th e in format ion required by th is  subru le  ma y  be  ma inta ined  by  th e  person  an d  submitt ed  to  th e  dep artm ent  in a ccor dan ce with th e followin g schedule, un less  th e dep artm ent  specifically requests that in format ion by an ear lier dat e un der subru le (3) of th is ru le:

    (i)   By J anuar y 1, 1998 , for all applicat ions for a renewable operat ing perm it required to be submitt ed un der subru le (4)(e) of th is ru le an d for all applicat ions submitt ed un der an alternat e schedule un der subru le (4)(g) of th is ru le with a submitta l dat e from October 16, 1996 , to December 15, 1996 .

    (ii)    By J anuar y 1, 1999 , for all applicat ions for a renewable operat ing perm it required to be submitt ed un der subru le (4)(f) of th is ru le an d for all applicat ions submitt ed un der an alternat e schedule un der subru le (4)(g) of th is ru le with a submitta l dat e from December 16, 1996 , to Februar y 28, 1997 .

    Ea ch submitta l of an y additiona l in format ion sha ll include a cert ificat ion by th e resp onsible officia l which stat es that , based on in format ion an d belie f form ed after reasona ble inquiry, th e stat ement s an d in format ion in th e submitta l ar e tru e, a ccurat e, an d com plete.

    (3)     Aft er an applicat ion for a  renewable  operat ing  perm it  ha s  been  determ ined  by  th e dep artm ent  to  be  administrat ively  com plete,  th e  dep artm ent   ma y  require  additiona l in format ion, including in format ion that was not requested on th e applicat ion form . For th e pur pose of th is subru le, additiona l in format ion mean s in format ion necess ar y to evaluat e or tak e fina l action on th e applicat ion, in format ion  needed  to determ ine th e applicability of an  lawful   requirement  in format ion   needed   to   en for ce   an  lawful   requirement , in format ion needed to address an y applicable requirement s to which th e stat ionar y sour ce becom es subject after th e dat e that th e person submitt ed th e administrat ively com plete applicat ion, but befor e release of a dra ft renewable operat ing perm it for public part icipat ion un de r R 336 .1214 (3), or in format ion needed  to evaluat e  th e  am ount  of th e  annua l  air qua lity  fee  for  th e  stat ionar y  sour ce.  A  person's  resp onse  to  a  request  for  additiona l in format ion by th e dep artm ent sha ll  include  all  of  th e  in format ion  requested  by  th e dep artm ent in th e request an d a cert ificat ion by a resp onsible officia l which stat es that , based on  in format ion  an d  belie f  form ed  after  reasona ble  inquiry,  th e  stat ement s  an d in format ion in th e resp onse ar e tru e, a ccurat e, an d com plete.  The person who submitt ed th e applicat ion for a renewable operat ing perm it  for  a  stat ionar y  sour ce  sha ll  furn ish, with in 30 days of th e dat e of th e request, an y additiona l in format ion requested, in writing, by th e dep artm ent , except as follows :

    (a)  A 30-day extension for a resp onse sha ll be grant ed if th e person requests that extension, in writing, dur ing th e initial 30-day t ime period.

    (b) The person ma y request a longer period of t ime, in writing, spe cifying th e reasons why 60 days was not reasona ble for submitt ing th e requested in format ion.

     

     

    (c) The dep artm ent sha ll provide writt en notice to th e person of th e dat e of expirat ion of an y t ime period for submitta l of all requested additiona l in format ion as a part of an y request for additiona l informat ion or upon grant ing a request for an extension.

    Fa ilur e to submit additiona l  in format ion  that  ha s  been  requested  in  writing  by  th e dep artm ent by th e expirat ion of th e t ime period specified for resp onse results in th e loss of th e applicat ion shield specified in subru le (1) of th is ru le.

    (4)   For a stat ionar y sour ce that is defined as a ma jor sour ce un der R 336 .1211 (1)(a ) on th e effect ive dat e of th is ru le, an administrat ively com plete applicat ion  for  a  renewable operat ing perm it sha ll be con sidered t imely if it is received by th e dep artm ent on or befor e th e followin g deadlines:

    (a)      By Februar y 29, 1996 , for a  ma jor  sour ce,  as  defined  by  R 336 .1211 (1)(a ),  with  a stan dar d industr ial classificat ion (sic) code of 0600 -0999 (agricultura l services), 1500 -1799 (con stru ct ion), 1800 -1999 , 2000 -2039 (food), 2100 -2399 (toba cco an d textiles),  2400 -2499 (lum ber an d wood), 2950 -2999 (aspha lt ), 3270 -3289 (con crete, lime an d gypsum products), 5000 -5499 (services),  or  5600 -7499  (services).  For  a  ma jor  sour ce  that  operat es  un der mu lt iple sic codes ,  th e sic  code  that  resulted  in  th e  most  actua l  emissions  of  air contam inant s from th e ma jor sour ce dur ing calendar year 1994 sha ll be th e sic code used for th e pur poses of th is subru le.

    (b)    By May 15, 1996 , for a ma jor sour ce, as defined by R 336 .1211 (1)(a ), with a stan dar d industr ial classificat ion (sic) code of 3000 -3099 (ru bber an d miscellan eous plastic), 5500 - 5599 (aut o dealers an d gas service), or 7500 -7599 (aut o repair). For a ma jor sour ce that operat es un der mu lt iple sic codes , th e sic code that resulted in th e most actua l emissions of air contam inant s from th e ma jor sour ce dur ing calendar year 1994 sha ll be th e sic code used for th e pur poses of th is subru le.

    (c)    By J uly 30, 1996 , for a ma jor sour ce, as defined by R 336 .1211 (1)(a ), with a stan dar d industr ial classificat ion (sic) code of 3400 -3599 (fa bricat ed meta l). For a ma jor sour ce that operat es un der mu lt iple sic codes , th e sic code that resulted in th e most actua l emissions of air contam inant s from th e ma jor sour ce dur ing calendar year 1994 sha ll be th e sic code used for th e pur poses of th is subru le.

    (d)   By October 15, 1996 , for a ma jor sour ce, as defined by R 336 .1211 (1)(a ), with a stan dar d industr ial classificat ion (sic) code of 1300 -1399 (oil an d gas), 2051 -2099 (bak eries an d food), 2500 -2599 (furn itur e), 2650 -2699  (paper  products),  3600 -3699  (electr onic),  4000 -4899 (tran sportat ion), 7600 -7999 (services), 8100 -9999 (services). For a  ma jor  sour ce  that operat es un der mu lt iple sic codes , th e sic code that resulted in th e most actua l emissions of air contam inant s from th e ma jor sour ce dur ing calendar year 1994 sha ll be th e sic code used for th e pur poses of th is subru le.

    (e)     By December 15, 1996 , for a  ma jor  sour ce,  as  defined  by  R 336 .1211 (1)(a ),  with  a stan dar d industr ial classificat ion (sic) code of 1000 -1299 (mining), 1400 -1499 (nonm eta llic minera l mining), 2040 -2050 (gra in mills an d cereal), 2700 -2799 (print ing),  3100 -3199 (leath er), 3200 -3269 (stone, clay, an d glass), 3290 -3299 (nonm eta llic  minera l  products), 3700 -3710 (tran sportat ion equipment ), 3714 -3799 (tran sportat ion equipment ), 3800 -3999 (miscellan eous manu factur ing), 4900 -4999 (gas, electr ic an d san itar y services), 8000 -8099 (medical). For a ma jor sour ce that operat es un der mu lt iple sic codes , th e sic code that resulted in th e most actua l emissions of air contam inant s from th e ma jor sour ce dur ing calendar year 1994 sha ll be th e sic code used for th e pur poses of th is subru le.

     

     

    (f)  By Februar y 28, 1997 , for a ma jor sour ce, as defined by R 336 .1211 (1)(a ), with a stan dar d industr ial classificat ion (sic) code of 2600 -2649 (paper mills), 2800 -2899 (ch emicals), 2900 - 2949 (petr oleum refining), 3300 -3399 (primar y meta l), 3711 -3713 (aut omobile  an d  tru ck asse mbly). For a ma jor sour ce that operat es un der mu lt iple sic codes , th e sic code that resulted in th e most actua l emissions of air contam inant s from th e ma jor sour ce dur ing calendar year 1994 sha ll be th e sic code used for th e pur poses of th is subru le.

    (g)   Notwith stan ding th e deadlines specified in subdivisi ons (a) to (f) of th is subru le, a person who owns or operat es 2 or more stat ionar y sour ces that ar e subject to th e provisions of th is ru le ma y request, in writing, an alternat e schedule  for  submitta l  of  t imely  an d administrat ively com plete applicat ions for renewable operat ing perm it s for th ose stat ionar y sour ces. The proposed schedule sha ll provide that administrat ively com plete applicat ions for th e stat ionar y sour ces sha ll be submitt ed between th e dat es specified in subdivisi ons (a) to (f) of th is subru le. If agreed to in writing by th e dep artm ent , th e alternat e schedule sha ll be th e basis for determ ining wheth er an administrat ively com plete applicat ion  is t imely pur suant  to th is ru le.

    (5)    For a stat ionar y sour ce that becom es a ma jor sour ce, as defined by R 336 .1211 (1)(a ), after th e effect ive dat e of  th is  ru le,  an  administrat ively  com plete  applicat ion  sha ll  be con sidered t imely if it is received by th e dep artm ent not more than  12 month s after  th e stat ionar y sour ce comm ences operat ion as a ma jor sour ce or by th e applicable deadline specified in subru le (4)(a ) to (f) of th is ru le, whichever is lat er. For th e pur poses of th is subru le, comm encing operat ion as a ma jor sour ce occur s upon comm encement  of  tr ial operat ion of th e new or modified emission un it that increased th e potent ial to emit of th e stat ionar y sour ce to more than or equa l to th e applicable ma jor sour ce definition specified in R 336 .1211 (1)(a ).

    (6)    For a stat ionar y sour ce that is an a ffect ed sour ce un der t itle IV of th e clean air act, a com plete  perm it  applicat ion  for  an  initial pha se  II  acid  ra in  perm it  sha ll be  con sidered t imely if it is submitt ed by J anuar y 1, 1996 , for sulfur  dioxide  an d J anuar y 1, 1998 , for nitr ogen oxides .

    (7)   For renewal of a renewable operat ing perm it , an administrat ively com plete applicat ion sha ll be con sidered t imely if it is received by th e dep artm ent not more than 18 month s, but not less than 6 month s, befor e th e  expirat ion  dat e  of th e  curr ent  renewable  operat ing perm it .

    (8)     For a stat ionar y sour ce  that  is  not  a  ma jor  sour ce  un der  R 336 .1211 (1)(a ),  but  is oth erwise subject to th e requirement s of th is ru le un der R 336 .1211 (1), a com plete applicat ion is con sidered t imely if it is received by th e dep artm ent in a ccor dan ce with th e followin g provisions, as applicable:

    (a)   For an a ffect ed sour ce un der R 336 .1211 (1)(b), on or befor e October 1, 1997 .

    (b)   For a solid waste incinerat ion un it un der R 336 .1211 (1)(c), with in 12 month s of th e dat e of th e promu lgat ion of an applicable requirement un der section 129 (a) of th e clean air act.

    (c)   For a mun icipal solid waste lan dfill un der R 336 .1211 (1)(d), by whichever is th e lat er of th e followin g dat es:

    (i)   November 1, 1998 .

    (ii)    With in 21 month s of th e effect ive dat e of R 336 .1931 for implement ing th e provisions of 40 C.F.R. part 60, subpart Cc.

     

     

    (iii)      With in 15 month s of th e dat e th e lan dfill becom es subject to an y of th e provisions of 40

    C.F.R. part 60, subpart WWW.

    (9)      For modificat ions to a renewable operat ing perm it , an administrat ively com plete applicat ion sha ll be con sidered t imely if it is received by th e dep artm ent in a ccor dan ce with th e t ime fram es specified in R 336 .1216 .

    (10)   Fa ilur e to operat e in com plian ce with all term s an d con ditions of an operat ing perm it is groun ds for en for cement action un der th e act, perm it revocat ion or revisi on, or denial of a perm it renewal applicat ion.

    (11)     Fa ilur e to ha lt or reduce an activity when necess ar y  to com ply  with  an  operat ing perm it is groun ds for en for cement action.

    (12)      Submitta l of a com plete applicat ion for a renewable operat ing perm it does not supersede or a ffect an y requirement s to obta in a perm it to insta ll un der R 336 .1201 .

    (13)    A person who submits in format ion to th e dep artm ent as a part of an applicat ion for a renewable operat ing perm it un der a claim of con fident ia lity, con sistent with th e requirement s of  1976  PA  442 ,  MCL  §15.231  et  seq.,  an d  kn own  as  th e  freed om  of in format ion act, sha ll submit a copy of th e in format ion directly to th e Un ited Stat es environm enta l protection agency.

    (14)     Except as provided in th is subru le, th e dep artm ent sha ll tak e fina l action on each administrat ively com plete applicat ion for a renewable operat ing perm it , including an applicat ion  for  perm it  renewal,  with in  18  month s   after   th e  dat e  of  receipt   by  th e dep artm ent of an administrat ively com plete applicat ion. The dep artm ent sha ll tak e fina l action on each t imely an d administrat ively com plete applicat ion for fir st t ime issuan ce of a renewable operat ing perm it for ma jor sour ces, submitt ed un der subru le (4)(a ) to (f) of th is ru le, in a ccor dan ce with th e followin g schedule:

    (a)    By Februar y 28, 1997 , for all applicat ions for a renewable operat ing perm it required to be submitt ed un der subru le (4)(a ) an (b) of th is  ru le an d on  all applicat ions  submitt ed un der an alternat e schedule un der subru le (4)(g) of th is ru le with a submitta l dat e on or before May 15 , 1996 .

    (b)   By Februar y 28, 1998 , for all applicat ions for a renewable operat ing perm it required to be submitt ed un der subru le (4)(c) an d  (d) of th is  ru le an d  on  all applicat ions  submitt ed un der an alternat e schedule un der subru le (4)(g) of th is ru le with a submitta l dat e from May 16, 1996 , to October 15 , 1996 .

    (c)   By Februar y 28, 1999 , for all applicat ions for a renewable operat ing perm it required to be submitt ed un der subru le (4)(e) of th is ru le an d on all applicat ions submitt ed un der an alternat e schedule un der subru le (4)(g) of th is ru le with a submitta l dat e from October 16, 1996 , to December 15 , 1996 .

    (d)   By Februar y 28, 2000 , for all applicat ions for a renewable operat ing perm it required to be submitt ed un der subru le (4)(f) of th is ru le an d on all applicat ions submitt ed un der an alternat e schedule un der subru le (4)(g) of th is ru le with a submitta l dat e from December 16, 1996 , to Februar y 28, 1997 .

    Rule 211 .  (1)  All of th e followin g stat ionar y sour ces ar e subject to th e requirement s of R 336 .1210 to obta in, an d only operat e in com plian ce with , a renewable operat ing perm it :

    (a)     Major sour ces as defined by an y of th e followin g criteria:

     

     

    (i)   A ma jor sour ce un der section 112 of th e clean air act, which is defined as an y stat ionar y sour ce or group of stat ionar y sour ces locat ed with in a cont iguous ar ea an d un der comm on contr ol that  emits, or ha s th e potent ial to emit, in th e aggregat e, an y of th e followin g:

    (A)    Ten tons per year of an y ha zar dous air pollutant that  ha s been  listed  un der  section 112 (b) of th e clean air act.

    (B)    Twent y-five tons per year of an y com binat ion of ha zar dous air pollutant s that  ha ve been listed un der section 112 (b) of th e clean air act.

    (C)    A lesse r quant ity as th e administrat or of th e Un ited Stat es environm enta l protection agency ma y esta blish by ru le for an y ha zar dous air pollutant listed un der section 112 (b) of th e clean air act. The dep artm ent sha ll ma inta in, an d mak e available upon request, a list of th e ha zar dous air pollutant s for which a lesse r quant ity criteria ha s been esta blished. Em issions from an y oil or gas explorat ion or production well, with it s ass ociat ed equipment , an d emissions from an y pipeline com press or or pum p stat ion sha ll not be aggregat ed with emissions from oth er similar  un it s, wheth er  or  not  th e un it s ar e in  a  cont iguous ar ea  or un der comm on contr ol, to determ ine wheth er th e un it s or stat ions ar e ma jor sour ces un der th is para gra ph. For th e pur pose of th is para gra ph, th e potent ial to emit of a stat ionar y sour ce for ha zar dous air pollutant s includes fugitive emissions, regar dless of th e cat egory of th e stat ionar y sour ce.

    (ii)    A stat ionar y sour ce that directly emits, or ha s th e potent ial to emit, 100 tons per year or more of an y of th e following:

    (A)  Lead.

    (B)   Sulfur dioxide.

    (C)   Nitr ogen oxides .

    (D)  Car bon monoxide. (E) PM-10 .

    (F)   Ozone.

    (G)  Volat ile organ ic com poun ds.

    (H)   ) Any air contam inant  regulat ed un der section 111 of t itle I of th e clean air act. (I) Any class I an d class II substan ces un der t itle VI of th e clean air act.

    For th e pur pose of th is para gra ph, th e fugitive emissions of a stat ionar y sour ce sha ll not be con sidered in determ ining wheth er th e stat ionar y  sour ce  is  a  ma jor  sour ce,  un less  th e stat ionar y sour ce belongs to 1 of th e cat egories listed in th e definition of potent ial to emit in R 336 .1116 .

    (iii)     A ma jor stat ionar y sour ce, as defined in part d of t itle I of th e clean air act, including, for ozone nonatta inm ent ar eas, stat ionar y sour ces that ha ve th e potent ia l to emit 100 tons per year or more of volat ile organ ic com poun ds or oxides of nitr ogen in ar eas classified as mar gina l or moderat e.

    (b)   Any a ffect ed sour ce as defined in section 402 of th e clean air act.

    (c)   Any solid waste incinerat ion un it , as defined in section 129 (g) of th e clean air act, that is required to obta in a renewable operat ing perm it un der section 129 (e) of th e clean air act.

    (d)   Any mun icipal solid waste lan dfill that  ha s a des ign capacity equa l to or great er than

    2.5 million megagram s an d 2.5 million cubic meters.

    (e)     Any stat ionar y sour ce in a  sour ce  cat egory  des ignat ed  by  th e  administrat or  of  th e Un ited Stat es environm enta l protection agency un der 40 C.F.R. §70.3.

     

     

    (2)   For th e pur poses of determ ining th e applicability of R 336 .1210 , th e potent ial to emit of a stat ionar y sour ce sha ll be th e sum of th e potent ial to emit of all pr ocess an d pr ocess equipment locat ed at th e stat ionar y sour ce.

    (3)   The followin g stat ionar y sour ces ar e exempted from th e obligat ion to obta in a renewable operat ing perm it un der R 336 .1210 :

    (a)  All stat ionar y sour ces an d sour ce cat egories for which th e person owning or operat ing th e stat ionar y sour ce would be required to obta in a perm it solely becau se th e stat ionar y sour ce is subject to 40 C.F.R. part 60, subpart AAA, stan dar ds of per forman ce for new reside nt ial wood heat ers.

    (b)  All stat ionar y sour ces an d sour ce cat egories for which th e person owning or operat ing th e stat ionar y sour ce would be required to obta in a perm it solely becau se th e stat ionar y sour ce is subject to 40 C.F.R. part 61, subpart M, nat iona l emission stan dar d for ha zar dous air pollutant s for asbes tos, §61.145 , stan dar d for demolition an d renovat ion.

    Rule 212 . (1) A t imely an d administrat ively com plete applicat ion for a stat ionar y sour ce subject to th e requirement s  of R 336 .1210  sha ll meet  th e requirement s of subru le (2) of R 336 .1210 an d sha ll conta in all in format ion that is necess ar y to implement an d en for ce all applicable requirement s that include a pr ocess -specific emission limitat ion or stan dar d or to determ ine th e applicability of th ose requirement s.

    (2)   All of th e followin g activities ar e con sidered to be insignificant activities at a stat ionar y sour ce an d need not be included in an administrat ively com plete applicat ion  for  a renewable operat ing perm it :

    (a)   Rep air an d ma int enan ce of groun ds an d stru ctur es.

    (b)   All activities an d chan ges pur suant to R 336 .1285 (a) to (f); however, if an y com plian ce monitoring requirement s in th e renewable operat ing perm it  would  be  a ffect ed  by  such chan ge, th en applicat ion sha ll be ma de to revise th e perm it pur suant  to R 336 .1216 .

    (c)   All activities an d chan ges pur suant to R 336 .1287 (f) to (h ); however, if an y com plian ce monitoring requirement s in th e renewable operat ing perm it  would  be  a ffect ed  by  such chan ge, th en applicat ion sha ll be ma de to revise th e perm it pur suant  to R 336 .1216 .

    (d)  Use of office supplies.

    (e)   Use of housekeep ing an d jan itorial supplies.

    (f)  San itar y plum bing an d ass ociat ed sta cks or vent s.

    (g)    Temporar y activities relat ed to th e con stru ct ion or dismant lement of buildings, ut ility lines, pipelines, wells , earth work s, or oth er stru ctur es.

    (h)    Stora ge an d han dling of drum s or oth er tran sporta ble conta iners that ar e sealed dur ing stora ge an d han dling.

    (i)    Fire protection equipment , fire fight ing an d tra ining in preparat ion  for  fight ing fires. Pr ior approval by th e dep artm ent for open burn ing ass ociat ed with tra ining in preparat ion for fight ing fires is required pur suant  to R 336 .1310 .

    (j)    Use, servicing, an d ma int enan ce of motor vehicles, including car s, tru cks, lift tru cks, locom otives, aircra ft , or wat ercra ft , except where th e activity is subject to an applicable requirement . The applicable requirement or th e emissions of th ose air contam inant s addressed by th e applicable requirement sha ll be included in a t imely an d administrat ively

     

     

    com plete applicat ion pur suant to R 336 .1210 . Exam ples of applicable requirement s ma y include an applicable requirement for a fugitive dust contr ol or operat ing program or an applicable requirement to include fugitive emissions pur suant  to R 336 .1211 (1)(a )(ii).  For th e pur pose of th is subdivisi on, th e ma int enan ce of motor vehicles does not include paint ing or refinishing.

    (k)   Constru ct ion, repair, an d ma int enan ce of roads or oth er paved or un paved ar eas, except where th e activities ar e subject to an applicable requirement . The applicable requirement or th e emissions of th e air contam inant s addressed by th e applicable requirement sha ll be included in a t imely an d administrat ively complete applicat ion pur suant to R 336 .1210 . Exam ples of applicable requirement s include an applicable requirement for a fugitive dust contr ol or operat ing program or an applicable  requirement  to include  fugitive emissions pur suant  to R 336 .1211 (1)(a )(ii).

    (l)    Piping an d stora ge of swee t natura l gas, including vent ing from press ur e relief valves an d pur ging of gas lines.

    (3)   The followin g pr ocess or pr ocess equipment need not be included in an administrat ively com plete applicat ion for a renewable operat ing perm it , un less th e pr ocess or pr ocess equipment is subject to applicable requirement s that include a pr ocess -specific emission limitat ion or stan dar d:

    (a)     That a term or con dition of a  perm it  to insta ll, perm it  to operat e, or  order  ent ered pur suant  to th e act is no longer an applicable requirement .

    (b)     That a term or con dition  of a  perm it  to insta ll, perm it  to operat e, or  order  ent ered pur suant to th e act should be modified to provide for con solidat ion or clar ificat ion of th e applicable  requirement .  A  person  sha ll  demonstrat e  that   th e  modificat ion  results  in en for ceable applicable requirement s which ar e equivalent to th e applicable requirement s conta ined in th e origina l perm it or order an d  that  th e  equivalent  requirement s  do not violat e an y oth er applicable requirement .

    (c)   That th e equipment should be com bined int o emission un it s differ ent from th e emission un it s conta ined in a perm it to insta ll, perm it to operat e, or order ent ered pur suant to th e act to provide for con solidat ion or clar ificat ion of th e applicable requirement . A person sha ll demonstrat e that th e realignm ent of th e emission un it s results in en for ceable applicable requirement s which ar e equivalent to th e applicable requirement s conta ined in th e origina l perm it or order an d that th e equivalent requirement s do not violat e an y oth er applicable requirement .

    (6)     Beginn ing with th e annua l report of emissions required pur suant to R 336.202 an d section 5503 (k) of th e act for calendar year 1995 , or th e fir st calendar year after a stat ionar y sour ce becomes a ma jor sour ce  as  defined  by  R 336 .1211 (1)(a ), whichever  is  lat er, each stat ionar y sour ce subject to th e requirement s of th is ru le sha ll report th e emissions, or th e in format ion necess ar y to determ ine th e emissions, of each  regulat ed  air  pollutant .  The in format ion sha ll be submitt ed ut ilizi ng th e  emissions  invent ory form s  provided  by  th e dep artm ent . For th e pur pose of th is  subru le, "regulat ed air pollutant " mean s all of th e following:

    (a)   Nitr ogen oxides or an y volat ile organ ic compoun d.

    (b)    A pollutant for which a nat iona l am bient  air  qua lity stan dar d ha s been  promu lgat ed un der th e clean air act.

    (c)   A pollutant that is subject to an y stan dar d promu lgat ed un der section 111 of th e clean air act.

    (d)  A class I or II substan ce that is subject to a stan dar d promu lgat ed un der or esta blished by t it le VI of th e clean air act.

    (e)     A pollutant that is subject to a stan dar d promu lgat ed un der section 112 or oth er requirement s esta blished un der section 112 of th e clean air act, except for  pollutant s regulat ed solely pur suant to section 112 (r ) of th e clean  air  act.  Pollutant s subject  t o  a stan dar d promu lgat ed or oth er requirement s esta blished un der section 112 of th e clean air act include both of th e followin g:

    (i)   A pollutant that is subject to requirement s un der section 112 (j) of th e clean air act. If th e administrat or of th e Un ited Stat es environm enta l protection agency fa ils to promu lgat e a stan dar d by th e dat e esta blished pur suant to section 112 (e) of th e clean air act,  an y pollutant for which a stat ionar y sour ce would be ma jor sha ll be con sidered to be regulat ed on th e dat e 18 month s after th e applicable dat e esta blished pur suant to section 112 (e) of th e clean air act.

     

     

    (ii)   A pollutant for which th e requirement s of section 112 (g)(2) of th e clean air act ha ve been met, but only with respe ct to th e specific stat ionar y sour ce that is subject to th e section 112 (g)(2) requirement .

    (7)   For th e pur pose of calculat ing th e annua l air qua lity fee pur suant to section 5522 of th e act, th e actua l emissions of a fee-subject air pollutant from all pr ocess or pr ocess equipment sha ll  be  determ ined.  However, th e  actua l  emissions  of a  fee-subject  air  pollutant  from pr ocess or pr ocess equipment listed pur suant to subru les (2) to (4) of th is ru le need not be calculat ed un less eith er of th e followin g ar e met:

    (a)    The pr ocess or pr ocess equipment is subject to a pr ocess -specific emission limitat ion or stan dar d for th e specific fee-subject air pollutant .

    (b)     The actua l emissions from th e pr ocess or pr ocess equipment do not exceed 10% of significant , as defined in R 336 .1119 (e), for that  air pollutant .

     

    R 336 .1213   Content  of a rene w ab le ope rating  pe rm it .

    Rule 213 .  (1) Ea ch renewable operat ing perm it sha ll include all of th e followin g genera l provisions:

    (a) A person sha ll com ply with all con ditions of th e renewable operat ing perm it . Any perm it non com plian ce con st itut es a violat ion of th e act an d is groun ds for en for cement action, for perm it revocat ion or revision, or for denial of th e renewal of a renewable operat ing perm it . All term s an d con ditions of a renewable operat ing perm it that ar e des ignat ed in th e perm it as fede ra lly en for ceable pur suant to subru le (5) of th is ru le, ar e en for ceable by th e administrat or of th e Un ited Stat es environm enta l protection agency an d by citizens un der th e provisions of th e clean air act.

    (b)   It sha ll not be a defense for a person in an en for cement action that it would ha ve been necess ar y to ha lt or reduce th e perm itt ed activity in order to ma inta in com plian ce with th e con ditions of th e perm it .

    (c)    The renewable operat ing perm it ma y be modified, revised , or revoked for cau se. The filing of a request by a person for a perm it modificat ion, revisi on, or term inat ion, or a notificat ion of plann ed chan ges or  ant icipat ed  non com plian ce  does  not  sta y  an y  perm it con dition. This does not supersede or a ffect th e ability of a person to mak e chan ges, at th e person's own r isk , pur suant  to R 336 .1215 an d R 336 .1216 .

    (d) A person sha ll allow th e dep artm ent or an auth orized represe ntat ive of th e dep artm ent , upon prese ntat ion of crede nt ia ls an d oth er docum ent s as ma y be required by law an d upon stat ing th e auth ority for an d pur pose of th e investigat ion, to per form an y of th e followin g activities:

    (i)     Ent er, at reasona ble t imes, a stat ionar y sour ce or  oth er  premises  where  emissions- relat ed activity is con ducted or where recor ds mu st be kept  un der  th e con ditions  of th e perm it .

    (ii)    Ha ve a ccess to an d copy, at reasona ble t imes, an y recor ds that mu st be kept un der th e con ditions of th e perm it .

    (iii)    Inspect, at reasona ble t imes, an y of th e followin g:

    (A)  Any stat ionar y sour ce.

    (B)   Any emission un it .

    (C)   Any equipment , including monitoring an d air pollut ion contr ol equipment .

     

     

    (D)   Any work pra ct ices or operat ions regulat ed or required un der th e renewable operat ing perm it .

    (iv)      As auth orized by section 5526 of th e act, sam ple or monitor at reasona ble  t imes substan ces or param eters for th e pur pose of assur ing com plian ce with th e perm it or applicable requirement s.

    (e)    A person sha ll furn ish to th e dep artm ent , with in a reasona ble t ime, an y in format ion that th e dep artm ent ma y request, in writing, to determ ine wheth er cau se exists for modifying, revisi ng, or revoking th e perm it or to determ ine com plian ce with th e perm it . Upon request, a person sha ll also furn ish to th e dep artm ent copies of an y recor ds that ar e required  to  be  kept  as  a  term  or  con dition  of  th e  renewable  operat ing  perm it  For in format ion which is claimed by th e person to be con fident ia l, con sistent with th e requirement s of  1976  PA  442 ,  MCL  §15.231  et  seq.,  an d  kn own  as  th e  freed om  of in format ion act, th e person  ma y  also be  required  to furn ish  th e  recor ds  directly  to th e Un ited Stat es environm enta l protection agency togeth er with a claim of con fident ia lit y.

    (f)    A cha llenge by an y person, th e administrat or of th e Un ited Stat es environm enta l protection agency, or th e dep artm ent to a part icular con dition or a part of a  renewable operat ing perm it sha ll not set aside, delay, sta y, or in an y way a ffect th e applicability or en for ceability of an y oth er con dition or part of th e renewable operat ing perm it .

    (g) A person sha ll pay fees con sistent with th e fee schedule an d requirement s pur suant to section 5522 of th e act.

    (h)    The renewable operat ing perm it does not convey an y propert y right s or an y exclusive privilege.

    (i)     Fede ra lly en for ceable perm it to insta ll term s an d con ditions in cor porat ed int o th e renewable operat ing perm it ar e ident ified with in th e renewable operat ing perm it as being esta blished pur suant  to R 336 .1201 .

    (2)   Ea ch renewable operat ing perm it sha ll conta in emission limits an d stan dar ds, including operat iona l requirement s an d limits that ensur e com plian ce with all applicable requirement s at th e t ime of perm it issuan ce. In addition, each renewable operat ing perm it ma y conta in additiona l limits agreeable to both th e applicant an d th e dep artm ent , provided that th ese limits ar e not contrar y to R 336 .1213 or th e clean air act. The followin g provisions apply to emission limits an d stan dar ds:

    (a)    The renewable operat ing perm it sha ll spe cify an d reference th e un derlying applicable requirement for each term or con dition an d ident ify an y differ ence in form as com par ed to th e applicable requirement upon which th e term or con dition is based .

    (b)    The renewable operat ing perm it sha ll stat e that , where an applicable requirement is more str ingent than an applicable requirement  of regulat ions  promu lgat ed  for  a ffect ed sour ces un der t itle IV of th e clean air act, both provisions sha ll be in cor porat ed int o th e perm it .

    (c)   If th e stat e implementat ion plan allows for an alternat ive emission limit that is equivalent to th e limit conta ined  in  th e  stat e  implementat ion  plan ,  an y  renewable operat ing perm it conta ining th e equivalent alternat ive emission limit sha ll conta in term s an d  con ditions  to  ensur e  that  an y  such  emission   limit   is  quant ifiable,  a ccounta ble, en for ceable, an d based on replicable pr oced ur es.

    (d)   Any term or con dition esta blished as a limit on th e potent ial to emit of th e stat ionar y sour ce sha ll be con sistent with th e requirement s of R 336 .1205 (1)(a ).  For each such limit on

     

     

    th e potent ial to emit of th e stat ionar y sour ce, th e perm it sha ll specify an d reference an y requirement s that  would oth erwise be applicable to th e sour ce or emission un it .

    (3)   The renewable operat ing perm it sha ll conta in term s an d con ditions necess ar y to ensur e that su fficient testing, monitoring, recor dkeep ing, report ing, an d com plian ce evaluat ion activities will be con ducted to determ ine th e statu s of com plian ce of th e stat ionar y sour ce with th e emission limitat ions an d stan dar ds conta ined in th e renewable operat ing perm it . The followin g provisions apply to testing,  monitoring,  recor dkeep ing,  report ing,  an d com plian ce evaluat ion activities:

    (a)    With respe ct to testing an d monitoring, each renewable operat ing perm it sha ll conta in term s an d con ditions necess ar y to ensur e com plian ce with all of th e followin g:

    (i)   The use of all emissions monitoring an d ana lysis pr oced ur es or test meth ods required by th e applicable requirement s, including 40 C.F.R. part 64 an d an y oth er pr oced ur es an d meth ods promu lgat ed pur suant  to sections 504 (b) or 114 (a )(3) of th e clean air act.  Title 40

    C.F.R. part 64 is adopted by reference in R 336 .1299 . If more than 1 monitoring or testing requirement applies, th e perm it ma y specify a str eam lined set of monitoring or testing requirement s, provided th e specified monitoring or testing is adequat e to assur e com plian ce at least to th e sam e extent as th e monitoring or testing applicable requirement s that were not included in th e perm it as a result of such str eam lining.

    (ii)    Where th e applicable requirement does not require periodic testing or instrum enta l or noninstrum enta l monitoring, which ma y con sist of recor dkeep ing des igned to serve as monitoring, th e use of periodic monitoring su fficient to yield reliable data  from th e relevant t ime period that ar e represe ntat ive of th e stat ionar y sour ce's com plian ce with th e perm it , as report ed pur suant to subru le (3)(c) of th is ru le. The monitoring requirement s sha ll ensur e use of term s, test meth ods,  un it s,  avera ging  periods,  an d  oth er  stat ist ical  con vent ions con sistent with th e applicable requirement . Recor dkeep ing provisions sha ll be su fficient to meet th e requirement s of subru le (3)(b) of th is ru le.

    (iii)    As necess ar y, requirement s con cern ing th e use, ma int enan ce, an d, where appropriat e, insta llat ion of monitoring equipment or meth ods.

    (b)   With respe ct to recor dkeep ing, each renewable operat ing perm it sha ll conta in term s an d con ditions necess ar y to ensur e com plian ce with th e recor dkeep ing requirement s specified in th e applicable requirement s.  Ea ch  renewable  operat ing perm it  sha ll also conta in  term s an d con ditions that  require, where appropriat e, both of th e followin g:

    (i)     Recor ds of an y periodic emission or param etr ic monitoring that include all of th e followin g in format ion:

    (A)  The dat e, locat ion, t ime, an d meth od of sam pling or measur ement s.

    (B)   The dat es ana lyses of th e sam ples were per form ed.

    (C)   The com pan y or ent ity that  per form ed th e ana lyses of th e sam ples.

    (D)   The ana lytical techn iques or meth ods used . (E) The results of th e ana lyses .

    (F) The relat ed operat ing con ditions or param eters that existed at th e t ime of sam pling or measur ement .

    (ii)   Retent ion of recor ds of all required monitoring data an d support in format ion for a period of not less than 5 year s from th e dat e of th e monitoring sam ple, measur ement , report , or applicat ion.  Support in format ion includes all calibrat ion an d ma int enan ce recor ds an d a ll

     

     

    origina l str ip-chart recor dings, or oth er origina l data recor ds, for cont inu ous monitoring instrum entat ion an d copies of all report s required by th e renewable operat ing perm it .

    (c)    With respe ct to report ing an d th e cert ificat ion of report s, each  renewable  operat ing perm it sha ll conta in term s an d con ditions necess ar y  to  insur e  com plian ce  with  th e report ing requirement s specified in th e applicable requirement s. Except as provided subdivisi on (iii)(B) of th is subdivisi on, an y docum ent , including report s, required to be submitt ed to th e dep artm ent as a term or con dition of a renewable operat ing perm it sha ll include a cert ificat ion by a resp onsible officia l which stat es that , based on in format ion an d belie f form ed after reasona ble inquiry, th e stat ement s an d in format ion in th e docum ent ar e tru e, a ccurat e, an d com plete. Ea ch  renewable operat ing perm it  sha ll also conta in  term s an d con ditions for all of th e followin g:

    (i)    The submitta l of report s of an y required monitoring at least once every 6 month s. All instan ces of deviat ions from perm it requirement s dur ing th e  report ing  period  sha ll  be clear ly ident ified in th e report s. Ea ch report submitt ed pur suant to th is subdivisi on sha ll include a cert ificat ion by a resp onsible officia l which stat es that , based on in format ion an d belie f form ed after reasona ble inquiry, th e stat ement s an d in format ion  in  th e report  ar e tru e, a ccurat e, an d com plete.

    (ii)    The prompt report ing of deviat ions from perm it requirement s. Pr ompt report ing sha ll be defined as follows , un less oth erwise provided in th e renewable operat ing perm it :

    (A)  For deviat ions that exceed th e emissions a llowed un der th e renewable operat ing perm it , prompt report ing mean s report ing con sistent with th e requirement s of R 336 .1912 . All report s submitt ed pur suant to th is para gra ph sha ll be promptly cert ified as specified  in para gra ph (iii) of th is subdivisi on.

    (B)    For deviat ions which exceed th e emissions allowed un der  th e  renewable  operat ion perm it an d which ar e not report ed pur suant to R 336 .1912 due  to th e  durat ion  of th e deviat ion, prompt report ing mean s th e report ing of all deviat ions in th e report s required by para gra ph (i) of th is subdivisi on. The report sha ll describe reasons for each deviat ion an d th e actions tak en to minimize or corr ect each deviat ion.

    (C)   For deviat ions that do not exceed th e emissions a llowed un der th e renewable operat ing perm it , prompt report ing mean s th e report ing of all deviat ions in th e report s required by para gra ph (i) of th is subdivisi on. The report sha ll describe th e reasons for each deviat ion an d th e actions tak en to minimize or corr ect each deviat ion.

    (iii)    For report s required pur suant to para gra ph (ii) of th is subdivisi on, prompt cert ificat ion of th e report s mean s eith er of th e followin g:

    (A)   Submitt ing a cert ificat ion by a resp onsible officia l with each report which stat es that , based on in format ion  an d  belie f  form ed  after  reasona ble  inquiry,  th e  stat ement s  an d in format ion in th e report ar e tru e, a ccurat e, an d com plete.

    (B)    Submitt ing, with in 30 days followin g th e end of a calendar month dur ing which 1 or more prompt report s of deviat ions from th e emissions allowed un der th e perm it were submitt ed to th e dep artm ent pur suant to para gra ph (ii) of th is subdivisi on, a cert ificat ion by a resp onsible officia l which stat es that , based on in format ion an d belief form ed after reasona ble inquiry, th e stat ement s an d in format ion conta ined in each of th e report s submitt ed dur ing th e previous month were tru e, a ccurat e, an d com plete. The cert ificat ion sha ll include  a  list ing  of  th e  report s  that  ar e  being  cert ified.  Any  report  submitt ed pur suant  to para gra ph  (ii) of th is  subdivisi on  that  will  be  cert ified  on  a  month ly  basis

     

     

    pur suant to th is para gra ph sha ll include a stat ement that cert ificat ion of th e report will be provided with in 30 days followin g th e end of th e calendar month .

    (4)    With respe ct to com plian ce, each renewable operat ing perm it sha ll conta in term s an d con ditions necess ar y to ensur e each of th e followin g:

    (a)   In cor porat ion int o th e renewable operat ing perm it of a schedule of com plian ce.

    (b) For a stat ionar y sour ce that  is not in com plian ce with all applicable requirement s at th e t ime of issuan ce of a renewable operat ing perm it , th e submission of progress report s to th e dep artm ent , con sistent with an applicable schedule of com plian ce, at least semiannua lly or more frequent ly if spe cified in an applicable requirement or  by  th e  dep artm ent  in  th e perm it . Pr ogress report s sha ll conta in th e in format ion specified in both of th e followin g provisions:

    (i)   The dat e or dat es for achieving th e activities, milestones, or com plian ce required in th e schedule of com plian ce, an d th e dat e or dat es when th e activities, milestones, or com plian ce were achieve d.

    (ii)    An explanat ion of why an y dat es in th e schedule of com plian ce were not or will not be met an d a description of an y prevent ive or corr ective measur es adopted.

    (c) A requirement that , at least annua lly, or more frequent ly if spe cified in an applicable requirement or by th e dep artm ent in th e renewable operat ing perm it ,  th e  resp onsible officia l sha ll cert ify, in writing, to th e dep artm ent an d to th e Un ited Stat es environm enta l protection agency, that th e stat ionar y sour ce is an d ha s been in com plian ce with all term s an d con ditions conta ined in th e renewable operat ing perm it , except for an y deviat ions from com plian ce that ha ve been or ar e being report ed to th e dep artm ent . The cert ificat ion sha ll stat e that , based on in format ion an d belie f form ed after reasona ble inquiry, th e stat ement s an d in format ion in th e cert ificat ion ar e tru e, a ccurat e, an d com plete. Ea ch cert ificat ion of com plian ce sha ll include all of th e followin g in format ion:

    (i)    The ident ificat ion of each term  or  con dition  of  th e  perm it  that  is  th e  basis  of  th e cert ificat ion.

    (ii)    The com plian ce statu s of th e stat ionar y sour ce with respe ct to each ident ified term or condition.

    (iii)    Wheth er com plian ce was cont inu ous or int erm itt ent .

    (iv)     The meth ods used for determ ining th e  com plian ce  statu s  of  th e  stat ionar y  sour ce, curr ent ly an d over th e report ing period con sistent with subru les (3)(a ), (b), an d (c) of th is ru le.

    (v)   Oth er facts as th e dep artm ent ma y require in th e perm it that ar e necess ar y to determ ine th e com plian ce statu s of th e stat ionar y sour ce.

    (5)   Ea ch renewable operat ing perm it sha ll provide for th e followin g:

    (a)    Ea ch renewable operat ing perm it sha ll spe cifically des ignat e as not being en for ceable un der th e clean air act an y term s an d con ditions included in th e perm it that  ar e  not required un der th e clean air act or un der an y of it s applicable requirement s. Term s an d con ditions so des ignat ed ar e not subject to th e requirement s for review by th e Un ited Stat es environm enta l protection agency or a ffect ed stat es un der R 336 .1214 .

    (b)   Ea ch renewable operat ing perm it sha ll spe cifically des ignat e each fede ra lly en for ceable applicable   requirement   previously   esta blished   in    perm it   to   insta ll   pur suant   to R 336 .1201 .

    (6)   Both of th e followin g provisions apply to perm it shields:

     

     

    (a)    Except as provided in subdivisi on (b) of th is subru le, each renewable operat ing perm it sha ll include a perm it shield provision stat ing that com plian ce with th e con ditions of th e perm it sha ll be con sidered com plian ce with an y applicable requirement s as of th e dat e of perm it issuan ce, if eith er of th e followin g provisions is sat isfied:

    (i)   The applicable requirement s ar e included an d ar e specifically ident ified in th e perm it .

    (ii)    The perm it includes a determ inat ion or a con cise summar y of th e determ inat ion by th e dep artm ent that  oth er  specifically  ident ified  requirement s  ar e  not  applicable  to  th e stat ionar y sour ce.

    (b)   Noth ing in th is subru le or in an y renewable operat ing perm it sha ll alter or a ffect an y of th e following:

    (i)     The provisions of section 303 of th e  clean  air  act,  emergency  orders,  including  th e auth ority of th e administrat or of th e Un ited Stat es environm enta l protection agency un der that  section.

    (ii)   The liability of an owner or operat or of a stat ionar y sour ce for an y violat ion of applicable requirement s befor e or at th e t ime of perm it issuan ce.

    (iii)    The applicable requirement s of th e acid ra in program , con sistent with section 408 (a) of th e clean air act.

    (iv)    The ability of th e Un ited Stat es environm enta l protection agency to obta in in format ion from a stat ionar y sour ce pur suant  to section 114 of th e clean air act.

    (7)    Ea ch  renewable operat ing perm it  sha ll be issued for  a  fixed term  of not  more than  5 year s.   Renewable operat ing perm it s that  ha ve term s of less than  5 year s ma y be issued with th e agreement of th e dep artm ent an d th e perm it applicant .  The term s an d con ditions of a renewable operat ing perm it for a ffect ed sour ces un der t itle IV of th e clean air act that address  th requirement s  of t itle IV sha ll be  issued  for  a  term  of 5 year s. The dat e of expirat ion of th e renewable operat ing perm it sha ll be specified in th e perm it .

    (8)   A renewable operat ing perm it sha ll include term s an d con ditions that allow a stat ionar y sour ce to switch it s operat ion between reasona bly ant icipat ed operat ing scenar ios if th e scenar ios ha ve been ident ified by th e stat ionar y sour ce in it s applicat ion an d foun d to be approvable by th e dep artm ent . The term s an d con ditions sha ll provide for all of th e following:

    (a)     Require th e stat ionar y sour ce, cont emporan eously with mak ing a chan ge from  one operat ing scenar io to an oth er, to recor d, in a log at th e stat ionar y sour ce, a recor d of th e scenar io un der which th e sour ce is operat ing.

    (b)   Extend th e perm it shield described in subru le (6) of th is ru le to all term s an d con ditions un der each approved operat ing scenar io.

    (c)  En sur e that th e term s an d con ditions of each approved alternat ive scenar io meet all applicable requirement s.

    (9)     A renewable operat ing perm it sha ll include term s an d con ditions for th e tra ding of emissions increases an d decreases am ong pr ocess  emission  un it s  with in  th e  stat ionar y sour ce solely for th e pur pose of com plying with an emissions cap that is esta blished in th e perm it indepe ndent of oth erwise applicable requirement s, if th e term s an d con ditions ha ve been requested by a person in an applicat ion for a renewable operat ing perm it . If a person wishes to include th e term s an d con ditions in a renewable operat ing perm it , th e perm it applicat ion sha ll include proposed replicable pr oced ur es an d perm it term s that th e person believes  ensur e  th e  emissions  tra des  ar e  quant ifiable  an d  en for ceable.   The  term s  an d

     

     

    con ditions sha ll include th ose necess ar y to meet th e requirement s of subru les (2) to (4) of th is ru le. The dep artm ent sha ll not be required to include in th e emissions tra ding provisions an y emission un it s for which emissions ar e not quant ifiable or for which th ere ar e no replicable pr oced ur es to en for ce th e emissions tra des. The perm it sha ll also require com plian ce with all applicable requirement s. Both of th e followin g provisions apply to th e tra ding of emissions increases an d decreases am ong emission un it s solely for th e pur pose of com plying with an emissions cap:

    (a)       A writt en notificat ion to th e dep artm ent an d th e Un ited Stat es environm enta l protection agency is required 7 days in advan ce of an y emissions tra de un der th is subru le. The notice sha ll stat e when th e chan ge will occur an d sha ll des cribe th e chan ges in emissions that will result an d how th ese increases an d decreases in emissions will com ply with th e term s an d con ditions of th e perm it .

    (b)   The perm it shield described in  subru le  (6)  of  th is  ru le  sha ll  extend  to  term s  an d con ditions that  allow th e increases an d decreases in emissions.

    (10)    In addition to th e oth er requirement s of th is ru le, each renewable operat ing perm it for an a ffect ed sour ce un der t itle iv of th e clean air act sha ll include a perm it con dition prohibiting emissions exceedi ng an y a llowan ces that an a ffect ed sour ce lawfully holds as of th e allowan ce tran sfer deadline pur suant to R 336 .1299 (d) an d 40 C.F.R. §72.9(c)(1)(i). All of th e followin g apply to allowan ces:

    (a)    A perm it revisi on sha ll not be required for increases in emissions that  ar e auth orized by a llowan ces acquired pur suant to t itle IV of th e clean air act if th e increases do not require a perm it revisi on un der an y oth er applicable requirement .

    (b)   A limit sha ll not be placed on th e num ber of a llowan ces held by th e a ffect ed sour ce.  The a ffect ed sour ce ma y not, however, use allowan ces as a defense to non com plian ce with an y oth er applicable requirement .

    (c)   Any a llowan ce sha ll be a ccount ed for a ccor ding to th e pr oced ur es esta blished in regulat ions promu lgat ed un der t itle IV of th e clean air act.

    (11)    A renewable operat ing perm it for a temporar y sour ce ma y auth orize emissions from a stat ionar y sour ce at mu lt iple temporar y locat ions. An a ffect ed sour ce un der t itle IV of th e clean air act sha ll not be perm itt ed as a temporar y sour ce. In addition to th e oth er requirement s of th is ru le, perm it s for temporar y sour ces sha ll include all of th e followin g provisions:

    (a)    Conditions  that  will  assur e  com plian ce  with  all  applicable   requirement  at   all auth orized locat ions.

    (b) Requirement s that th e owner or operat or notify th e dep artm ent not less than 10 days in advan ce of each chan ge in locat ion.

    (c)  Conditions that  assur e com plian ce with all oth er provisions of th is ru le.

    (12)   A renewable operat ing perm it sha ll conta in term s an d con ditions allowing for emission avera ging an d emission reduction credit tra ding pur suant to an y applicable int erstat e or regiona l emissions tra ding program that ha s been approved by th e administrat or of th e Un ited Stat es environm enta l  protection  agency  as  a  part  of  Michigan 's  stat e implementat ion plan .

    Rule 214 .  (1)  Aft er  th e  dep artm ent  ha s  received  an  administrat ively  com plete applicat ion  an d  all  additiona l  in format ion  requested  by  th e  dep artm ent  pur suant   to R 336 .1210 (3) for a renewable operat ing perm it , significant modificat ion to a renewable operat ing perm it , or th e renewal of a renewable operat ing perm it , th e dep artm ent sha ll prepar e a dra ft perm it an d a report that sets forth th e applicable requirement s an d factua l basis for th e dra ft perm it term s an d con ditions. The report sha ll include citat ions of th e applicable requirement s, an explanat ion of an y equivalent requirement s or oth er chan ges included in th e dra ft  perm it  pur suant  to  R 336.1212 (6),  an d  an y  determ inat ion  ma de pur suant t o R 336 .1213 (6)(a )(ii)  regar ding  requirement s  that  ar e  not  applicable  to  th e stat ionar y sour ce where th e dra ft perm it conta ins only a summar y of th e determ inat ion.

    (2)  The person who applied for th e renewable operat ing perm it sha ll be provided with a reasona ble period of t ime, but not less than 7 days nor more than 30 days, to review an d comm ent on th e dra ft renewable operat ing perm it , dra ft renewable operat ing perm it significant modificat ion, or dra ft renewable operat ing perm it renewal befor e th e start of th e public part icipat ion pr oced ur e specified in subru le (3) of th is ru le. If th e person an d th e dep artm ent cann ot agree on th e term s an d con ditions  of th e  dra ft  renewable  operat ing perm it , th e term s an d con ditions that th e dep artm ent believes ar e necess ar y to com ply with th e requirement s of R 336 .1213 sha ll be in cor porat ed int o th e dra ft renewable operat ing perm it an d th e report required by subru le (1) of th is ru le sha ll include a discussion of th e person's objections.

    (3)    Except for modificat ions qua lifying for administrat ive perm it  am endment  pr oced ur es pur suant   to   R 336 .1216 (1)   or   minor   perm it   modificat ion   pr oced ur es   pur suant    to R 336 .1216 (2), th e dra ft renewable operat ing perm it , dra ft renewable operat ing perm it modificat ion, or th e dra ft renewable operat ing perm it renewal sha ll be subjected to th e followin g public part icipat ion pr oced ur e befor e th e dep artm ent submits a proposed renewable operat ing perm it to th e Un ited Stat es environm enta l protection agency for review pur suant  to subru le (6) of th is ru le:

    (b) The notice sha ll set forth all of th e followin g in format ion:

    (i)   The nam e of th e stat ionar y sour ce.

    (ii)    The nam e an d ma iling address of th e resp onsible officia l.

    (iii)    The ma iling address of th e dep artm ent .

    (iv)   The activity or activities involved in th e proposed perm it action.

    (v)   The emissions chan ge involved in an y perm it modificat ion.

    (vi)    The nam e, address , an d telep hone num ber of a represe ntat ive of th e dep artm ent from whom int erested persons ma y obta in additiona l in format ion, including copies of th e dra ft perm it , th e report  required un der subru le (1) of th is ru le, an d, to th e extent  provided  by

     

     

    1976 PA 442 , MCL §15.231 et seq., an d kn own as th e freed om of in format ion act, th e applicat ion an d an y oth er mat erials available to th e dep artm ent that ar e relevant to th e perm it decision.

    (vii)    A brief description of th e pr oced ur es to submit comm ent s.

    (viii)      The t ime an d place of an y hear ing that ma y be held, including a stat ement  of th e pr oced ur es to request a hear ing, un less a hear ing ha s already been scheduled.

    (c)   The dep artm ent sha ll provide not less than 30 days for public comm ent an d sha ll give notice of an y public hear ing not less than  30 days in advan ce of th e hear ing.

The applicat ion shield provided by R 336 .1210 (1) sha ll cont inu e to apply to th e stat ionar y sour ce, con sistent with th e provisions of R 336 .1210 , unt il th e dep artm ent tak es fina l action on th e renewable operat ing perm it .

    (7)  The  dep artm ent  sha ll mak e  a  fina l decision  to issue  or  deny a  renewable  operat ing perm it , a  significant  modificat ion  to a  renewable  operat ing  perm it , or  th e  renewal  of a renewable   operat ing   perm it   after   com pletion   of   th  review  by    th  Un ited  Stat es environm enta l protection agency spe cified in subru le (6) of th is ru le.  The fina l renewable operat ing perm it sha ll conta in all term s an d con ditions determ ined by th e dep artm ent to be necess ar y  pur suant   to  R 336 .1213 , after  con siderat ion  of all  comm ent s  received  dur ing public part icipat ion pur suant  to subru le (3) of th is ru le an d a ffect ed stat e review pur suant to subru le  (4) of th is  ru le, including an y term s  an d  con ditions  necess ar y to resolve an y objection  by  th e  administrat or  of  th e  Un ited  Stat es  environm enta l  protection  agency pur suant  to subru le (6) of th is ru le.   The dep artm ent  sha ll tran smit  copy of each fina l renewable  operat ing  perm it  to  th e  Un ited  Stat es  environm enta l  protection  agency. A person aggrieve d by th e issuan ce, denial, modificat ion, or renewal of a renewable operat ing perm it ma y appe al th e fina l decision as provided in section 5506 (14) of th e act.

    (8)   Any person ma y petition th e administrat or of th e Un ited Stat es environm enta l protection agency to mak e an objection regar ding a renewable operat ing perm it pur suant to 40 C.F.R. §70.8(d). The petition sha ll be filed with in 60 days after th e expirat ion of th e administrat or's  45-day  review  period  specified  in  subru le  (6) of th is  ru le  an d  40 C.F.R.

    §70.8(c). The petition sha ll be based only on an objection to th e renewable operat ing perm it that was ra ised with  reasona ble specificity dur ing th e public comm ent  period provided for in subru le (3)(c) of th is ru le, un less th e petitioner demonstrat es that it was impra cticable to ra ise th e objection dur ing th e public comm ent period or un less th e groun ds for th e objection ar ose after th e public comm ent period. A petition for review does not sta y th e effect iveness of a renewable operat ing perm it or it s requirement s if th e renewable operat ing perm it was issued after th e end of th e 45-day review period an d befor e th e dep artm ent received an objection by th e administrat or. If th e administrat or of th e Un ited Stat es environm enta l protection agency objects to th e renewable operat ing perm it as a result of a petition filed pur suant to 40 C.F.R. §70.8(d) befor e th e dep artm ent ha s issued th e renewable operat ing perm it , th e dep artm ent sha ll not issue th e renewable operat ing  perm it  unt il  th e administrat or 's   objection   ha  been   resolved.     The   applicat ion   shield   provided   by R 336 .1210 (1) sha ll cont inu e to apply to th e stat ionar y sour ce, con sistent with th e provisions of R 336 .1210 , unt il th e dep artm ent  tak es  fina l  action  on  th e  renewable operat ing perm it .     Rule  215 .  (1)  The  followin g  provisions  apply  to  operat iona l  flexibili ty  with in  a stat ionar y sour ce. As provided in 40 C.F.R. §70.4(B)(12), a person ma y mak e eith er of th e followin g chan ges to pr ocess or pr ocess equipment with in a stat ionar y sour ce cover ed by a renewable operat ing perm it with out a revisi on to that perm it , if th e chan ges ar e not a modificat ion un der an y applicable provision of t itle I of th e clean air act an d th e chan ges do not exceed th e emissions allowable un der th e renewable operat ing perm it , wheth er expressed th erein as a rat e of emissions or in th e term s of tota l emissions, if th e person provides writt en notificat ion to th e dep artm ent an d th e Un ited Stat es environm enta l protection agency at least 7 days prior to th e chan ge. The perm itt ee an d th e dep artm ent sha ll atta ch each such notice to th eir copy of th e relevant perm it :

    (a) ) As provided in 40 C.F.R. §70.2 an d 40 C.F.R. §70.4(B)(12)(i), a person ma y mak e chan ges that contra vene a spe cific perm it con dition, if th e chan ges ar e not modificat ions un der  an y provision of t itle I of th e clean air act an d th e chan ges do not exceed th e emissions a llowable un der th e renewable operat ing perm it , wheth er expressed th erein as a rat e of emissions or in term s of  tota l  emissions.  Such  chan ges  do  not  include  chan ges  that   would  violat e applicable requirement s or  contra vene fede ra lly en for ceable perm it  term s  an d con ditions that  ar e  monitoring,  including  test  meth ods,  recor dkeep ing,  report ing,   or com plian ce cert ificat ion requirement s. For each such chan ge, th e writt en notificat ion  required in th is subru le sha ll include all of th e followin g in format ion:

    (i)   A brief des cription of th e chan ge with in th e stat ionar y sour ce.

    (ii)   The dat e on which th e chan ge will occur .

    (iii)    ny chan ge in emissions.

    (iv)   Any perm it term or con dition that  is no longer applicable as a result of th e chan ge.

    (b) As provided in 40 C.F.R. §70.4(B)(12)(ii), a person ma y tra de increases an d decreases in emissions with in th e stat ionar y sour ce a ccor ding to pr oced ur es specified by an applicable emissions tra ding program that ha s  been  approved  by  th e  administrat or  of th e  Un ited Stat es environm enta l protection agency as a part of Michigan 's stat e implementat ion plan , if th e person ha s provided writt en notificat ion to th e dep artm ent an d th e Un ited Stat es environm enta l protection agency of th e chan ges at least 7 days prior to th e activity tak ing place.

    (i)      The writt en notificat ion required in th is subdivisi on sha ll include all in format ion required by th e approved stat e implementat ion plan , including at a minimum , all of th e followin g in format ion:

    (A)  When th e proposed chan ge will occur .

    (B)   ) A des cription of each such chan ge.

    (C)   Any chan ge in emissions.

    (D)     The perm it requirement s with which th e stat ionar y sour ce will com ply using th e emissions tra ding provisions of th e approved stat e implementat ion plan for tra ding with in a stat ionar y sour ce.

    (E)   The pollutant s emitt ed subject to th e emissions tra de.

    (F)    The provisions of th e approved stat e implementat ion plan . with which th e stat ionar y sour ce will com ply an d which provide for th e emissions tra de with in th e stat ionar y sour ce.

     

     

    (ii)   Complian ce with th e perm it requirement s that th e stat ionar y sour ce will meet using th e emissions tra de sha ll be determ ined a ccor ding to th e requirement s of th e approved stat e implementat ion plan auth orizing th e emissions tra de with in th e stat ionar y sour ce.

    (c)   For th e pur poses of th is subru le, th e emissions allowable un der th e renewable operat ing perm it include an y emission limitat ion, stan dar d, or con dition, including a work pra ct ice stan dar d, that is required  by  an  applicable  requirement  or  an y  emission  limitat ion, stan dar d, or con dition, including a work pra ct ice stan dar d, that esta blishes an  emissions cap which th e sour ce ha s assum ed to avoid an applicable requirement .

    (2)   The followin g provisions apply to emission reduction credits tra ding between stat ionar y sour ces. As provided in 40 C.F.R. §70.6(A)(8), a person ma y mak e an y chan ges with out revisi on to th e renewable operat ing perm it where provided for in th e renewable operat ing perm it an d a llowed by an applicable int erstat e or regiona l emissions tra ding program that ha s been approved by th e administrat or of th e Un ited Stat es environm enta l protection agency.

    (3)      The  followin g  provisions  apply  to  off-pe rm it   chan ges.     as   provided   in   40 C.F .R.

    §70.4(B)(14) an d (15), a person ma y mak e a chan ge at a stat ionar y sour ce covered by a renewable operat ing perm it that is not addressed or prohibited by th e renewable operat ing perm it with out a revision to th e renewable operat ing perm it , if all of th e followin g provisions ar e met:

    (a)  The chan ge com plies with all applicable requirement s an d is not a modificat ion un der an y applicable provision of t itle I of th e clean air act.

    (b)  If th e stat ionar y sour ce is an a ffect ed sour ce un der t itle IV of th e clean air act, th e chan ge is not contrar y to an y applicable requirement of t itle IV of th e clean air act.

    (c) The person sha ll provide cont emporan eous writt en notificat ion to th e dep artm ent an d th e Un ited Stat es environm enta l protection  agency of each  chan ge.  The writt en  notice sha ll des cribe th e chan ge, including all of th e followin g in format ion:

    (i)   The dat e of th e chan ge.

    (ii)    ny chan ge in emissions.

    (iii)    Any pollutant s emitt ed.

    (iv)   Any applicable requirement that  would apply as a result of th e chan ge.

    (v)   A stat ement that  th e notificat ion is being provided pur suant  to th is subru le.

    (d) The person sha ll keep a recor d des cribing chan ges ma de at th e stat ionar y sour ce that result in emissions of an air contam inant which ar e subject to an applicable requirement , but not oth erwise regulat ed un der th e perm it ,  an d  th e  emissions  resulting  from  th e chan ges.

    (4)   The followin g provisions apply to insignificant chan ges.  A person ma y mak e a chan ge at a stat ionar y sour ce cover ed by a renewable operat ing perm it that involves th e insignificant activities listed pur suant to R 336 .1212 (2) or that involves th e insta llat ion, con stru ct ion, recon stru ct ion, relocat ion, alterat ion, or modificat ion of an y pr ocess or pr ocess equipment listed pur suant to R 336 .1212 (3) an d (4) with out a revisi on to th e renewable operat ing perm it , if none of th e followin g provisions apply to th e chan ge:

    (a)   The chan ge would result in a violat ion of an y applicable requirement .

    (b)   The chan ge would require or modify an y of th e following:

    (i)   A case-by-ca se determ inat ion of an emission limitat ion or oth er stan dar d.

    (ii)   For temporar y sour ces, a sour ce-specific determ inat ion of am bient air impacts.

     

     

    (iii)    A visibili ty or increment ana lysis.

    (c)    The  chan ge  would  seek  to esta blish  or  modify  an  emission  limit,  stan dar d, or  oth er con dition  of th e  renewable  operat ing perm it  that  th e  stat ionar sour ce  ha s  assum ed  to avoid an applicable requirement to which th e stat ionar y sour ce would oth erwise be subject. (d)  The  chan ge  is  a  ma jor  offse t  modificat ion  or  a  modificat ion  un der  an y  applicable requirement of section 111 , section 112 , or part C of t it le I of th e clean air act.

    (5)    Chan ges ma de pur suant to th is ru le do not  qua lify for  th e perm it  shield provided  by R 336 .1213 (6).
