    MIOSHA STANDARDS SECTION NOTICE OF PUBLIC HEARING

    MIOSHA Construction Safety Standards Part 26 'Steel Erection'

    Part 28 'Personnel Hoisting in Steel Erection'

     

    Please take notice that pursuant to the provisions of the Administrative Procedures Act (1969 PA 306, MCL 24.242) and MIOSHA (1974 PA 154 as amended, MCL 48.1019, and MCL 48.1021), the

    Department of Labor and Economic Growth will conduct a PUBLIC HEARING to allow all persons an opportunity to present data, views, questions, and arguments relative to proposed amendments as promulgated by the Construction Safety Standards Commission to CS Part 26 ‘Steel Erection' and CS Part 28 ‘Personnel Hoisting in Steel Erection' on:

     

    September 25, 2006

    Oral and/or written testimony will be accepted for the following proposed amendments to the Michigan Administrative Code:

    Part 26 'Steel Erection' - R 408.42602, R 408.42605, R 408.42608, R 408.42609, R 408.42616, R

    408.42628,    R 408.42629,    R 408.42634,    R 408.42636,    R 408.42648,    R 408.42651,    and R 408.42655. To be rescinded are R 408.42624 and R 408.42625. SOAHR #2005-082 LG

    Part 28 'Personnel Hoisting in Steel Erection' - R 408.42801, R 408.42804, R 408.42806, and R 408.42809. SOAHR #2006-062 LG.

     

    The proposed amendments will provide protection for Michigan workers involved in steel erection. The proposed rules will become effective 14 days after filing with the Secretary of State.

     

    Part 26 'Steel Erection' The proposed amendments clarify that riding the headache ball is prohibited EXCEPT in certain  circumstances when  connectors follow the new proposed rule Part 28 'Personnel Hoisting in Steel Erection.' R 408.42624 and R 408.42625 are being rescinded, as they are duplicative.

     

    Part 28 'Personnel Hoisting in Steel Erection' The proposed amendments clarify when and how a connector may be lifted to the workstation via a headache ball.

     

     

    The proposed amendments are published in the September 1, 2006 Michigan Register. Copies of the amendments may be obtained from the address listed below or you may download a copy of the proposed amendments from our website at www.michigan.gov/mioshastandards. The amendments are located under the ‘What’s New’ section.

    Persons attending the hearings are urged to submit a written summary of remarks as part of their presentation. The submissions of a written statement will in no way prohibit or limit the right of oral expression by any persons at the hearings. Persons unable to attend the public hearings may submit separate written data, views, and arguments relative to the proposed amendments by mail, e-mail, or facsimile and must be received no later than 5:00 p.m. on September 25, 2006.
