    NOTICE OF PUBLIC HEARING BOARD OF MEDICINE GENERAL RULES

    BOARD OF OSTEOPATHIC MEDICINE AND SURGERY GENERAL RULES OCTOBER 3, 2012

    9:00 A.M.

    RULE SETS # 2012-035 LR AND #2012-036 LR

     

    The Department of Licensing and Regulatory Affairs will hold a public hearing on Wednesday, October 3, 2012, starting at 9:00 a.m. at the Department of Licensing and Regulatory Affairs, Ottawa Building, 611 West Ottawa, Conference Room 3, Upper Level, Lansing, Michigan.

     

    The public hearing is being held to receive comments on proposed amendments to the Board of Medicine and Board of Osteopathic Medicine and Surgery administrative rules. Public Act 210 of 2011, which took effect on November 8, 2011, amended provisions in the Public Health Code regarding allopathic physicians and osteopathic physicians’ delegation to physician assistants. According to the House Fiscal Agency’s legislative analysis of the Act, the purpose of several of these amendments is to eliminate the current restrictions on physicians’ authority to delegate the prescribing of Schedule 2 controlled substances to physician assistants. As a result, the rules are being revised to eliminate the provisions that restrict allopathic physicians and osteopathic physicians’ authority to delegate the prescribing of Schedule 2 controlled substances to physician assistants. Also, the rules are being revised to clarify and reduce the requirements for the written authorization that allopathic physicians and osteopathic physicians use to delegate the performance of medical care services and the prescription of controlled substances to physician assistants.

     

    These rules are being promulgated under the authority of sections 16145, 17001, and 17501 of 1978 PA 368, MCL 333.16145, MCL 333.17001, and MCL 333.17501 et seq. and Executive Reorganization

    Order Nos. 1996-1, 1996-2, 2003-1, and 2011-4, MCL 330.3101, MCL 445.2001, MCL 445.2011, and

    MCL 445.2030. The rules will take effect immediately upon filing with the Secretary of State, unless specified otherwise in the rules.

     

    Comments on the proposed rules may be presented in person at the public hearing. Written comments may be submitted at the time of presentation and will also be accepted until 5:00 p.m. on October 3, 2012, at the following address or e-mail address:
