  • (1) If a certificate of need review standard requires a data commitment, including Michigan inpatient data base (MIDB) data or cancer registry data, the health facility or freestanding facility committing the data shall be regularly admitting patients and providing services as of the date the director makes the final decision on an application under section 22231 of the code. Further, the department shall not consider any commitment if a health facility or freestanding facility withdrew its commitment before the final decision on an application.

    (2)   If a certificate of need review standard requires a physician commitment, then all of the following apply, unless otherwise specified in a review standard:

    (a)   The commitments shall be submitted at the time the application is submitted to the department.

    (b)    A commitment shall not be withdrawn after the date an application is deemed complete by the department and after a proposed decision to approve an application has been issued by the department.
