  • (1) An applicant that receives either (a) a proposed decision of the bureau which recommends denial of a certificate of need or (b) a notice of reversal by the director, may request a hearing, as authorized by the code. The purpose of the hearing is to allow the applicant the opportunity to demonstrate that the applicant’s completed application meets the requirements for approval under part 222 of the code. In a comparative review, approved applicants cannot request a hearing on a proposed decision regarding a different applicant.
