  • (1) If a petitioner appeals to circuit court regarding a matter that has been appealed to the division pursuant to the provisions of section 322 of the act, the petitioner's appeal before the division shall be deemed withdrawn and the division shall not  hold  a   hearing  on   the matter.

    (2) If the circuit court renders a decision on a matter, the division shall not hold a hearing on the same matter until at least 1 year after the date of the circuit court's final order,  unless   the   circuit   court, administrator, or hearing officer orders otherwise.
