  • (1)      Civil infraction: A violation of  this  code   or  rules substantially corresponding to the Act that is designated a civil infraction is not a crime and shall not be punishable by imprisonment or a penal fine. A civil infraction shall not be considered a lesser included offense

    of any criminal offense.

    (2)       Misdemeanor: Unless another penalty is expressly   provided  by the ordinances of this governmental unit, every person  who  is   convicted  of  a misdemeanor violation of any provision of this code shall be punished by a fine of not more than $100.00 or by imprisonment for not more than   90 days, or both.
