  • (1) The department shall prepare and submit to the regional administrator, on or before February 28, May 31, August 31, and November 30, a list of all dischargers holding national permits which, as of 30 days before the date of the report, have submitted a report to the department pursuant to R 323.2146 showing noncompliance with requirements set forth by the department to be met on interim dates or on the final date of  compliance specified in the permit and those which have not filed a timely report. The noncompliance list shall be available to the public at appropriate department offices for inspection and copying, and shall contain all of the following information:

    (a)  The name and address of each noncomplying permittee.

    (b)   A concise description of the nature of noncompliance.

    (c)   A description of proposed actions to be taken by the department or the permittee to correct the noncompliance.

    (d)    Any other information deemed necessary by the department to explain or mitigate an instance of noncompliance.

    (2)   A discharger who fails or refuses to comply with an interim or final date of compliance specified in a state or national permit may be deemed by the department to be in violation of the permit and may  be  subject  to enforcement action prescribed in part 31 of the act or these rules.
