  • Before commencing the proceedings for denial, suspension, or revocation of a license, the department shall give notice to the applicant or licensee, personally or by mail, of the facts or conduct which warrant the intended action and shall provide the applicant  or  licensee  with an opportunity to show compliance with the public health code for type IV installations, or  the  fire  prevention  code  for type I, II, or III installations and these rules. If, after an opportunity to show compliance, the department determines that the applicant or licensee has failed to show compliance with the applicable code and these rules, then the department may issue an order to deny, suspend, or revoke the license. An applicant or licensee who is aggrieved by a decision of the department to deny, suspend, or revoke a license is entitled to an administrative hearing under 1969  PA 306, MCL 24.201 et seq.  This rule does not apply to emergency orders issued pursuant to subsection (3) of section 13321 of the public health code.
