Section 38.1109. Consideration and disposition of declaratory ruling requests.

Within 90 days after receipt of a complete petition for a declaratory ruling, the board, after consultation, if necessary, with staff and the attorney general will act on the petition. A declaratory ruling shall receive a majority concurrence of the board members present and voting before it is issued to the interested person.
