The Michigan Dep artm ent of En vironm enta l Qua lity (DEQ), Air Qua lity Divisi on, will con duct a public hear ing on proposed administrat ive ru les promu lgat ed pur suant to Part 55, Air Pollut ion Contr ol, of th e Natura l Res our ces an d En vironm enta l Pr otection Act, 1994 P A 451 , as am ended (Act 451 ); R 336 .1102 , R 336 .1104 , R 336 .1105 , R 336 .1107 , R
336 .1108 , R 336 .1113 , R 36.1118 , R 336 .1120 , R 336 .1915 , an d R 336 .1916 . The addition of
R 336 .1915 an d R 336 .1916 will provide com pan ies with a prot ocol for providing evide nce to th e DEQ that th e emission violat ions resulted from a ma lfun ct ion, start -up, or shut down. The DEQ will use th e evide nce in th e determ inat ion of wheth er to use en for cement discretion. The ru les will also provide com pan ies with an a ffirmat ive defense against stat e en for cement actions for excess emissions that ar ise dur ing certa in start -up an d shut down epis odes if pra ctices to reduce th e emissions ar e followed . In addition, th ere ar e proposed chan ges to th e definitions for “excess emissions” an d “ma lfun ct ions,” R 336 .1105 an d R 336 .1113 . The rema inder of th e proposed revisions ar e administrat ive chan ges to updat e th e ru les in a ccor dan ce with Execut ive Orders, mak e corr ections, an d updat e adoptions by reference.
The public hear ing will be held on December 3, 2001 , at 10:00 a.m., in th e Air Qua lity Divisi on Conference Room, Constitut ion Ha ll, 3r d floor , 525 West Allegan Str eet, Lan sing, Michigan .
