    Rule 2201 . This part  perta ins to th e des ign, placement , relocat ion, cover ing, removal,

    use, an d ma int enan ce of signa ls, tra ffic contr ol devices, a ccide nt prevent ion signs, ta gs, an d barr icades for con stru ction operat ions.

     

    R 408 .42211  De finitio ns ; A to C.

    Rule 2211 . (1) "Accide nt  prevent ion sign" mean s a sign used to warn  of a ha zar d or to provide safety instru ctions or directions.

    (2)   "Accide nt prevent ion ta g" mean s a ta g which is used to warn of an existing or imm ediat e ha zar d an d which is temporar ily atta ched to a part of equipment or a stru ctur e.

    (3)  "Barr icade" mean s a readily visible obstru ct ion used to direct th e passage of employees or vehicles.

     

     

     

    (4) "Barr ier" mean s a device that is des igned to prevent penetrat ion from a way of tra vel to ar eas behind th e barr ier to minimize injur y to employees  who  per form  con stru ct ion operat ions.

    (5)   "Caut ion sign or ta g" mean s a sign or ta g used to warn of a potent ia l ha zar d or to warn against an un safe pra ct ice.

     

    R 408 .42213  De fin itio ns ; E to T.

    Rule 2213 . (1) "Exit sign" mean s a sign used to des ignat e a point  of dischar ge from a room or building.

    (2)  “Han dhold mean s an a ffixe d device or des ignat ed place where a person r iding on a moving vehicle or on equipment to per form work can sta bilize his or her position by gripping with his or her free han d or han ds.

    (3)   “Out of order ta g" mean s a ta g used to indicat e a ma chine is ma lfun ct ioning.

    (4)   "Safety instru ct ion sign" mean s a sign used for genera l instru ct ion or suggestion relat ive to safety.

    (5)     Sign mean s a boar d, sheet, poster, or placar d displayed to con vey in format ion or direction eith er temporar ily or perman ent ly.

    (6)  "Signa l" mean s a spe cific use of han ds or a visua l or au dible device, such as a flashing light or horn , to warn of a possible or existing ha zar d.

    (7)   Tag mean s a piece of mat erial, usua lly paper, meta l, or plastic, atta ched to a piece of equipment or stru ctur e for th e pur pose of ident ificat ion, instru ct ion, or classificat ion.

    (8) "Tra ffic contr ol devices" mean s all signs, signa ls, mark ings, an d devices placed or erected for th e pur pose of regulat ing, warn ing, an d guiding vehicular tra ffic an d for providing employee protection in a work zone.

    (9) "Tra ffic regulat or" mean s a person who ha s been tra ined, properly att ired, an d equipped to regulat e tra ffic flow to provide employee protection in a work zone.

     

    R 408 .42221  Duties  of emp loye r.

    Rule  2221 (1)  An  employer  sha ll  provide,  insta ll,   an  ma inta in   signa ls,   signs, barr icades, an d ta gs, as prescribed by th is part , where an employee might be, or  would likely be, injur ed if not alert ed to th e ha zar d.

    (2) An employer sha ll provide tra ining appropriat e to th e work assignm ent for each employee engaged in  activities  cover ed  by th is part .  The followin g ar e exam ples of th e tra ining that  ma y be required:

    (a) Recogn it ion of ha zar ds, such as, but not limited to, possible ma sonr y wall colla pse ar eas, cran e swing ar eas, floor opening cover s, or tra ffic contr ol ha zar ds.

    (b)   Tra ffic regulat or tra ining.

    (c) Pr oper placement an d removal of signs, signa ls, ta gs, an d barr icades.

    (d)   Tra ining in how to per form work in proximity to tra ffic to minimize vulnera bility.

    R 408 .42223  Traffic cont rol.

    Rule 2223 . (1) Tra ffic contr ol devices sha ll be insta lled an d ma inta ined as prescribed in part 6, as revised J anuar y 2001 , of th e 1994 edition of th e Michigan Manua l Of Un iform Tra ffic Contr ol Devices,(MMUTCD) which is adopted in th ese ru les by reference. Part 6 is available for review at th e Michigan Dep artm ent  of  Consum er  an d  Industr y  Services, Stan dar ds Divisi on, 7150 Harr is Drive, P.O. Box 30643 , Lan sing, Michigan , 48909 , or is available at no cost from an y of th e Michigan Dep artm ent of Tran sportat ion (MDOT ) Regiona l Offices , MDOT Service Cent ers, or MDOT Centra l Offices in Lan sing, Michigan .

    (2)    An employer sha ll ensur e that all operat ions ha ve rout ine inspe ct ions of tra ffic contr ol element s for a ccep ta ble level s of operat ion. When tra ffic exposur es ar e such that signs, signa ls, or barr icades do not provide th e necess ar y protection on, or adjacent to, a highway or str eet, tra ffic regulat ors or oth er appropriat e  tra ffic  contr ols  sha ll  be  provided. Modificat ion of tra ffic contr ols, such as additiona l signs or devices, or a chan ge in work operat ions, sha ll be determ ined by a  qua lified  person  who is  resp onsible  for  th e  pr oject tra ffic contr ol.

    (3)  Signa ling directions by tra ffic regulat ors sha ll con form to th e provisions of part 6, as revised J anuar y 2001 , of th e 1994 edition of th e  Michigan  Manua l  of Un iform  Tra ffic Contr ol Devices, which is adopted in th ese ru les by reference.

    (4) A han d-held paddle sign sha ll ha ve 2 faces an d it sha ll be atta ched to a sta ff of suita ble des ign that will a llow th e ent ire un it to be held an d contr olled by 1 tra ffic regulat or. The bott om of th e sign sha ll be a minimum of 6 feet (1.8 meters) above th e roadway sur face. The sign sha ll be fastened to th e sta ff so that no part of th e lege nd is obscur ed.  The port ion of th e sta ff with in th e sign face sha ll mat ch th e sign color s. The sign sha ll not be less than 18 by 18 inches (450 millimeters x 450 millimeters) an d th e lett ers sha ll ha ve a minimum height of 6 inches (150 millimeters). All lett ers an d spacing between lett ers sha ll be as prescribed in part 6, as revised J anuar y 2001 , of th e 1994 edition of th e Michigan Manua l of Un iform Tra ffic Contr ol Devices (MMUTCD) which is adopted in th ese ru les by reference. The lege nd sha ll be optically cent ered horizonta lly on th e sign. One side of th e sign sha ll display a stop face an d th e oth er side sha ll display th e mess age “slow”, except that if it is necess ar y for 1 tra ffic regulat or to stop 2 directions of tra ffic at th e sam e t ime, th en a stop face sha ll be used on each side of th e sign. The stop face sha ll ha ve a red backgroun d with white lett ers an d border. The “slow” face  sha ll ha ve  an  oran ge backgroun d  with  black lett ers an d border. The sha pe of th e sign sha ll be octa gona l an d th e port ions of th e sign oth er than th e diam ond-sha ped “slow” face sha ll be black. When th e sign paddle is used dur ing hour s of darkn ess , th e red an d white of th e stop face an d th e oran ge of th e “slow” face sha ll be reflectorized. Sheet meta l or oth er light semirigid mat erial ma y be used for mount ing th e stop an d “slow” faces.

     

     

     

    (5)    If signa ling by a tra ffic regulat or is necess ar y on con stru ct ion operat ions that ar e not with in a public right -of-wa y, th en a han d-held paddle sign as specified in subru le (4) of th is ru le sha ll be used .

    (6)   The paddle sign sha ll be as follows : DETAIL OF PADDLE SIGN

     

    *NOTE:  The dimensions shown for th e sign ar e minimum . Pr oport ionat ely lar ger paddle signs ma y be used .

     

    (7)     In periods of darkn ess , appropriat e light ing sha ll be used to illum inat e th e  tra ffic regulat or an d th e tra ffic regulat or stat ion. The light ing sha ll be as is required in part 6 of th e Michigan Manua l of Un iform Tra ffic Contr ol Devices (MMUTCD) which is adopted by reference in th is ru le. Appropriat e light ing mean s light ing that illum inat es th e tra ffic regulat or so that he or she is visible  to on com ing tra ffic an d does  not  impair  eith er  th e tra ffic regulat ors or motorists visibili ty due to blinding or sha dowing.

    (8)   An employer sha ll provide, an d a tra ffic regulat or sha ll wear , a vest, a shirt , or a jacket that is flour escent oran ge, yellow, str ong yellow green, or a com binat ion of th ese color s an d sha ll conta in retr o reflective mat erial that is oran ge, yellow, white, silver, or str ong yellow green. A tra ffic regulat ors  vest, shirt , or  jacket  sha ll be  clear ly visible  at  360  degrees thr ough th e full ran ge of body motion day an d night .

    (9)    An employer sha ll require that th e garm ent is inspected befor e each use for all of th e following:

    (a)   Wear .

    (b)   Dama ge.

    (c)   Fa ding.

    (d)  Reflectivity.

    (e)   Oth er deteriorat ion.

    Defective garm ent s sha ll be report ed to th e employer an d th e employer sha ll eith er repair or replace th e garm ent .

    (11) If vehicular tra ffic violat es tra ffic laws an d creat es a ha zar d to employees per form ing con stru ct ion operat ions, th en an employer sha ll notify th e appropriat e law en for cement agencies  of  th e  un it  of  governm ent   exercising  auth ority  over   th e  roadway  for   th e en for cement of applicable speed limits an d oth er tra ffic laws.

     

    R 408 .42224 Ba rri cades for const ruc tio n ope rations on  othe r than  pub li c  ri ght - of-w ay .

    Rule 2224 . (1) A barr icade that ha s a high point of not less than 36 inches (900 millimeters) sha ll be provided to direct vehicular tra ffic to protect an employee per form ing con stru ct ion operat ions.

    (2) A barr icade sha ll be provided to obstru ct or direct an employee from a ha zar dous ar ea of a con stru ct ion operat ion not oth erwise a ffect ed by an oth er stan dar d.

    (3)    If an employee is work ing dur ing a period of darkn ess , th en a barr icade sha ll be ma de visible by am bient illum inat ion or by atta ched light ing.

     

    R 408 .42225 P lacement , remova l, re location , and use of tra ffic  cont rol  devices from a mov ing vehic le ; handho lds .

    Rule 2225 .  Constru ct ion an d ma int enan ce operat ions from a moving vehicle.

    (1)   Constru ct ion an d ma int enan ce operat ions that require placement , relocat ion, or removal of pavement mark ings, or tra ffic contr ol devices such as drum s, barr icades, con es, or signs, sha ll provide protection to an employee by an y of th e followin g meth ods:

    (a)   Use of a seat an d a seat belt.

    (b)    A stan dar d guar dra il system as prescribed in  Constru ct ion  Safety Stan dar d  Part  45 Fa ll Pr otection, R 408 .44501 which adopts C.F.R. §1926 .502 et seq. by reference.     (c)   A guar dra il as described in subdivisi on (b) of th is subru le ma y be modified as follows for th e followin g operat ions as spe cified in para gra phs (i) an d (ii) of th is subdivisi on. These ru les apply only to th e placement , removal, relocat ion, an d use of tra ffic contr ol devices from a moving vehicle, an d do not apply to th e tran sportat ion of an employee or employees out side of th e con stru ct ion influence ar ea (CI A) or from point to point with in th e CIA.

     

     

     

    Tran sportat ion of an employee or employees out side of th e con stru ct ion influence (CI A) or from point to point with in th e CIA ar ea sha ll be as required in C.F.R. §1926 .601 (b)(8) an d (b)(9), which is adopted by reference in Constru ct ion Safety Stan dar d Part 13 Mobile Equipment , R 408 .41301  et  seq. of th e Michigan  Administrat ive Code.  A copy of th ese ru les ar e available at no cost from th e Michigan Dep artm ent of Consum er an d Industr y Services, Stan dar ds Divisi on, 7150 Harr is Drive, P.O.     (i)    For cont inu ous moving operat ions, th e top ra il of a guar dra il ma y be removed at th e point of operat ion when a han dhold is provided an d is used an d only dur ing cont inu ous moving operat ions for th e placement , removal, or relocat ion of tra ffic contr ol devices, such as con es, tu bular devices, or pavement mark ings.

    (ii)    For int erm itt ent stopping operat ions, a section of guar dra il ma y be removed at th e point of operat ion when a han dhold is provided an d is used when int erm itt ent stopping of th e vehicle is required for th e placement , removal, or relocat ion of tra ffic contr ol devices, such as drum s, signs, or pavement  mark ings.   The han dhold sha ll be used by employees at  all t imes when th e vehicle is in motion an d it sha ll be locat ed so that  th e employee is positioned a minimum of 48 inches (1.2 meters) in distan ce from th e ar ea from th e ra iling that ha s been removed.

    (d)   Use of oth er mean s that will provide equivalent fall protection for an employee ma y be used . Such a system sha ll be per forman ce orient ed an d sha ll be des igned so that it does not creat e a great er ha zar d to th e employee.

    (2) A han dhold sha ll be orient ed an d a size to promote gripping by wra pping fingers ar oun d not less than 270 degrees (3 sides ) of th e device or place des ignat ed. The han dhold sha ll be capable of with stan ding not less than 200 poun ds of for ce in an y direction an d be free from rough edges , slippe ry sur faces, or ha zar dous pr oject ions. The han dhold sha ll be in  place an d ident ified as such befor e employees ar e perm itt ed to per form th eir assigned ta sks while r iding on moving vehicles.

     

    R 408 .42229  Signs  gene rally.

    Rule  2229 . (1) A sign  an d  it s  fastening  device  sha ll be  free  of shar p  edges , burr s, splint ers, or oth er shar p pr oject ions that  cou ld creat e a ha zar d.

    (2)   If con ditions warrant th e use of a sign size that is not specified in ta bles 2 to 5, th en th e rat io of th e height of th e ident ifying pan el, such as "DANGER" or "CAUTIO N", to th e width of th e sign sha ll be ma inta ined as prescribed in th e ta bles .

    (3)    Signs sha ll be removed or cover ed when th e ha zar d addressed by th e sign no longer exists.

     

     

     

    R 408 .42230  Lett er sty le and  size .

    Rule 2230 . (1) A lett er sha ll be block style an d uppe r case for th e top pan el an d uppe r or uppe r an d lower case for th e bott om pan el.  Lett ers an d num bers sha ll be legible.

    (2)   Lett er size sha ll be determ ined by th e length of th e mess age an d th e ma ximum visibili ty an d readability. Table 2 sha ll be used as a guide for th e minimum lett er height at a safe viewi ng distan ce.

    (a)   The spacing of lett ers an d words sha ll not reduce legibili ty.

    (b)     The height of a lett er that is more than 5 inches (125 millimeters) high  sha ll  be increased by an additiona l 1 inch (25 millimeters) for each 35 feet (10.5 meters) of viewi ng distan ce.

    Rule 2233 . (1) A dan ger  sign  to alert  employees sha ll be  used  where an  imm ediat e ha zar d exists.  The sign sha ll be removed when th e ha zar d no longer exists.

    (2)   The proport ions for a dan ger sign sha ll be not less than th ose prescribed in ta ble 3 an d th e format  of figur e 1 sha ll be followed .

    (3)   A dan ger sign sha ll ha ve th e signa l word "dan ger" in white with in a red oval out lined in white on a black rectan gular backgroun d in th e uppe r pan el. The lower pan el where additiona l wording ma y be used sha ll be black or red lett ers on a white backgroun d as shown in figur e 1.

    (2)  The sign sha ll be ent irely visible in daylight  an d at  night  from a distan ce of not less than  600 feet (180 meters).
