7 CORRECTION OF OBVIOUS ERRORS IN PUBLICATION

    SUBJECT:    Request  for correction of MIOSHA Part 18 'Fire Protection  and Prevention,’ Rule R 408.41801, pursuant to Administrative Procedures Act, Section 56(1), MCL 24.256 (1).

     

    The MIOSHA Standards Section, as a promulgating agency, is writing to request that the State Office of Administrative Hearings and Rules exercise its discretion to an obvious error in the MIOSHA Rules, pursuant to the Administrative Procedures Act, Section 56(1), MCL 24.256 (1).

     

    The error is in section R 408.41842(1), which references subrule (8). The subrule (8) was changed to

    (6) at the last amendment on September 10, 2002; in fact there is no longer a subrule (8) in this section. The reference needs to be corrected to the new subrule number.

     

    The language should read as follows:

     

    R 408.41842 Employee Emergency Action Plans.

    Rule 1842. (1) This rule applies to all emergency action plans required by a particular MIOSHA or OSHA safety or health standard. The emergency action plan shall be in writing, except as provided in subrule (6) (8) of this rule, and shall cover the designated actions that employers and employees must take to ensure employee safety from fire and other emergencies.
