8 CORRECTION OF OBVIOUS ERRORS IN PUBLICATION

    SUBJECT:      Request for correction of MIOSHA Part 11 ‘Recording and Reporting of Occupational Injuries and Illnesses,’ Rule R 408.21101, pursuant to Administrative Procedures Act, Section 56(1), MCL 24.256 (1).

     

    The MIOSHA Standards Section, as a promulgating agency, is writing to request that the State Office of Administrative Hearings and Rules exercise its discretion to an obvious error in the MIOSHA Rules, pursuant to the Administrative Procedures Act, Section 56(1), MCL 24.256 (1).

     

    The error is in section R 408.22151, which references a rule number R 408.21133 that was changed to rule number R 408.22153 during the amendment on December 12, 2001. The reference needs to be corrected to the new section number.

     

    The language should read:

     

    R 408.22151 Public employer petition for alternate record maintenance.

    Rule 1151. A public employer who wishes to maintain records in a manner different from that required by this part shall submit a petition containing the information prescribed in R 408.22153  21133  to the Department of Consumer and Industry Services, Bureau of Safety and Regulation, State Secondary Complex, 7150 Harris Drive, Box 30643, Lansing, Michigan 48909.
