R 285 .628 .1   De fi n itio ns .

Rule 1.  As used in th ese ru les:

(a)    "Certifiable seed potat oes" mean s seed potat oes w h ic h ar e eligible  fo r ce rt ific at io n  a s clo n es , clo n e i n c r e a se, p r e m ie r fo un d at io n , fo un d at io n , o r ce rt ifie d seed, which meet or exceed th e stan dar ds es ta blis hed in th ese ru les, an d which ar e produced an d stored as required by th ese ru les, AND WHICH. Ce rt ifi a ble seed po tat oes ma y a l so originat e from a stat e-app roved laborat ory or greenhouse program that involves in vitro techn iques of propagat ion an d th e subseq uent production of plant s  or  tu bers  un der  a  contr olled environm ent.   Seed  stock produced  un der  th ese  contr olled con ditions sha ll be  designat ed p r enuclear. Seed originat ing from th is program will be produced in a limited generat ion system of March 20, 2001 nu cle ar , ge n e rat io n I , ge n e rat io n II , ge n e rat io n III , ge n e rat io n IV, an d  ge n e rat io n  V  seed .  FOUNDATIO N-FIELD  YEARS  1  THROUGH  5,  AND CERTI FIED FIELD YEARS 1 THROUGH 6. Nu cle ar seed FOUN DATIO N-FIELD YEAR 1, is th e first field progeny of NUCLEAR seed produced in a laborat ory or greenhouse program . Initial expl ant s sha ll be screened for th e prese nce of path ogens by using accep ted techn iques.

(b) "Cert ificat ion" mean s th e act of verifying com pliance with th e stan dar ds or requirement s specified in th e regulat ions govern ing th e production of seed potat oes. Excep t as oth erwise specified, th e measur ement method or basis for determ ining com pliance with th e stan dar ds is visua l inspection of th e growing groun ds an d crops th ereon or har vested th erefrom as describe d in th e regulat ions. "Cert ificat ion" does not con stitut e a guarant ee or warrant y or rep rese ntat ion that  th e seed potat oes to which th e indicia of cert ificat ion (cert ificat ion ta gs,

 

 

seals, bulk cert ificat es) ar e atta ched, or which ar e oth erwise represe nt ed as cert ified, ar e merchanta ble or fit for a part icular pur pose.

(c)  "Cert ified seed " mean s A CLASS OF SEE D WHICH MEE TS THE DIS EASE AND VARIE TAL TOL E RANCE S E STABLIS HE D BY THE SE RULE S F OR F IE LD YEAR 1 THROUGH FIELD YEAR 6 AND WHICH IS th e progeny of foun dat ion seed or th e progeny of seed produced in an oth er stat e or countr y that is cert ified as foun dat ion seed or a higher class by an official seed -cert ifying  agency  in  th e  oth er  stat e  or  countr y  using stan dar ds com para ble to th e stan dar ds esta blished in th ese ru les. CERTI FIED SEE D FROM OTHE R  STATES  OR  COUN TRI ES  THAT  IS  TO  BE  EN TERED  FOR CERTI FICATIO N  IN  MIC HIGAN  MUS T   MEE T   OR   EXCEE D   MIC HIGAN ?S CERTI FIED SEE D STANDARDS .

(D)    C? OMMERCI AL POTATO PRODUCTIO N?MEANS PRODUCTIO N OF POTATOES FOR OTHE R THAN CERTI FIED SEE D PU RPOSES.

(E)    "FIELD YEAR" MEANS A SEE D POTATO CLASSI FICATIO N DESIGN ATING THE NU MBER OF YEARS A PARTIC ULAR LOT HAS BEEN GROW N IN THE FIELD AFTER GREENH OUSE PROPAGATIO N.

(d)      ) (F) "Foun dat ion seed " mean s th e progeny of p r e m ie r foun d at ion NU CLEAR seed or a compara ble seed class approved by th e cert ifying agency. FOUN DATIO N SEE D SHALL MEE T THE DIS EASE AND VARIETAL TOL ERANCES ESTABLIS HE D IN THE SE RULES FOR FIELD YEAR 1 THROUGH FIELD YEAR 5.

(f)"Pr e m ie r foun d at ion seed " m e an s th e p r oge n y of seed p otat oes p r od u ced in a p r ogram of h ill se le ct ion an d clona l in cr e a se or  a  com p ara ble seed  cla ss a pp r ove d by th e ce rt ifyin g a ge n cy.

(g)   "Pr e -nu cle ar NU CLEAR seed st ock " mean s propagat ion mat erial, including mini-tu bers an d plant lets, which originat ed in a stat e-approved laborat ory or greenh ouse program that involves in vitr o techn iques an d which is grown un der contr olLED con ditions.

(e) (H) "Ope rat ion" mean s a seed potat o ent erprise where th e lowes t class of seed plant ed is cert ified, or ge n e rat ion V. FIELD YEAR 6. It includes all lan d, equipment , stora ges, AND facilities, an d la bor e r s used to produce cert ified seed .

(h)  ) (I) "Seed lot" mean s all th e seed potat oes of th e sam e var iety which ar e of a single class, which ar e of a specific seed sour ce, an d which ar e har vested from a field or stored togeth er in a spe cific stora ge facility.

(i)   (J ) "Seed potat o" mean s th e tu ber that  is used for th e  reproduction of th e potat o.

(j)   (K) "Seed potat oes eligible for cert ificat ion" mean s an y of th e followin g:

(i)      Any potat o var iety that ha s been released , nam ed, an d ha d it s des cription published by th e potat o ass ociat ion of America, Un ited Stat es dep artm ent of agricultur e, or a recogn ized stat e agricultura l expe r iment stat ion.

(ii)      Unnam ed expe r im e nta l seed lin gs an d nam ed var ie t ie s CULTI VARS that do not ha ve published descriptions, such as advan ced lines from breedi ng program s an d p at e nt ed PROTECTED var ieties, if th e seed sour ce is approved by th e officia l seed -cert ifying agency an d a plant an d tu ber des cription is provided to th e officia l seed -cert ifying agency.

(iii)      Lines, selections, an d tran sgenic seed st ocks which ar e derived from previously nam ed an d described var ieties,  which ent er an approved t issue cultur e program , an d which carr y a tra it or tra it s that ar e not visibly cert ifiable if th e lineage is clear ly substant iat ed by signed a ffida vit.

 

 

(k) ) (L) "Sep arat e operat ion" mean s a distinct production  un it  which  ha s  a  un ique  an d ded icat ed stora ge facility an d which ha s equipment that is assigned only to that operat ion. Sep arat e operat ions sha ll be des ignat ed at th e t ime of applicat ion for cert ificat ion.

(l)   (M) "Toleran ce" mean s a perm issible allowan ce for a disease, var ieta l mixtur e, or gra de defect as specified in th e regulat ions govern ing th e cert ificat ion of seed potat oes.

Rule 2. The Michigan cr op im p r ove m e nt a ss ociat ion SEE D POTATO ASSOCI ATIO N is des ignat ed as th e officia l seed -cert ifying agency of th e dep artm ent of agricultur e for th e pur pose of assisting an d advising th e dep artm ent in carr ying out th e provisions of Act N o. 221 of th e Pu blic Act s of 1959 ,  a s  am e n ded ,  bei n g  286 .71  t o  286 .75  of  th e  Mich igan Com p ile d L a ws , 1959 PA 221 , MCL ET SEQ. an d th ese ru les.

 

R 285 .628 .4  Conditions   for ce rtifi cation .

Rule 4. (1) A seed lot that is eligible for cert ificat ion sha ll not be cert ified if an y of th e followin g con ditions exist:

(b)     The seed lot  is  plant ed  less  than  5  feet  from  oth er  potat oes  that  ar e  part  of  th e cert ificat ion program  or  less  than  50  feet  from  oth er  potat oes  that  ar e  not  part  of  a cert ificat ion program .

(c)   The seed lot is grown in a field in which weeds , insect injur y, spra y dama ge, disease, or an y oth er factor that prevent s th e adequat e inspection or  production  of cert ifiable  seed potat oes is present .

(d) The seed lot is plant ed on lan d USE D FOR COMM ERCI AL POTATO PRODUCTIO N OR that ha s been exposed to infection from bacterial r ing rot dur ing th e  preceding  2 growing seasons.

(e)  The seed lot ha s been  exposed  to bacterial r ing rot  infection  befor e, dur ing, or  after har vest.

(f) The seed lot is stored, gra ded, or han dled in stora ge facilities that conta in potat oes that were not field-inspected or potat oes that  were rejected for th e prese nce of bacterial r ing rot.

(g)    Severe FOLI AR DIS EASES  INCLUDING lat e blight , EARLY BLIG HT, AND WILT DIS EASES SUC H AS VERTICILLI UM, blackleg, AND FU SARIUM; frost injur y, or an y oth er con dition that  renders th e seed lot un desira ble for use as seed is prese nt .

(h)   Bacterial r ing rot is prese nt in a seed lot in th e operat ion. All seed st ocks of that  lot ar e to be removed from th e operat ion. All equipment an d facilities  that  ma y ha ve com e in conta ct with th is seed sha ll be clean ed an d disinfected. The first lot of seed cut or plant ed, or cut an d plant ed, after th e infected lot  is  not  cert ifiable  an d is not  eligible  for  sale as cert ified seed for 1 growing season. These lots  ma y be  reta ined  in  th e operat ion  in  th e cert ified inspection system an d ma y be reent ered as seed that is eligible for cert ificat ion th e followin g year if bacterial r ing rot is not noted. The classificat ion level for th ese lots sha ll be reta ined un der th e norma l generat ion system as if th ey were eligible for cert ificat ion. All oth er seed  lots in th e operat ion ma y be cert ified, but  sha ll not be sold for futur e seed

 

 

propagat ion for 1 growing season. All shipping an d inspection docum ent s for th ese lots that ar e sold dur ing th e first year after disease ident ificat ion sha ll indicat e that th e seed is not to be used for seed propagat ion. If bacterial r ing rot is detected in an operat ion in more than 1 seed lot in th e sam e year or in 1 seed lot 2 of 3 con secut ive year s, THEN all seed st ocks sha ll be removed from th e operat ion an d all equipment an d facilities sha ll be clean ed an d disinfected befor e furth er cert ificat ion will be issued. If bacterial r ing rot is detected in an operat ion in more than 1 seed lot in th e sam e year or in 1 seed lot 2 of 3 con secut ive year s or noncert ified production occurr ed in th e previous year of operat ion, th en seed potat oes ma y WILL NOT be approved for sale or tran sfer from th e operat ion for futur e TO OTHE R seed propagat ion  OPE RATIO NS  FOR  2  GROWI NG  SEASONS .  a ccor d in g  t o  th e  followin g s ch ed u le :

(i) F ir s t ye ar - ce rt ifie d . or ge n e rat ion V seed .

(ii) Se con d ye ar - foun d at ion -F I E LD YE AR 5 . or ge n e rat ion I V seed .

Cutt ing an d plant ing equipment is to be th oroughly clean ed an d disinfected between lots an d th e  disinfection sha ll be docum ent ed for futur e reference by th e officia l seed -cert ifying  agency.  This docum entat ion sha ll be part of th e applicat ion for cert ificat ion. Mat erials that ar e used to disinfect cutt ing an d plant ing equipment sha ll be of a type LABELED FOR BACTERIAL DIS EASE CONTROL . a pp r ove d for that p ur p ose by Mich igan s tat e un ive r s it y.

(i)   Seed lots which ar e eligible for sale or tran sfer an d which ha ve not been wint er-tested or laborat ory-tested OR FOR WHICH A SAMPLE OR SAMPLES HAVE NOT BEEN SUBMITT ED FOR WINT ER TESTING by an organ izat ion approved by th e official seed - cert ifying agency or th e Michigan dep artm ent of agricultur e.

(j)   Bacterial r ing rot-infected potat oes an d oth er plant part s that might provide a sour ce of contam inat ion or cull potat oes from an oth er locat ion or farm ar e stored or disposed of at , or ar e intr oduced int o, th e operat ion.

If a potat o disease of  significant  impact  to  th e  seed  industr y  is  ident ified  for  which cert ificat ion stan dar ds ha ve not been esta blished in th ese ru les, THEN th e director sha ll appoint an advisory comm itt ee to provide recomm endat ions for  appropriat e cert ificat ion stan dar ds an d actions. The comm itt ee sha ll con sist of 1 cert ified OR FOUN DATIO N seed potat o producer an d 1 represe ntat ive each from ALL OF THE FOLLOWI NG:

The dep artm ent of b otan y an d plant path ology an d th e dep artm ent of crop an d soil sciences at  Michigan  stat e  un iversity.  The  officia l  seed -cert ifying  agency, an d.  The  Michigan dep artm ent of agricultur e. The signed a ffida vit required for th e genetic mat erial defined in R 285 .628 .1(j)(iii) sha ll be provided by th e applicant to th e officia l seed -cert ifying agency upon request, in order to propagat e an d cert ify th is mat erial in Michigan . The cert ified seed ta g for th is mat erial sha ll specify that it ha s met all cert ificat ion stan dar ds, except for nonvisua l chara cteristics. The plant an d tu ber  des criptions  an d  an y required  a ffida vits sha ll be in a format  approved by th e officia l seed -cert ifying agency.

Except  as  oth erwise  specified,  th e  measur ement   meth od   or   basis   for   determ ining com plian ce with th e stat ed toleran ces is visua l inspection of a sam ple of th e plant s or tu bers in  th e  field  or  lot,  respe ctively.    Furth er,  except  as  specified,  sam ple  sizes  ar e  at  th e d is cr e t ion of TO BE DETERMI NE D BY th e cert ificat ion agency.  Dise ases ,  var ieta l mixtur es,  or  gra de  defects  ma y  be  prese nt  at  a  level  in  excess  of  specified  toleran ces;

 

 

however, disease symptoms, var ieta l mixtur es, an d gra de defects ma y  SHALL  not  be visua lly detecta ble at th e t ime of officia l inspection due to num erous factors, including environm enta l conditions an d  var ieta l differ ences.  Furth erm ore, even  th e inspection  of lar ger sam ples might not reveal deviat ions in excess of specified toleran ces. Fina lly, with respe ct to th e zero toleran ces for such defects as  var ieta l mixtur e, bacterial r ing rot,  an d r oot kn ot nemat ode AND SPINDL E  TUBER,  th e  toleran ces  ar e  chosen  for  reasons  of con venience an d pra ct icality an d ar e not con stru ed to mean that th e lot inspe cted is free of th e defects. Negat ive inspection results mean that var ieta l mixtur e, bacterial r ing rot, or root kn ot nemat ode OR SPINDL E TUBER were not foun d dur ing th e inspection pr ocess . ONLY  SEE D  LOTS  PRODUCED  FROM   FOUN DATIO N   CLASS   MATERIAL   OR BE TTE R IS E LIGIBL E F OR SALE OR TRANSFE R F OR RE CE RTI F ICATIO N.

R 285 .628 .5  Official  seed -ce rtif ying  agency ; duties .

 

 

Rule 5.  The official seed -cert ifying agency sha ll do all of th e following:

(a)      Mak e 2 or more inspections of all fields of seed potat oes eligible for cert ificat ion an d all p r enu clear seed st ock eligible for cert ificat ion. An applicat ion for such cert ificat ion sha ll be filed a ccor ding to th e requirement s of R 285 .628 .3. Inspections sha ll be ma de at t imes when plant growth an d oth er con ditions ar e optimum for var ieta l ident ificat ion an d disease expressi on.  All potat o production sha ll ha ve at least 1 field inspection for r ing rot.

(b)     Mak e at least 1 tu ber inspection of all seed lots ent ered for field inspection cert ificat ion.

(c)    At least annua lly an d befor e th e esta blishm ent of each greenh ouse crop, inspe ct stora ge, laborat ory, greenh ouse, an d screenh ouse facilities for proper isolat ion an d san itat ion.  If both greenh ouse or laborat ory production an d th e field production ar e inspe cted by th e officia l seed -cert ifying agency, THEN th ey will be con sidered sep arat e production un it s. If only th e greenh ouse or laborat ory production or only th e field  production  is  inspe cted, THEN it will be con sidered 1 un it .

(d)     Collect, or cau se to be collect ed, represe ntat ive tu ber or plant sam ples of cert ifiable seed potat oes for wint er testing or oth er tests as ma y be required for cert ificat ion.

(e)           Iss ue cert ificat ion ta gs, OR BULK CERTI FICATES for each conta iner or bulk shipment of cert ifiable potat oes or, upon request by an applicant who ha s sold seed potat oes that WHICH mu st be  shipped  befor e  th e  wint er  test  results  ar e  kn own  an d  which  ar e oth erwise cert ifiable, issue ce rt ificat ion ta gs OR BULK CERTI FICATES for each conta iner or bulk shipment that conta ins th e stat ement that th e potat oes MET SUMM ER FIELD AND LABORATORY CERTI FICATIO N REQUI REMEN TS BUT WERE SHIPPE D we r e ce rt ifie d before th e OFF ICI AL wint er test results WERE AVAILABLE.

(f)   Apply inspection toleran ces to field inspections an d wint er tests on th e basis of visua l obse rvat ions, except when deemed appropriat e by th e cert ifying agency to con firm visua l obse rvat ions or suspected lat ent infections by la borat or y ANALYTIC AL meth ods.

(a)    Less than all of th e potat o acreage on th e farm producing such lots was plant ed with seed that  ha d been cert ified.

Rule 9. All cla sses EACH LOAD of seed sha ll be inspected for gra de at th e t ime of shipping to com plete th e cert ificat ion pr ocess . The inspection ma y be ma de by th e fede ra l- stat e inspe ct ion service or by th e cert ifying agency. A shipping t ime inspe ct ion for gra de sha ll be ma de each t ime a lot LOAD of seed potat oes is tran sferr ed or shipped . A cert ificat e of inspection sha ll a ccom pan y each shipment .

Rule 11. (1) Gra des an d sizes of nu cle ar , ge n e rat ion  I , ge n e rat ion  II , ge n e rat ion  III , ge n e rat ion I V, ge n e rat ion V, p r e m ie r foun d at ion , foun dat ion an d cert ified classes of seed sha ll con form to th e curr ent Un ited Stat es stan dar ds for gra des of seed potat oes effect ive Mar ch 6, 1987 . These stan dar ds ar e adopted in th ese ru les by reference an d ar e available from th e Superint endent of Docum ent s, Un ited Stat es Governm ent Pr int ing Office, Washington, DC 20402 , at no cost , or from th e Michigan Dep artm ent of Agricultur e, P.O. Box 30017 , Lan sing, Michigan 48909 , at no cost.

(2)   Blue ta g gra de seed potat oes sha ll be in com plian ce with th e requirement s of th e Un ited Stat es no. 1 seed potat o gra de. The size sha ll be not less than 1 1/2 inches an d not more than 3 1/4 inches in diam eter or more than  12 oun ces in weight , un less oth erwise specified. If stones ar e prese nt , th ey sha ll be duly noted on th e gra de inspe ct ion report .

(3)  Yellow ta g gra de seed  potat oes sha ll be in com plian ce with th e blue ta g Un ited Stat es no. 1 seed potat o gra de stan dar ds, except that , to allow for var iat ions incident  to proper gra ding an d han dling, BOTH OF th e followin g toleran ces ar e perm itt ed:

(a) The a llowan ce for sprout s ma y be exceeded after Mar ch 15.

(i)   Twelve percent for externa l or int erna l defects based on th e followin g allowan ces:

(a )(A) Six percent for dama ge, including not more than 2 3% for serious dama ge due to dry or moist-type fusar ium tu ber rot.

(b)(B)  Six percent for serious dama ge due to oth er defects.

(c)  (C) Tota l serious dama ge sha ll not be more than  6%.

(ii)   One percent for frozen, soft rot, or wet break down.

(4)   All sellers an d pur cha sers of a given lot of red ta g gra de seed potat oes sha ll joint ly agree as to size an d defects, except that NEI THE R OF th e followin g toleran ces sha ll n ot be exceeded :
