    Administrat ive Code ar e am ended, an d R 339 .18930 is added to th e Code, as follows:

     

    PART 1. GENER AL PROVISIONS

     

    R 339 .18901   De finitio ns.

    Rule 1. (1) As used in th ese ru les:

    (a)  "Act" mean s 1980 PA 299 , MCL 339 .101 et seq., an d known as th e occu pat iona l code.

    (b) "Boar d" mean s th e boar d of exam iners in mortuar y science.

    (c) "Chan ge in ownership" mean s a chan ge in th e form of ownership or a chan ge of owners, partn ers, officers, or directors.

    (d) "Dep artm ent" mean s th e dep artm ent of con sum er an d industry services.

    (e) "Esta blis hm ent working hour s" mean s 8 a.m. to 10 p.m.

    (f) "Full-time" mean s not less than  40 hour s per wee k.

    (g)  "Mana ger"  mean s  a  mortuar y  science  licensee  who is  responsible  for  th e  day-to-d ay administrat ion of a fun era l es ta blis hm ent.

    (h)   "Report ing  period"  mean s  work  which  is  perform ed  by  a  reside nt  tra inee  betwee n J anuar y 1 an d J un e 30 an d which is report ed to th e dep artm ent by J uly 15 or work which is perform ed by a reside nt tra inee betwee n J uly 1 an d December 31 an d which is report ed to th e dep artm ent by J anuar y 15 of th e following year .

    (i) "Sponsor" mean s a mortuar y science licensee who ha s held a mortuar y science license for not  less  than   5  year s,  who  ha s  agreed  to  supervise  an d  instru ct  a  reside nt  tra inee  as required by  R 339 .18925 , an d who ha s not ha d an y disciplinar y action tak en against him or her with in th e last 5 year s.

    (2)    The term s defined in art icles 1 an d 18 of th e act ha ve th e sam e mean ings when used in th ese rules.

     

     

    R 339 .18905   Boa rd mee ti ngs .

    Rule 5. (1) All boar d meetings ar e held in accordan ce with 1976 PA 267 , MCL 15.261 et seq., kn own as th e open meetings act, an d ar e open to th e public.

     

    P ART 2. LICENS ING

     

    R 339 .18921   Lic ensu re educa tio n requiremen ts .

    Rule 21. (1) As required by section 1806 of th e act, for educat ion com pleted after J anuar y 1, 2002 , th e 3 -year cour se in mortuar y science sha ll con sist of both of th e followin g:

    (a)   Completion, with not less than a 2.00 avera ge, of not less than 60 semester or 90 quart er hour s of non-remedial college level cour ses at an  a ccr edited  college  or  un iversity, which sha ll include all of th e followin g:

    (b)    Completion, with  not less than  a 2.00 avera ge, of 1 academic year  of instru ct ion in an a ccr edited mortuar y science program or a program deemed by th e dep artm ent to be equivalent to an a ccr edited program . The dep artm ent adopts by reference th e a ccr editat ion stan dar ds  conta ined  in  th e  American  Boar d  of  Fun era l  Service  Educat ion  manua l  on a ccr editat ion,  revised   October,  2000 ,  for  mortuar y  science  instru ct ion  com pleted  after J anuar y 1, 2002 . Copies of th e manua l ar e available from th e American Boar d of Fun era l Service Educat ion, 38 Florida Avenu e, Port lan d Maine 04103 , or from th e Dep artm ent of Consum er an d Industr y Services, P.O. Box 30018 , Lan sing, Michigan 48909 -7518 , at a cost as of th e t ime of th e adoption of th ese ru les of $50 .00. The dep artm ent sha ll distr ibut e, with out cost , a list of th e program s a ccr edited in a ccor dan ce with th e manua l.

    (2)   The dep artm ent ma y waive not more than 6 month s of an applicant 's reside nt tra ining upon  th e  receipt  of  pr oof  that   an  applicant  possesses   a  ba cca laur eat e  degree  from  an a ccr edited college or un iversity. A reside nt tra inee who ha s received a waiver un der th is subru le is not exempt from fulfilling th e requirement s of R 339 .18923 , R 339 .18925 , an d R 339 .18927 .

    (3)   For educat ion com pleted befor e J anuar y 1, 2002 , th e 3-year cour se in mortuar y science educat ion sha ll con sist of both of th e followin g:

    (a) Completion, with not less than a 2.00 avera ge, of not less than 60 semester or 90 quart er hour s of nonr emedial college level cour ses at  an  a ccr edited  college  or  un iversity, which sha ll include th e followin g subjects:

    (vii)    Comput er science                                            3 semester or 4 quart er hour s.

     

     

    (b)    Completion, with  not less than  a 2.00 avera ge, of 1 academic year  of instru ct ion in an a ccr edited mortuar y science program or a program deemed by th e dep artm ent to be equivalent to an a ccr edited program . The dep artm ent adopts by reference th e a ccr editat ion stan dar ds  conta ined  in  th e  American  Boar d  of  Fun era l  Service  Educat ion  manua l  on a ccr editat ion  revised  Sep tember,  1990  for  mortuar y  science  instru ct ion  com pleted  after J anuar y 1, 1993 . Copies of th e manua l ar e available from th e American Boar d of Fun era l Service Educat ion, 38 Florida Avenu e, Port lan d Maine 04103 , or from th e Dep artm ent of Consum er an d Industr y Services, P. O. Box 30018 , Lan sing Michigan 48909 -7518 , at a cost as of th e t ime of th e adoption of th ese ru les of $50 .00.

    (4)   An applicant who possesses  a ba cca laur eat e or higher degree from an a ccr edited college or un iversity is deemed to ha ve sat isfied th e requirement s of subru le (1)(a ) an d (3)(a ) of th is ru le.

     

    R 339 .18927   Res id en t trai ning repo rt s .

    Rule 27. (1) To receive credit for reside nt tra ining, each reside nt tra inee sha ll file with th e dep artm ent an embalming report which verifies that a minimum of 5 embalmings were per form ed by th e tra inee dur ing th e previous 6-month report ing period.

    (2) The dep artm ent ma y reject an embalming report that is filed by a reside nt tra inee if th e report is ina ccurat e, in com plete, or is filed after th e due dat es of J anuar y 15 an d J uly 15. The rejection of an embalming report ma y also result in th e loss of tra ining t ime for th e period cover ed by th e rejected report s. Fa ilur e to notify th e dep artm ent of a chan ge in sponsor as required by R 339 .18923 ma y result in th e loss of  tra ining  t ime  an d  th e rejection of embalmings per form ed un der th e new sponsor.

     

    R 339 .18929   Exa mina tio n.

    Rule 29. (1) The exam inat ion sha ll be given in 2 part s as follows :

    (a)     A nat iona l  writt en  exam inat ion  on  subjects  relat ing  to mortuar y  science,  including questions in all of th e followin g ar eas:

    (i)   Em balming.

    (ii)   Anat omy.

    (iii)    Chemistr y.

    (iv)   Path ology.

    (v)   Bacteriology.

    (vi)   Res torat ive art .

    (vii)    Mortuar y administrat ion. (viii) Fun era l service.

    (ix) Fede ra l laws an d regulat ions.

    (b)   A writt en exam inat ion on Michigan laws an d ru les.

    (2) An applicant sha ll com plete all educat iona l an d tra ining requirement s befor e tak ing th e exam inat ion on Michigan laws an d ru les.

    (3)  The exam inat ion  sha ll be  administered  not  less  than  once a  year  at  such  t imes  an d places as th e dep artm ent designat es.

    (4)  An applicant  sha ll not be licensed  un less he or she ha s achieve d a minimum  passing score of 75 on each part of th e exam inat ion.

     

     

    (5)      An applicant for a recipr oca l license who ha s com pleted a nat iona l exam inat ion equivalent to th e exam inat ion required in subru le (1)(a ) of th is ru le sha ll only be required to com plete th e writt en exam inat ion on th e law an d ru les of Michigan .

     

    R 339 .18930   Re li censu re.

    Rule 30.  (1) A person who ha s a lapsed or expired license an d who seeks  relicensur e at a t ime that is more than 3 year s from th e dat e of lapse  or  expirat ion  sha ll meet  curr ent educat iona l requirement s for relicensur e an d pass th e curr ent writt en exam inat ion on th e law an d ru les of Michigan .

    (2) A person who is seek ing relicensur e an d  who  ha s  previously  passed  a  nat iona l exam inat ion equivalent to th e exam inat ion required in Rule 339 .18929 (1)(a) does not ha ve to repe at th e nat iona l exam inat ion.
